AN ORDINANCE AMENDING SECTION 5.23 OF THE ZONING ORDINANCE
AS IT PERTAINS TO THE LOCATION OF FENCES IN THE
SINGLE FAMILY RESIDENTIAL DISTRICTS
WHEREAS, the Plan Commission of the Village of Elk Grove
Village at a public meeting duly called and held according to
law considered the question of amending Section 5.23 of the
Zoning Ordinance pertaining to the location of fences within
the single family residential districts; and
WHEREAS, the President and Board of Trustees after having
reviewed the findings and recommendations of said Plan Commission
find and believe it to be in the best interest of the Village
that the Zoning Ordinance be so amended:
NOW, THEREFORE, BE IT ORDAINED, by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois as follows:
Section 1: That Section 5.23 E. of the Zoning Ordinance
be and the same is hereby amended by adding thereto the following:
E. "On double frontage lots other than where the
rear yard abuts a major arterial street, open
and solid fences may be located within three
(3') feet of the rear property line."
Section 2: That Section 5.23 of the Zoning Ordinance is
hereby amended by adding thereto a new paragraph which shall
read as follows:
G. On corner lots fences shall be permitted subject
to the following conditions:
1) Open Fences
(a) No more than four (4') feet high
and the fence may be located within
three (31) feet of the side property
line between the front edge of the
house and the rear property line when
that side property line fronts a major
arterial street. On all other corner
lots, the fence may be located within
three (31) feet of the side property
line between the rear edge of the house
and the rear property line.
(b) No shrubs or foliage will be allowed
to grow higher than the top of the
fence if planted within three (3')
feet of the inside of the fence.
(c) No foliage will be allowed to be planted
in the three (3') foot area from the
fence to the property line except grass.
(d) where two (2) corner lots abut each
other, fences may be located within
three (31) feet of the side property
line between the rear edge of the house
and the rear property line.
(e) All fences shall conform to Section
3.51 - Obstruction to Vision.
2) Solid Fences
(a) No more than six (6') feet high and
the fence may be located within ten
(10') feet of the side property line
between the front edge of the house
and the rear property line when that
side property line fronts a major arter-
ial street. On all other corner lots,
the fence may be located within ten
(10') feet of the side property line
between the rear edge of the house
and the rear property line.
(b) No foliage will be allowed to hang
over the fence.
(c) No shrubs, trees or ornamentals can
be planted in the ten (10') foot area
from the fence to the property line
except grass.

(d) where two (2) corner lots abut each
other, fences may be located within
ten (101) feet of the side property
line between the rear edge of the house
and the rear property line.
(e) All fences shall conform to Section
3.51 - Obstruction to Vision.
Section 3: That the definitions as set forth in the Zoning
Ordinance are hereby amended by adding thereto the following
definitions:
1. Open Fence - an "Open Fence" is a fence including
gates which has, for each one (1') foot wide seg-
ment extending over the entire length and height
of the fence, eighty (80%) percent of the surface
area in open spaces which afford a direct view
through the fence.
2. Solid Fence - a "Solid Fence" is a fence including
gates which conceals from view the activities
conducted behind it from adjoining properties,
streets or alleys and has less than eighty (80%)
percent of the surface area in open spaces.
Section 4: All existing fences which fail to conform to
the fence regulations as amended herein shall be deemed legal
non -conforming uses and may be maintained, repaired or remain
located in their present location with the approval of the
Building Commissioner. Said approval may need only be required
during major repair for which a permit is otherwise required.
Section 5: That this Ordinance shall be in full force
and effect from and after its passage and approval according
to law.
