AN ORDINANCE PROHIBITING SCAVENGERS AND OTHER PERSONS
FROM REMOVING ITEMS FROM VILLAGE RECYCLING CONTAINERS
BE IT ORDAINED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DUPage,
Illinois, as follows:
SECTION 1: That 18.4004 of the Municipal Code be amended
by adding thereto the following paragraph:
18.4004F: It shall be unlawful for any scavenger to
remove any item including but not limited to newspapers;
aluminum or bimetal cans; glass bottles or plastic milk
containers placed in or adjacent to Village recycling
containers.
SECTION 2: That Chapter 24, Misdemeanors and Other Offenses
be amended by adding thereto the following section.
24.048 1) Unlawful Removal of Recycled Material:.
It shall be unlawful for persons, firms or corporations
to remove any item including but not limited to newspapers;
aluminum or bimetal cans; glass bottles or plastic milk
containers placed in or adjacent to Village recycling
containers.
2) Penalty: Any person, firm or corporation violating
any of the provisions of this section shall be subject
to a fine of not less than $25 nor more than $500
for each offense.
SECTION 3. Any person, firm or corporation violating any of
the provisions of this ordinance shall be subject to a fine
of not less than $25 nor more than $500 for each offense.
SECTION 4: That the village Clerk is hereby authorized to
publish this ordinance in pamphlet form.
SECTION 5: That this ordinance shall be in full force and
effect from and after its passage, approval and publishing
according to law.
