AN ORDINANCE AMENDING CHAPTER 24A.104, IMPOUNDMENT OF VEHICLES
OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE
BE IT ORDAINED by the President and Board of Trustees of
the Village of Elk Grove, Counties of Cook and DuPage, Illinois
as follows:
Section 1: That Paragraph A. Violation of Section 24A.104
Impoundment of Vehicles be and the same is hereby amended to
read as follows:
A. Violation. Any vehicle, the owner or owners of
which have a total of five (5) or more unpaid
citations for parking violations, issued with-
in an eighteen (18) month period, charging that
such vehicle or other vehicles owned by the
same owner or owners was parked or stopped in
violation of any Ordinance of the Village, shall
be deemed a public nuisance, and the Police
Department or any other agents of the Village
assigned to traffic duty are hereby authorized
to remove, cause to be removed or impound in
place the offending vehicle at the sole cost
and expense of the owner or owners thereof.
Section 2: That Paragraph C. Presumption of Owner's
Responsibility of Section 24A.104 be and the same is hereby
amended to read as follows:
C. Presumption of Owner's Responsibility. The
registered owner of a vehicle, the owner of
which has five (5) or more citations for parking
violations within an eighteen (18) month period
shall be presumed to be the owner and the oper-
ator of the vehicle at the time the citations
were issued and shall be responsible for the
offense and the impoundment.
Section 3: That the Village Clerk is hereby authorized
to publish this Ordinance in pamphlet form.
Section 4: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
