HomeMy WebLinkAboutORDINANCE - 2097 - 4/24/1990 - LATORIA PROPERTY ANNEXEDORDINANCE NO. 2097 AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (LATORIA) WHEREAS, a written petition has been filed with the Village Clerk of the Village of Elk Grove Village by John and Lorraine Latoria, said petition seeking annexation to the Village of Elk Grove Village of certain land and territory legally described hereinafter; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village; and WHEREAS, the proposed zoning of the property to be annexed is consistent with the zoning attached to said property by the Village's Comprehensive Plan and Official Map; and WHEREAS, any Fire Protection District, Library District, Town- ship Road Commissioner, County Clerk or other entity or person en- titled to notice prior to the annexation of the subject property has been given such notice as is required by law; and WHEREAS, the President and Board of Trustees find and believe it to be in the best interest of the Village that said land and ter- ritory be annexed to the Village according to the conditions and provisions of this Ordinance. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the land and territory, legally described on Exhibit A, attached hereto and by this reference incorporated here- in, which land and territory is contiguous to the Village of Elk Grove Village, and not within the limits of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boun- dary limits of said Village as is by law in such case made and pro- vided. Section 2: That the Village hereby grants I-1 Industrial Zoning to the property being annexed herein, said I-1 Zoning clas- sification being the use set forth for the property on the Village's Official Map. Section 3: That the annexation of the property is subject to the following conditions: a. Annexation fees of $500.00 per acre shall be paid upon annexation of the property to the Village of Elk Grove Village, which funds shall be placed in the Municipal Purpose Fund of the Village. b. Prior to the issuance of any Building Permits, proof shall be provided to the Village that the owners have paid the City of Wood Dale the sani- tary sewer recapture fees assessed on owner's pro- perty and provide proof that the owner has permis- sion to connection to the wood Dale Sanitary Sewer Collection System. C. Upon annexation, the owner shall have sixty (60) days to provide the Village with a Final Plat of Subdivision. The Plat of Subdivision must be ap- proved by the Community Development Director prior to the issuance of any Building or Engineering Per- mits. d. Engineering Plans subject to the approval of the Village Engineer shall be submitted prior to the issuance of any Building or Engineering Permits and shall include the extension of public utility lines across the lot frontage. -2- e. Prior to the issuance of any Engineering Permits, the owner shall provide a letter to the Village as proof that the owner has paid its proporate share assessed to its property to Amoco/Castle for sanitary sewer and water main extensions and to Trammell Crow for water main extensions. f. Owner will be responsible for all water charges of the Village of Elk Grove Village and all sanitary sewer charges of the Village of Elk Grove Village and the City of Wood Dale. g. That the owner acknowledges and shall be responsible for any impact fees, if any assessed by DuPage County pursuant to the DuPage County Transportation Impact Fee Ordinance presently in effect. Section 4: That the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this Ordinance together with a Plat of Annexation of said territory with the Re- corder of Deeds of DuPage County, Illinois. Section 5: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. Section 6: That this Ordinance shall be in full force and ef- fect from and after its passage, approval and publication according to law. VOTES: AYES: 7 ATTEST: Patricia S. PUBLISHED this 25th day of April , 1990, in pamphlet form. -3- EXHIBIT A Lot 4 and the North 63.04 feet of Lot 3, as measured on the East line thereof, in Emma Krueger's Subdivision of a part of the North half of the Northwest quarter of Section 3 and a part of the North- east quarter of the Northeast quarter of Section 4, Township 40 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded September 16, 1948 as Document No. 554217, together with that part of Wood Dale Road lying West of and adjoining said property, all in DuPage County, Illinois.
