HomeMy WebLinkAboutORDINANCE - 2042 - 5/23/1989 - TAXICABS, INSPECTION OFORDINANCE NO. 2042 AN ORDINANCE AMENDING SECTION 18.4210 INSPECTIONS OF ARTICLE XLII TAXICABS OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE WHEREAS, the Chief of Police of the Village of Elk Grove Village is responsible for the testing of taxicabs pursuant to Village Ordinance; and WHEREAS, the Chief has advised the President and Board of Trustees of his recommendation that the Village sanction and approve testing stations in order to provide a more thorough inspection of licensed taxicabs to assure that said taxicabs are mechanically dependable, safe, clean and satisfy the provi- sions of Article XLII of Chapter 18 of the Elk Grove Municipal Code; and WHEREAS, the President and Board of Trustees after having reviewed the recommendations of the Chief of Police find and believe that Section 18.4210 Inspections should be amended pur- suant to the recommendations of the Chief of Police. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 18.4210 Inspections of Article XLII taxicabs of Chapter 18 of the Municipal Code of the Village be and the same is hereby amended to read as follows: 18.4210 - Inspections/Inspection Sta,�ions a) Inspections 1) The Chief of Police will cause inspection of all licensed taxicabs to be done no less than two (2) times a year. 2) After receiving notice from the Chief of Police or his designated agent, a taxicab company will be allowed seven (7) days to take their licensed taxicab to an inspection station for inspection. Said inspection station shall be an offi- cial State of Illinois testing station or such other facility designated by the Chief of Police to conduct inspections required by this Section. The license of all taxicabs not inspected within that period will be suspended by direction of the Village Manager. 3) Such inspection will include, but need not be limited to, the following: (1) Vehicle, make, year and vehicle identification number (2) State license number and year (3) Village vehicle license number and year (4) Vehicle color (5) Vehicle number (6) Company name (7) Service brakes (8) Emergency brakes (9) Horn (10) Rear view mirror (11) Windshield wipers and washers (12) Headlights (13) Tail lights (14) Stop lights (15) Turn signals (16) Speedometer (17) Taximeter (18) Rates displayed (19) Steering (20) Interior condition (21) Exterior condition (22) Windows (23) Tires (24) Current bond sticker 4) Any taxicab failing to pass the inspection will be given a period of five (5) working days to allow for repairs. The vehicle cannot be used as a taxicab for hire until repairs have been completed and it passes reinspection. If the taxicab -2- -3- does not pass reinspection within the five (5) working day period, the taxi- cab license will be suspended by direc- tion of the Village Manager. b) Inspection Stations 1) The Chief of Police, in conjunction with the Chiefs of Police of the Villages of Arlington Heights, Schaumburg and Mount Prospect, shall designate those facilities which may serve as inspection stations to conduct the vehicle inspec- tions required by this Section, which facilities may be within or without the Village of Elk Grove Village. The inspection stations shall comply with established procedure and criteria for the conducting of inspections and mini- mum standards in order that a vehicle be approved, a copy of said criteria incorporated into the provisions of this Ordinance by this reference and copies of which shall be on file in the Office of the Village Clerk, the Police Department and the inspection stations authorized by the Chief of Police. He shall supply inspection stations with certified inspection forms, numbered certified vehicle inspection stickers and such other supplies as may be required to perform the duties required by this Section and the regu- lations established hereunder. 2) A list of authorized inspection stations shall be kept by the Chief of Police and shall be given to each taxicab com- pany together with the notice that vehi- cles must be inspected. An owner may use the authorized inspection station of his choice. 3) Inspection stations shall charge the inspection fee authorized by the Chief of Police for all taxicab inspections. There shall be no charge for a reinspec- tion within the five (5) working days allowed for repairs to a vehicle that fails the initial inspection. The authorized inspection fee shall be charged for reinspection made after the five (5) working day grace period. -3- 4) The Chief of Police shall cause unan- nounced spot checks of authorized in- spection stations to assure compliance with the inspection procedures, stan- dards and fees, and shall investigate all complaints of misconduct by inspec- tion stations or their employees. Non- compliance with the requirements of this Section of the regulations estab- lished by the Chief of Police shall be cause for suspension or revocation of the designation as an authorized inspec- tion station. Section 2: That any person, firm or corporation who vio- lates the provisions of this Ordinance shall be subject to a fine of not less than Twenty -Five ($25.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues to exist. Section 3: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 0 ABSENT: 1 APPROVED: Charles J. PUBLISHED this 25th day of May , 1989, in pamphlet form. -4- PUBLIC PASSENGER VEHICLE INSPECTIONS iThe owner of a public passenger vehicle must submit his vehicle for inspection prior to the issuance of a Public Passenger Vehicle License or the renewal thereof, and i shall also submit his vehicle for re -inspection every four (4) months. with inspections being conducted in the months of April, August and December of each calendar year, or at any other time so deemed necessary by the municipality. CERTIFIED PUBLIC PASSENGER VEHICLE INSPECTION i Each municipality shall designate and certify their Public - Passenger Vehicle Inspection Stations, supply them with certified inspection forms and procedures as well as the numbered certified vehicle inspection stickers. Also, each 1 municipality shall be responsible for spot checks of their inspection stations to ensure compliance of the inspection procedures. , PUBLIC PASSENGER VEHICLE INSPECTION FEES 4 Prior to the inspection of a Public Passenger Vehicle, the owner of said vehicle shall pay a fee of $25.00 to the in- spection station. If the vehicle is found to be in need of repair(s) the owner shall have seven (7) working days to make the neces- sary repair(s) and resubmit the vehicle for inspection free of further charges. After the period of seven (7) working j days, any re -inspection will be charged another $25.00 fee. CERTIFIED INSPECTION STICKERS _i Upon the completion of a successful inspection, the inspec- tion station shall affix the appropriate certified sticker to the lower left hand corner of the rear window. On subsequent inspection dates, the inspection station shall, as a first priority, remove the old sticker from the window before beginning the inspection. If the vehicle fails the inspection, the owner shall no longer use the vehicle, or allow the vehicle to be used for hire until such time the vehicle has completed a successful inspection. Be thoroughly familiar with all the provisions, regulations, and laws that pertain to safety tests. Remember that your station will be judged by the condition of the vehicles bearing its Certificates of Safety. Failure to safety test vehicles in accordance with these Rules and Regulations may well result in the suspension of your station permit. Please protect Certificates of Safety from theft. Your cooperation is requested. OFFICIAL TEST PROCEDURE } Each vehicle must have a separate official vehicle inspection report. When a vehicle is presented for a safety test, the owner, the certified safety tester or other station employee shall complete the following parts of the vehicle inspec- tion report by printing the following information. Remember to press hard since you are using a multiform set. 1. Enter the name of the taxi/limo company in Field nl. 2. Enter taxi number printed on side of vehicle in Field 712. 3. Enter Illinois Registration number of vehicle in Field 03. 4. Enter vehicle make in Field 794. !! 5. Enter model year of vehicle in Field tis. 6. Enter model of vehicle in Field #6. 7. Enter vehicle's primary color in Field 47. 8. Enter vehicle identification number (Vin) of vehicle in Field f8. Use the 1' actual Vin number that is on the vehicle - do not copy from registration card. 9. Enter vehicle's current odomoter reading in Field f9. ONLY A CERTIFIED SAFETY TESTER MAY COMPLETE THE FOLLOWING SAFETY PROCEDURE: The Certified Safety Tester shall make a physical check of the Vin on the vehicle, and the Vin an the Vehicle Inspection Report to.determine if each is identical to - the Vin shown on the registration card or proof of ownership. DO NOT PROCEED with the test if the numbers do not agree. The Certified Safety Tester will remove completely any Inspection Certificates of Safety affixed to the vehicle before proceeding with the test. I -2- The Certified Safety Tester will take possession of the vehicle to be tested TESTING PROCEDURE 10. Procedure - Mirrors A. Exterior Rearview Mirror: From the driver's position visually inspect exterior mirror on driver's side for a clear and reasonable un- obstructed view to the rear. Look for correct location, stable mounting, cracks, sharp edges, unnecessary protrusion. B. Interior Rearview Mirror: From the driver's position, visually inspect interior mirror for proper mounting, location, cracks, sharp edges, and ease of adjustment. 11. Procedure - Body Damaaes Inspect exterior of vehicle for signs of damage to body. 12. Procedure - Bumoers/Gas Cap Inspect front and rear bumpers for signs of damage and improper attachment. Inspect for presence of gas cap. Reject Vehicle If: A. Mirror not mounted on stable support. B. Mirror cracked, pitted or clouded. C. Mirror missing. D. Forward vision is unsafely obstructed by mirror assembly. Reject Vehicle If: A. Sheetmetal dents are over 2" deep or over 18" in length at its longest point. B. Torn metal, or other loose or dis- located parts that protrude from the surface of the vehicle. Reject Vehicle If: A. Either bumper is missing. B. Either bumper is loosely attached, or protruding creating a hazard to pedestrians, cyclists, or other vehicles. C. Either bumper has a dent which is over 2" deep. D. Vehicle has no gas cap. Beam indicator lamps do not indicate the proper beam to the driver and do not function properly. RP,ject Vehicle If: A. Any bulb in any required lamp or light fails to function properly. B. A lens is cracked or broken, or not securely attached to vehicle. Reject Vehicle If: A. Any bulb in the required lamp or light fails to function properly. B. A lens is -cracked, broken, or missing. Reject Vehicle If: A. Any bulb in the required lamp or light fails to function properly. B. A lens is cracked, broken or missing. C. Any lamp or light shows a beam of color contrary to law or regulation. Reject Vehicle If: A. Any bulb in the reauired lamp or light fails to function properly. Procedure - Rate Display Inspect vehicle for presence of rate card being displayed. Reject Vehicle If: A. Any window will not roll up and down as intended by the vehicle manufacturer. B. Any sharp edges of the window which could inflict a cut or injury. Reject Vehicle If: A. Any floor is not solid, i.e., any holes or excess play are cause for rejection. Reject Vehicle If: A. Any seat is not securely anchored to floor or adjusting mechanism slips out of position when braking or steering. B. Seats are excessively dirty. C. Seats have cuts or slashes exceeding 3" in length. Procedure - Brakes (Rear) Reject Vehicle If: Remove rear brake drums - A. Any drum or brake shoe is cracked. inspect drums and brake shoes ''- for wear. B. Any rivet or pad backing is rubbing drum. _ C. Any brake fluid leaking from any hoses - couplings or calipers. O.. Less than 1/16" of brake material is -_ left on bonded brake shoes or less tha 1/16" of brake material is exposed ove rivets on riveted shoes. V 35. Procedure - Ball Joints Inspect ball joints as per each manufacturers instructions. 36. Procedure - Wheel Bearings With the front end of the vehicle lifted so as to load any ball joints, grasp the front tire top and bottom. Rock it in and out, and record movement. To verify that any looseness de- tected is in the wheel bearing, notice the relative movement between the brake drum or disc and the backing plate or splash shield. 37. Procedure - Tires Reject Vehicle If: A. Movement in excess of manufacturers specifications is observed. Reject Vehicle If: A. Relative movement between drum and backing plate, measured at the tire, is 1/4 -inch or more. Reject Vehicle If: Inspect all tires for wear. A. Tread wear indicators contact the Use thread depth gauge. Inspect road in any 2 adjacent grooves at all wheel bolts. 3 equally spaced intervals around the circumference of the tire. B. Tread groove depth is less than 2/32 inch in any 2 adjacent grooves at 3 essentially equally spaced intervals around the circumference of the tire. C. A broken or cut cord can be seen. Rubber is worn, cracked, cut or otherwise deteriorated or damaged _ so that a cord can be seen - - either when the tire is not touched or when the edges of the crack, cut, or damage are parted or lifted by hand. D. Tire has bump, bulge, knot or other evidence of partial carcass failure, air seepage, or loss of adhesion betwe carcass and tread or sidewall. E. A valve stem leaks; or is cracked; or either damaged or positioned so as to hamper pressure checking or inflation; or shows evidence of wear because of misalignment. , 37. Procedure - Tires i I Continued i 38. Procedure - Steering Mechanism ;t Inspect power steering belts for proper condition and tension. Visually inspect gear, hoses, tubes, connector, cylinders, ii valves, pump, and pump mounting. Turn steering wheel through a full right and left turn and ,f feel for binding or jamming conditions. -9- ii 1; 39. Procedure - Shock Absorbers With vehicle on level surface, _+ bounce one corner of vehicle and determine the number of times vehicle bounces before leveling �! off. With vehicle on a hoist or jacked up, visually inspect shock absorbers for excessive leakage, looseness of mounting, brackets, and bolts. Physically grab upper and lower portion of shock inspecting for looseness in rubber bushing, mounting brackets, or bolts. Reject Vehicle If: (Continued) F. A tire or wheel is rubbing against any portion of the suspension, chassis or body. G. Any wheel or rim securing device such as a nut, bolt, stud, lug, ring, or other type securing device is loose, missing, or cracked. H. Wheel locating hole(s) are elongated, oversize, or "wallowed out". Any part of a wheel or rim is cracked, repaired by welding or rewelding, or damaged so as to cause unsafe operation of the vehicle. , Reject Vehicle If: A. Belts are badly frayed or cracked on inner edge. B. Any hose, tube, or connector has been rubbed by moving parts; leakage at any point in the system; gear, pump mounting, or connector is loose or broken. C. Binding or jamming occurs. Reject Vehicle If: A. Vehicle continues bouncing more than two cycles, indicating loss of shock absorber function. B. Severe leakage (not slight dampness) occurs. C. Mounting bolts or mounts are broken or loose, or rubber bushing is partially or completely missing. 1 40. Procedure - Sorings Reject Vehicle If: Inspect front and rear for broken A. Springs or torsion bars are broken. leaves or bar damage. Inspect Shackles or "U" bolts worn or loose. spring shackles, bushing, "U" Center bolt in springs sheared or i bolts, and center bolt in springs. broken. Steering stops allow tire i to rub on frame or metal. Any leaves are cracked, or shackle, shackle pins, hangers, or "U" bolts are worn or loose. 41. Procedure - linkaoes/Seals Reject Vehicle If: Inspect all front end linkages A. Any front end linkage is loose, bent, and all axle seals. defective or out of manufacturer's specifications. B. Any axle seal is found to be defective and/or leaking. 42. Procedure - Exhaust System Reject Vehicle If: Inspect manifold(s), muffler(s), A. There are loose connections or leaking catalytic converter, resonator(s), joints. all pipe(s), gaskets and supporting hardware. Rusted or corroded surfaces B. There are holes (other than manufacturer should be given particular attention. or rusted through places. (Holes in the system made by the man- ufacturer for drainage are NOT cause C. NOTE: Course for measured mile will be laid out by your local Police Department and will be located within your immediate vicinity. i 45. Print taxi meter number in the box. _11- NOTE: 11_ Reject Vehicle If: A. After transversing measured mile, the fare amount shown on fare meter is different from posted rate amount. 1 46. If taxi meter passes inspection, it shall be sealed and the box on this line is to be checked. 47. If vehicle has passed ALL previous tests, check this box and issue sticker. See separate instructions fog method of issuing sticker. 48. Mechanic inspecting vehicle is.to sign their name and the date tested on this line. 49. Name of the agency that inspected vehicle is to be printed on this line. 50. Inspecting agency's address and phone number are to be written on this line. 51. Distribution of inspection report: White: Inspecting agency to send this copy to i{ Gold: Inspecting agency to give this copy to whoever presents the taxi/limo for inspection. This copy is to be kept in the vehicle's glove box. ' Blue: Inspecting agency to keep this copy of the report on file for at least ij one (1) year from the date of inspection.
