HomeMy WebLinkAboutORDINANCE - 2018 - 2/28/1989 - SALE OF VLG OWNED PROPERTYORDINANCE NO. 2018 AN ORDINANCE AUTHORIZING THE SALE OF VILLAGE OWNED REAL PROPERTY WHEREAS, the Village of Elk Grove Village owns the following described real property: That part of Turner Avenue in Section 32, Township 41 North, Range 11, East of the Third Principal Meridian, lying East of and adjoining the East line of Lot 13 in Ninth Addition to Elk Grove Village Sec- tion 12, being a resubdivision in Section 32 aforesaid, and lying Northerly and ad- joining the Northerly lines of Lots 14 and 15 in Tenth Addition to Elk Grove Village Section 12, being a resubdivision in Sec- tion 32 aforesaid; and lying Southerly of a curved line convex Southerly, having a radius of 905.0 feet and being drawn from the Northeast corner of Lot 13 aforesaid to the most Northerly corner of Lot 14 aforesaid, in Cook County, Illinois. which property is generally located at the South side of Turner Avenue, 288.22 feet East of Arlington Heights Road, Elk Grove Village and is currently used for ingress and egress to Turner Avenue for three (3) lots which abut said property; and WHEREAS, the owners of said three (3) lots have entered into certain agreements by and between themselves which provide for perpetual easement rights of ingress and egress to Turner Avenue thereby rendered continued ownership by the Village un- necessary; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village have determined that it is no longer necessary, appropriate or in the best interest of the Village that it retain title to said real estate and that said real estate is not required for the use of, or profitable to the Village; and WHEREAS, the Village of Elk Grove Village is a Home Rule Municipality and in the exercise of its Home Rule Authority has received an offer to purchase the above described real pro- perty according to such terms and conditions which are deemed to be in the best interest of the Village; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: The President and Board of Trustees find as facts the recitals hereinabove set forth. Section 2: That the offer of Dr. John Riggs, Dr. Daniel Martisius, Dr. David Zak in the amount of Fifty Seven Thousand Dollars ($57.000.00 ) is hereby accepted by the President and Board of Trustees of the Village of Elk Grove Village for the sale of the following described real estate: That part of Turner Avenue in Section 32, Township 41 North, Range 11, East of the Third Principal Meridian, lying East of and adjoining the East line of Lot 13 in Ninth Addition to Elk Grove Village Sec- tion 12, being a resubdivision in Section 32 aforesaid, and lying Northerly and ad- joining the Northerly lines of Lots 14 and 15 in Tenth Addition to Elk Grove Village Section 12, being a resubdivision in Sec- tion 32 aforesaid; and lying Southerly of a curved line convex Southerly, having a radius of 905.0 feet and being drawn from the Northeast corner of Lot 13 aforesaid to the most Northerly corner of Lot 14 aforesaid, in Cook County, Illinois. Section 3: That the Village President is hereby authorized and directed to sign and the Village Clerk is hereby authorized and directed to attest to a Contract for the sale of the aforesaid real estate, which Contract shall be in the form attached hereto as Exhibit A. -2- Section 4: Upon satisfaction of the terms of the aforesaid Contract and upon the payment of the aforesaid offer price in the manner provided in said Contract, the President is hereby authorized and directed to convey and transfer the aforesaid real estate to the purchasers or their nominee by a proper Deed of Conveyance, stating therein the aforesaid consideration, and the Village Clerk is hereby authorized to acknowledge and attest such Deed and to affix thereto the seal of the Village. Section 5: That the Village President and Village Clerk are hereby authorized, respectively, to execute and attest such other documents as may be necessary to the conveyance herein authorized.
