AN ORDINANCE GRANTING A VARIATION OF THE ZONING ORDINANCE
TO PERMIT THE CONSTRUCTION OF A DECK ON A PORTION OF THE
FRONT YARD FOR PROPERTY LOCATED AT 401 CHARLES DRIVE,
ELK GROVE VILLAGE (DAVIS)
WHEREAS, the Zoning Board of Appeals of the Village of
Elk Grove Village at a public meeting duly called and held according
to law considered the question of granting a variation of Section
3.54A of the Zoning Ordinance as it pertains to structures in
any required front yard area to permit the construction of a
deck ten (101) feet into the existing 23.5 foot front yard on
properly located at 401 Charles Drive and legally described
hereinafter; and
WHEREAS, the President and Board of Trustees after having
considered the recommendation of said Zoning Board of Appeals
find and believe that sufficient hardship exists so as to warrant
the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section
3.54A of the Zoning Ordinance as it relates to structures in
the required front yard area to permit the construction of a
deck which would infringe ten (10') feet into the existing 23.5
foot front yard on property located at 401 Charles Drive, Elk
Grove Village and legally described as follows:
Lot 1 and 2 in C.A. Hodlmair Subdivision,
a Subdivision in the Southeast quarter of
Section 29, Township 41 North, Range 11,
East of the Third Principal Meridian, in
Cook County, Illinois
Section 2: That a second variation of Section 3.54A be
given to approve the existence of the 23.5 foot front yard.
Section 3: That this Ordinance shall be in full force
and effect from and after its passage and approval according
to law.
