HomeMy WebLinkAboutORDINANCE - 2043 - 5/23/1989 - TAXICAB OPERATORS PERMITNO. 2043 AN ORDINANCE AMENDING SECTIONS 18.4219, 18.4220, 18.4221 AND 18.4222 PERTAINING TO TAXICAB OPERATORS PERMIT OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE WHEREAS, the Chief of Police of the Village of Elk Grove Village is primarily responsible for enforcing provisions of the Municipal Code pertaining to taxicab licenses and operators permits; and WHEREAS, the Chief has advised the Board of his recommen- dation to amend the current regulations with respect to taxicab operators permit so that said regulations may be consistent with similar regulations of neighboring municipalities; and WHEREAS, the President and Board of Trustees find and believe that the amendments as set forth in this Ordinance are in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Sections 18.4219, 18.4220, 18.4221 and 18.4222 of the Municipal Code be and the same are hereby amended to read as follows: 18.4219 Operators Permit/Application. It shall be unlaw- ful for any person to operate a taxicab within the Village of Elk Grove Village without first having obtained a valid operators permit there- fore as herein provided. It shall be unlawful for any person owning or controlling any taxi- cab to employ or permit any person to operate a taxicab within the Village unless such driver has a valid operators permit issued by the Village. Any person desiring to secure an operators permit or renewal thereof shall make application in writing therefore to the Village Clerk. The application for the permit shall contain the name of the applicant; his residence and employ- ment history; driver's license number and current status thereof; information as to whether the state driver's license has ever been suspended or revoked and if so, when and for what cause; a list of all convictions, if any, for violation of federal, state or municipal laws; and such other information as deemed appropriate by the Chief of Police. 18.4220 Qualifications/Investigation/Issuance/Reciprocity. A. Qualifications. 1. Every applicant for a public passenger vehicle chauffeur's license shall be no less than twenty-one (21) years of age. 2. The applicant must pass a physical exami- nation by a licensed physician, at his own expense, subject to the examination con- ditions on the form provided by the Village of Elk Grove Village. Such certificate sets forth the opinion of the examining physician that the applicant is physically able to engage in the driving of public passenger vehicles without risk to the public. 3. The applicant must be the holder of a valid State of Illinois Driver's license. 4. The applicant must not have been convicted of any felony or Class A misdemeanor within the past five (5) years. 5. The applicant must not have had his driver's license suspended or revoked in any state within the past three (3) years as a conse- quence of violations of law concerning his operation of a motor vehicle. B. Investigation. Upon filing of such applica- tion, the Chief of Police shall make or cause to made a careful and diligent investigation, -2- including fingerprinting of applicant. The report of such investigation and a copy of the traffic and police record of the appli- cant, if any, shall be considered in evalu- ating the application. C. Issuance. If the Chief of Police shall be satisfied that the applicant satisfies the requirements set forth in the above Sections, and is a fit person to be licensed, such appli- cation shall be approved and the license issued. The operators license shall be displayed at all times in the taxicab driven by the oper- ator in plain view of the passenger. It shall be unlawful to transfer any operators permit from one person to another. D. Regional Reciprocity. The Chief of Police is authorized to issue a license to any appli- cant who has a current valid public passenger vehicle chauffeurs license issued by the Villages of Arlington Heights, Schaumburg or Mount Prospect without requiring the applicant to complete the full application process set forth herein. Should the existing license from one of the stated municipalities be within three (3) months of expiration on the date the application is submitted, the Chief of Police may authorize such testing as he deems necessary to ensure the applicant's qualifi- cations under the provisions of this Section. 18.4221 Fee. The fee for the initial issuance of an oper- ators permit shall be Fifteen ($15.00) Dollars and such permit shall expire on the thirty-first (31st) day of May of each year following the date of issuance. The annual fee for any renewal there- of shall be Ten ($10.00) Dollars. 18.4222 Suspension/Revocation. A. Suspension. The Village Manager, in his dis- cretion, may suspend a taxicab operators permit for a period not to exceed thirty (30) days, for any failure or refusal to comply with the provisions of this Chapter, for any violation of federal, state or municipal law, upon a determination that said permit was obtained fraudulently, that the permittee has become physically, mentally or emotionally unfit to -3- perform his duties as a taxicab operator, or t' -t there has been any fra, ulent use of the t_.;icab operators permit. �.,e Village Manager may further suspend any taxicab operators per- mit in the event the individual's chauffeurs permit in the Villages of Arlington Heights, Schaumburg or Mount Prospect has been like- wise suspended by any of said municipalities. B. Revocation. The Public Vehicle Commission may revoke any operators permit for repeated violation of traffic laws, ordinances of the Village, laws regulating the conduct of the driver and failure to render good service. Said revocation shall be after a hearing and the operator shall be granted an opportunity to defend charges made against him. The reco- vation of a chauffeurs permit issued in the Villages of Arlington Heights, Schaumburg or Mount Prospect shall be deemed sufficient cause for the revocation of the operators permit granted herein. Section 2: Any person, firm or corporation who shall have violated any of the provisions of this Ordinance shall be subject to a fine of not less than Ten ($10.00) Dollars nor more than Five Hundred ($500.00) Dollars for each and every offense. Section 3: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 0 ABSENT: 1 APPROVED: Charles J.
