HomeMy WebLinkAboutORDINANCE - 1965 - 5/10/1988 - ZONING ORDINANCE AMENDEDNO. 1965 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE BY ADDING WAREHOUSING, PACKAGING AND LIGHT ASSEMBLY AS A SPECIAL USE IN THE O & T OFFICE/TRANSITIONAL DISTRICT WHEREAS, the Plan Commission of the Village of Elk Grove Village at a public hearing duly called and held according to law considered the question of amending the Zoning Ordinance of the Village by adding warehousing, packaging and light assembly as a Special Use in the 0 & T Office/Transitional District; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having reviewed the findings and recommendation of said Plan Commission find and believe it to be in the best interest of the Village that the Zoning Ordinance be amended to provide for said Special Use. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 5.72 E. of the Zoning Ordinance of the Village, which Section sets forth Special Uses in the 0 & T Office/Transitional District, be and the same is hereby amended by adding thereto a new category entitled: Warehousing, Packaging and Light Assembly, the text of which is set forth in Exhibit A attached hereto and incorporated herein. Section 2: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 0 ABSENT: 1 APPROVED: Charles S. Warehousing, Packaging and Light Assembly Where property is located adjacent to property zoned as an I-1 or I-2 Industrial District, is also adjacent to property zoned as an A-1, A-2 and A-3 Residential District, and is not adjacent to property zoned as R-1, R-2, R-3 or R-4 Residential District (except where separated by a street or right-of-way of not less than sixty feet), the following uses shall be Special Uses: Warehousing and distribution of goods, products and supplies; 2. Packaging of existing goods, products and supplies; and 3. Light assembly uses which are designed for a narrow range of assembly uses which can conform to a high level of performance standards. Light assembly establishments of this type can locate in close proximity to residential uses without creating a nuisance to surrounding properties. Light assembly shall consist of the assembly by hand or hand held tools or an equivalent process of parts which have already been fabricated prior to such assembly. Light assembly firms are allowed within this District provided that the assembly operation is conducted solely within a building or group of buildings and will not cause or result in: (a) a violation of the performance standards set forth in Article 5, Section 5.9 of this Zoning Ordinance for the I-1 and I-2 Industrial Districts; (b) any uses which are prohibited uses in the I-1 or I-2 Industrial District, as specified in Article 5, Section 5.86 of the Zoning Ordinance; (c) hazard of fire or explosion or other physical hazard to any person, building or vegetation; (d) radiation or interference with radio or television reception beyond the boundaries of the immediate site of the building in which such use is conducted; (e) scientific testing of instruments which requires the flying of aircraft in the vicinity in such manner as to constitute a public nuisance; (f) a harmful discharge of waste materials (as defined in the Illinois Environmental Protection Act, 111-1/2 Illinois Rev. Stats, Sec. 1003.53); or (g) unusual traffic hazards or congestion. The following conditions and procedures shall be required as a minimum for such Special Use to be granted: 1. The use proposed must be of the type and so located as to constitute no significant detrimental influence upon the surrounding properties. 2. The application for the Special Use shall be accompanied by a general site plan designating the areas where buildings, driveways, parking areas and loading docks are to be located. Such site plan may be modified for all or any part thereof, prior to the time a building permit is issued so long as any modification does not substantially change the intent and effect of the site plan submitted with the application. 3. Wherever property abuts property zoned for residential purposes, it shall be screened or landscaped in a manner approved by the Plan Commission, in addition to any other screening or landscaping requirements which may be specified elsewhere in the Zoning Ordinance. 4. No storage shall be permitted outside buildings. The granting of the Special Use as to specific property may provide that any or all of the Bulk and Yard Requirements and Regulations for the property be modified to conform in whole or in part to the requirements for the I-1 or I-2 District which is adjacent to the property, in lieu of such requirements for the O & T District, and further may provide that the parking requirements for the buildings to be constructed thereon conform to the parking requirements which are set forth in this Zoning Ordinance for the actual uses made of such buildings as are set forth in Subsection 3.96.B.C. or D. of the Zoning Ordinance.
