HomeMy WebLinkAboutORDINANCE - 2095 - 4/10/1990 - BASSET TRAINING PROGRAMSORDINANCE NO. 2095 AN ORDINANCE AMENDING ARTICLE XVIII DEALERS IN ALCOHOLIC LIQUORS OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BY REQUIRING SERVERS OF ALCOHOLIC BEVERAGES TO HAVE COMPLETED A BEVERAGE ALCOHOL SELLERS AND SERVERS EDUCATION AND TRAINING PROGRAM WHEREAS, the President and Board of Trustees have determined that there is an increase of incidents of alcoholic related traffic offenses and traffic deaths; and WHEREAS, continued regulation of the service of alcoholic be- verages is vital to the health, safety and welfare of the residents of the Village of Elk Grove Village; and WHEREAS, Elk Grove Village is a Home Rule Municipality as de- fined in the Constitution of the State of Illinois and is empowered and authorized to enact certain regulation and legislation pertaining to its local government and affairs in its capacity as a Home Rule Municipality. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 18.1203, APPLICATION of Article XII DEALERS IN ALCOHOLIC LIQUOR of Chapter 18 of the Municipal Code be amended by adding thereto Paragraph K., which paragraph shall read as follows: K. Applications for a Class A or Class AA Liquor Li- cense shall be accompanied by proof of completion of a State certified beverage alcohol sellers and servers education and training program (BASSET) or an equivalent program approved and acceptable to the Chief of Police for all persons who serve or sell alcoholic beverages pursuant to those Licenses. Section 2: That Section 18.1205 of Chapter 18 of the Municipal Code shall amended by adding thereto the following paragraph, which shall read as follows: G. Sellers and Servers Education Training Program. 1. It shall be unlawful to permit any person in a Class A or Class AA licensed establishment to serve or sell alcoholic beverages unless that per- son has completed a BASSET Training Program or approved equivalent as required or employ a manager unless that person has completed the BASSET program or approved equivalent. 2. Any new employee of a Class A or Class AA li- censed establishment who serves or sells alcoholic beverages shall have ninety (90) days from the be- ginning of their employment to complete the BASSET Program or approved equivalent and shall until com- pletion of said Program work under the supervision of a person who has completed a training program. 3. A photocopy of the Certificate of Completion of a training program must be filed with the Village Clerk, posted in clear view on the premises and maintained on the premises of the licensee and pro- duced upon demand. Section 3: Any person, firm or corporation who violates any of the provisions of this Ordinance shall be subject to a fine of not less than Twenty -Five ($25.00) Dollars nor more than Five Hun- dred ($500.00) Dollars for each day a violation occurs or continues to exist. In addition to any penalties provided for herein, any person, firm or corporation who violates this Ordinance shall be subject to having its Class A or Class AA Liquor License suspended or revoked as provided in Section 18.1206 of the Elk Grove Village Municipal Code. Section 4: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. -2- Section 5: That this Ordinance shall be in full force and ef- fect from and after September 1, 1990.
