HomeMy WebLinkAboutORDINANCE - 2093 - 3/13/1990 - REZONE/700 DEVON AVEORDINANCE NO. 2093 AN ORDINANCE REZONING PROPERTY LOCATED AT 700 EAST DEVON AVENUE, ELK GROVE VILLAGE FROM I-2, INDUSTRIAL TO B-3, AUTOMOTIVE BUSINESS (THERMO-RAIL, INC./PENSKE TRUCK LEASING COMPANY, L.P.) WHEREAS, the Plan Commission of the Village of Elk Grove Village at a public meeting duly called and held according to law considered the question of rezoning property located at 700 East Devon Avenue, legally described hereinafter, from I-2, Industrial to B-3, Automotive Business; and WHEREAS, the President and Board of Trustees after having considered the recommendation of said Plan Commission find and believe it to be in the best interest of the Village that said property be rezoned as requested. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a rezoning from I-2, Gener- alized Industrial District, to B-3, Business District (Automotive) for property located at 700 East Devon Avenue, Elk Grove Village and legally described as follows: Lot 1 in Leaseway Leasing, Inc. Resubdivision, being a resubdivision of Lot 273 in Centex Industrial Park Unit 154, being a subdivision in the South Half of Section 34, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois Subject to the following conditions: 1. The wooden fence along the west side of the pro- perty, which separates the unincorporated residential property from the property in question, must be repaired. If the neighbor whose property the fence is located on objects to the petitioner repairing the fence, then the petitioner must install screening along the west property line; 2. The property owner must repave the parking lot, install a sidewalk and grant any necessary easements for installing the sidewalk as a function of the re- zoning; and, 3. A letter must be secured from Thermo -Rail, Inc. stating Thermo -Rail's intent to purchase the site if it is rezoned. A letter (attached) from Thermo -Rail addressing this issued was distributed by Penske's attorney at the February 07, 1990 Plan Commission meeting. Section 2: That the Village Clerk is hereby authorized to amend the Zoning Map of the Village consistent with the provisions of this Ordinance. Section 3: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 4 NAYS: 0 ABSENT: 2 APPROVED: Charles J.
