HomeMy WebLinkAboutORDINANCE - 2103 - 5/8/1990 - FLOODED AREASNO. 2103 AN ORDINANCE AMENDING CHAPTER 24 OF THE MUNICIPAL CODE BY ADDING THERETO REGULATIONS PROHIBITING HARMFUL ACTIVITY IN FLOODED AREAS WHEREAS, the President and Board of Trustees have been advised that during periods of heavy flooding within the Village, indivi- duals have entered upon flooded areas on foot or with inflatable rafts, canoes, boats and other devices; and WHEREAS, the President and Village Trustees have been further advised that such activity in these flooded areas is a danger to the individual's health, safety and welfare and furthermore impedes the Village's emergency and safety activities in said areas. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Chapter 24, MISDEMEANORS AND OTHER OFFENSES is hereby amended by adding thereto a new section which shall read as follows: 24.050 - Harmful Activity in Flooded Areas A. It shall be a nuisance and therefore unlawful for any person to wade, swim or otherwise traverse by boat, canoe, raft or other device or otherwise enter into or on flooded areas in the Village unless such activity is necessary for the protection or preservation of life or property. B. Any person who violates any of the provisions of this Section shall be subject to a fine of not less than Twenty -Five ($25.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense. Section 2: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 3: That this Ordinance shall be in full force and ef- fect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 0 ABSENT: 1 APPROVED: Charles J. Willis, Village Manager SUBJECT: Safety Measure Regulation The flood of 1987 produced numerous consequences: most were not good. One which can be addressed is the attraction the flood waters have for youngsters and adults to use the high water for wading, paddling, swimming and floating. While that may be exciting for those who do those things it also serves to excite and alarm passers-by and residents who can see the activity from their yards or homes. Some have called for emergency rescue services and we have responded. Some cases have been relatively easy and non -risky -type rescues. However, on one or more occasions the rescue services have placed our Fire personnel in high jeopardy. At my request an ordinance has been drafted by our Village Attorney to prohibit harmful activity in flooded areas. It could be helpful not only in protecting our personnel but also in discouraging persons from putting themselves at risk. Your consideration and adoption of the ordinance is recommended. Thank you.
