AN ORDINANCE AUTHORIZING THE VILLAGE PRESIDENT AND
VILLAGE CLERK TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT
BETWEEN DuPAGE COUNTY AND THE VILLAGE OF ELK GROVE
CONCERNING THE PAYMENT OF PREVIOUSLY ADOPTED IMPACT FEE
REQUIREMENTS AND AUTHORIZING THE WITHHOLDING OF BUILDING
PERMITS UNTIL SUCH TIME AS IMPACT FEES HAVE BEEN PAID
WHEREAS, the County Board of DuPage County has adopted a Fair
Share Transportation Impact Fee Ordinance; and
WHEREAS, the County Board of DuPage County has requested the
Village enter into an Intergovernmental Agreement to assist the
County in insuring that all fees that are due the County under said
Ordinance be paid; and
WHEREAS, the Village President and Board of Trustees of the
Village of Elk Grove Village find and believe it to be in the best
interest of the Village to cooperate with the County of DuPage in
its endeavors to alleviate traffic congestion and transportation
within those portions of the Village located within the County of
DuPage.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That the Village President and Village Clerk are
hereby authorized to execute an Intergovernmental Agreement between
DuPage County and the Village of Elk Grove Village, a copy of said
Agreement being attached hereto and by this reference incorporated
herein.
Section 2: Pursuant to the terms of the Intergovernmental
Agreement, the Village shall withhold from issuing any building per-
mits for property located in DuPage County until the Village re-
ceives evidence that the applicant has paid the development fees
required by the County of DuPage.
Section 3: That the Village Clerk is hereby directed to pub-
lish this Ordinance in pamphlet form.
Section 4: That this Ordinance shall be in full force and ef-
fect from and after its passage, approval and publication according
to law.
