AN ORDINANCE REGULATING BUILDING ACTIVITIES,
AMENDING CHAPTER 13 OF THE MUNICIPAL CODE OF
ELK GROVE VILLAGE
NOW, THEREFORE, BE IT ORDAINED by the President
and Board of Trustees of the Village of Elk Grove
Village, Counties of Cook and Du Page:
Section 1: Chapter 13 of the Municipal Code of
Elk Grove Village is hereby repealed
(Ordinance No. 1721).
Section 2: Chapter 13 of the Municipal Code of

ARTICLE I - DEVELOPMENT AND BUILDING DEPARTMENT
13.101 Creation
There is hereby created a Department of Development and Building which
shall consist of a Building Commissioner and such other employees as may
be authorized by the President and Board of Trustees.
13.102 Building Commissioner
There is hereby established the position of Building Commissioner. The
Building Commissioner shall be appointed by the Village Manager and shall
serve at his discretion. The Building Commissioner shall have control
and supervision over all offices and employees assigned to the Department
of Development and Building, subject to the general direction of the
Village Manager.
Wherever the term Building Official is used in any portion of the herein
adopted code, it shall mean the Building Commissioner of the Village of
Elk Grove Village.
13.103 Duties of the Building Commissioner
The Building Commissioner shall be responsible for:
A. The enforcement of all ordinances and codes of the Village
relating to the construction, repair, or alteration of the
buildings and structures, and the use of streets or parkways
in connection therewith.
B. All inspections to ensure compliance with building
construction regulations.
C. The enforcement of all zoning and land use and zoning maps of
the Village.
D. The maintenance of current accurate land use and zoning maps
of the Village.
E. Performing such other duties as may be required by the
Village Manager including providing assistance and advice as
may be required by the Plan Commission, or other agencies of
the Village.

13.104 Building Inspector
There is hereby created the position of Building Inspector. The Building
Inspector shall be appointed by the Village Manager and serve at his
discretion.
13.105 Duties
It shall be the duty of the Building Inspector to inspect all buildings
and structures being erected or altered, as frequently as may be
necessary to ensure compliance with the Village Ordinance. The Building
Inspector shall be under the direction of the Building Commissioner.
13.106 Ex -Officio Electrical Inspector
The Building Commissioner shall also be the chief electrical inspector
and ex -officio electrical inspector and shall have the power to inspect
any electrical installations and no electrical wiring shall be covered
until after such inspection. He shall also have the power to cause the
current in any wiring or circuit or conduit to be turned off whenever
this is necessary in an emergency to protect life or property.
13.101 Ex -Officio Plumbing Inspector
The Building Commissioner shall also be the chief plumbing inspector and
ex -officio plumbing inspector and is hereby empowered to enforce all
ordinances relating to the installation, care, and standards of plumbing
and shall make such inspections as may be necessary to ensure compliance
with such provisions.
13.108 Copies of Permit to Assessors
In addition to all other duties, the Building Commissioner shall forward
to the Township Assessors and County Assessors a copy of each building
permit issued, at the end of each current month.
13.109 Records - Reports
The Building Commissioner shall keep records of all applications and
shall show the disposal thereof. He shall make monthly reports to the
Village Manager of his activities and of the services of the Department.
He shall file such other reports as may be required by the Village
Manager.

ARTICLE II - BUILDING CODE
13.201 Adoption of Regulations - One and Two Family Dwelling Units
The provisions of the CABO One and Two Family Dwelling Organizations
Code, 1986 Edition as prepared by the Nationally recognized Model Code,
is hereby adopted as the regulations governing the construction of
detached one and two family units, their appurtenances, and accessory
structures except as noted herein:
A. The provisions of the BOCA National Building
Code 1987 Edition shall apply to items not
specifically covered by the CABO One and Two
Family Dwelling Code, 1986 Edition.
B. "Part VI Electrical" of the CABO One & Two
Family Dwelling Code is hereby deleted and
replaced by Article IV of Chapter 13 of the
Municipal Code of the Village of Elk Grove
Village.
C. Section R-115 Definitions delete family
definition and insert following:
Family - One or more persons occupying a
premise and living as a single housekeeping
unit, whether or not related to each other by
birth, adoption or marriage, but no unrelated
group shall consist of more than three persons,
as distinguished from a group occupying a
boarding house, lodging house, or hotel.
Three copies of said CABO One and Two Family Dwelling Unit Code 1986
Edition, are available for inspection and on file in the Office of the
Village Clerk of the Village of Elk Grove Village.
13.202 All Other Structures
The 1987 Edition of the BOCA National Building Code as prepared by the
Building Officials and Code Administrators International, Inc., is hereby
adopted as the regulations governing the construction of all other
buildings and structures in the Village of Elk Grove Village.
Detached one and two family dwelling unit provisions of the 1987 BOCA
National Building Code shall not prevail, when specifically covered in
the CABO One and Two Family Dwelling Code, 1986 Edition.
The 1987 BOCA National Building Code is hereby modified and amended in
such manner as is set forth in the remaining Articles of this Chapter.
Three copies of said 1987 BOCA National Building Code are available for
inspection and on file in the office of the Village Clerk of the Village
of Elk Grove Village.

13.204
Section 106 Moved Structures shall be amended by adding the following
Sections:
106.2. No person, firm, or corporation shall move any
building on through or over any street, alley,
sidewalk, or other public place in the Village
without having obtained a permit therefore from the
Building Commissioner. Applications for such permits
shall be made in writing to the Building Commissioner
and shall state thereon the proposed route and number
of days it is intended that the building shall occupy
any portion of any public street.
106.3. No permit shall be issued to move a building to a
location within the Village of Elk Grove Village to a
location when the use of said building at said
location would cause a violation of applicable
regulations.

106.4. Any person, firm, or corporation applying for a
permit under this Article shall prior to receiving a
permit, submit a bond with a lawful corporate surety
to be approved by the Village Attorney, conditioned
on compliance with all the provisions of this Article
and agreeing to pay and holding the Village harmless
from any claim which may be made against it by reason
of the occupation of any public street by the
building or structure moved.
106.5. Whenever a public street is used, safety warning
devices shall be provided by a permittee as required
by the Police Department.
106.6. Whenever it shall be necessary to interfere with
wires or cables of public utility in moving a
building, the applicant for a permit shall furnish
evidence that appropriate arrangements have been made
with the affected public utility.
106.7. Whenever it shall be necessary in moving a building
to traverse non Village public streets, it shall be
the responsibility of the applicant for a permit
hereunder, to furnish evidence that appropriate
permission has been secured from the agency or party
who maintains and/or owns the non Village public
street to be used.
106.8. Whenever a building or structure is moved or
demolished, the sites shall be maintained in a safe
condition and restored to grade in accordance with
the provisions of Article 18 of the BOCA National
Building Code, 1987 Edition.
13.205 Delete the following Sections in their entirety
Sections 109.1 thru 109.7 inclusive and Sections 110.1 thru 110.8
inclusive.
13.206 Required Permit
Section 111.1, when permit is required, is amended to read as follows:
WHEN PERMIT IS REQUIRED: When the value of construction is
Three Hun red 300.00 Dollars or more it shall be unlawful to
construct, enlarge, alter, or demolish a structure; or change the
occupancy of a building or structure requiring greater strength,
exit way or sanitary provisions; or to change to a prohibited use;
or to install or alter any equipment for which provision is made
or the installation of which is regulated by this code, without
first filing an application with the building official in writing
and obtaining the required permit therefore; except that ordinary
repairs as defined in Section 104.0, which do not involve any
violation of this code shall be exempt from this provision.
Fences and/or dense plantings shall not be installed without first
securing a permit pursuant to the Zoning Ordinance of the Village
of Elk Grove Village.
13.207 Section 111.5 Plans and Specifications
Section 111.5, Plans and Specifications is deleted and amended to read:
111.5 PLANS AND SPECIFICATIONS
The application for a permit shall be accompanied by not
less than four complete copies of plans and
specifications bearing the seal and signature of a
registered architect, structural, or professional
engineer pursuant to the Statutes of the State of
Illinois. Said plans and specifications shall be drawn
to scale to show the clarity, the details and dimensions
of the work to be performed and the material to be used.
The Building Commissioner is authorized to modify and/or
waive the requirement for plans and/or specifications
when the proposed work is of a minor nature.
PRELIMINARY PLAN REVIEW services may be performed by
the Bui]ding Commissioner or his authorized
representative upon receipt of sufficient information of
partially completed plans for the purpose of providing
advice and assistance about Village requirements and
standards. Said service shall be performed for a fee not
to be in excess of one-half of the established fee
normally charged for full and final plan review and
approval. Any fees paid for said preliminary review
shall not be credited toward the cost for final plan
review work.

13.208 Section 111.6 Site Plan
Section 111.6 is changed to:
111.6 PLOT PLAN AND SURVEY
In addition to the requirements below, evidence shall be
furnished to the Building Commissioner, such as a plat of
survey of said lot prepared by a licensed Illinois Land
Surveyor, that the intended building site is a lot of
record.
Except for an addition to a single family residence, and
their accessory structure, the Building Commissioner
shall be provided with a plat of survey showing the
location of said subsurface improvements in reference to
property lines and other structures located on the same
property under development and the elevation of
subsurface improvements per USGS datum, prior to
proceeding with aboveground improvements, prepared by a
licensed Illinois Land Surveyor.
111.6 Site Plan is changed to Section 111.7.
111.7 Engineering details changed to Section 111.8.
111.8 Amendment to applications changed to Section 111.9.
111.9 Time limitation of application changed to Section 111.10.
13.209 Section 112.2 Suspension of Permit
Section 112.2, Suspension of Permit, is hereby deleted and amended to
read:
112.2 SUSPENSION OF PERMIT
Any permit issued shall cease to be valid when approved
work at the site has not started within sixty (60) days
of the date issued, or been completed within twelve (12)
months of the date issued, or been diligently pursued for
a period of thirty (30) days following commencement of
any work at the site unless otherwise extended by the
Building Commissioner.
13.210 Section 114.0 Fees
Section 114.0 shall be amended as follows:
114.3.1 Fee schedule:
A fee for each plan examination, building permit and
inspection shall be as established by the President and
Board of Trustees.
The fee for a permit to move a structure or building
shall be as established by the President and Board of
Trustees.
The fee for a permit for the demolition of a building or
structure shall be as established by the President and
Board of Trustees.
The fee for a permit to erect signs and similar
structures shall be as established by the President and
Board of Trustees.
114.4 ACCOUNTING, is hereby deleted and amended to read:
All accounting and fiscal responsibilities shall be
performed as required by the State of Illinois Statutes
and the Municipal Code of the Village of Elk Grove
Village.
114.5 REFUNDS, is hereby deleted and amended to read:
Refunds for fees paid shall not be authorized nor made.
13.211 Section 117.4 Violation Penalties
Section 117.4 is hereby deleted and amended to read:
117.4 VIOLATION PENALTIES
Penalties as provided for in section 13.701.
13.212 Section 118.2 Unlawful Continuance
Section 118.2 is hereby amended to read:
118.2 UNLAWFUL CONTINUANCE
It shall be unlawful for any person to continue any work
in or about any building after having been served with a
Stop Work Order, except as may be authorized by the
Building Commissioner to eliminate violations and/or
unsafe conditions.

13.213 Section 123.3 Compensation of Board Survey
Section 123.3 Compensation of Board Survey, is hereby deleted in its
entirety and amended to read:
123.3 COMPENSATION
Compensation of any person serving on the Board of Survey
shall be as determined by the President and Board of Trustees.
13.214 Section 124.2.6 Board of Appeals
Section 124.2.6 Compensation of members, is hereby deleted in its
entirety and amend to read:
124.2.6 COMPENSATION
Compensation of any person serving on the Board of Appeals
shall be determined by the President and Board of Trustees.
13.215 Section 201.0 General Definitions
Section 201.0 add the following definition:
FIRE OFFICIAL: Shall mean the Fire Chief of the
Village of Elk Grove Village.
13.216 Table 501 Height and Area Limitations
Amendments to Table 501 of the 1987 BOCA Basic Building Code.
TABLE 501, line R-2 under columns 5A and 5B shall be
limited to ei ht dwelling units or less,
over eight (83 units not permitted.
13.217 Section 504.0 Unlimited Area
Amend Section 504 by adding the following Section.
504.3 The roof systems of all unlimited area buildings
shall be provided with smoke and heat vents
in accordance with Section 930.
13.218 Section 512.0 Physically Handicapped and Aged
Section 512 is hereby deleted in its entirety and State of Illinois
Accessibility Standards apply.

13.219 Section 602.3.1 Automatic Fire Suppression System
Section 602.3.1 - Automatic Fire Suppression System is revised to read as
follows:
Section 602.3.1 - Automatic Fire Suppression System:
An automatic fire suppression system shall be
installed throughout the building. The system
shall be designed using the parameters set forth
forth in Article 10 and the requirements of
Section 602.3.1.1 through 602.3.1.3.
13.220 Section 602.3.0 High Rise Building
Section 602.3 OPTIONS - the following sections are hereby deleted:
602.3.2 Area of Refuge
602.3.2.1 Division of Floor Area
602.3.2.2 Stairway and Elevator
602.3.2.3 Wall Construction
602.3.2.4 Floor/Ceiling Construction
602.3.2.5 Manual Fire Alarm System
13.221 Section 625 Swimming Pools
A. Section 625.4 is deleted in its entirety. For locations
see Ordinance 842, Section 3.54D.
B. Section 625.6.2 is hereby deleted and amended to read:
625.6.2 - DRAINAGE SYSTEMS
Water demand from a pool shall not be discharged to the
storm drain during periods of rain or storms. At no time
shall the rate of drain water exceed a flow of 200 gallons
per minute.
625.9 - SAFETY DEVICES
Change depth of pool from 24" to 30".
13.222 Section 709.0 Ventilation of Special Spaces
Amend Section 709.0 by adding Section 709.4.
709.4 All buildings of Use Groups F, S, Windowless Building and
those classified as unlimited area shall be provided with smoke
and heat venting by one of the following methods:
1. Smoke control conforming to Section 1019.0, 1987 BOCA
National Building Code.
2. Smoke and heat venting in accordance with Section 930, 1987
BOCA National Building Code.
3. Skylights that meet all the requirements of Section 930,
1987 BOCA National Building Code excluding automatic
activation.
4. For all buildings 12,000 square feet or less 20 square feet
of panels or windows in each 50 lineal feet, or fraction
thereof, of exterior wall in each story. The panels shall
be openable for smoke and heat control. The panels or
windows shall be distributed around the perimeter in not
more than 50 feet intervals. A minimum of one such opening
shall be provided for each building or tenant space.
13.223 Section 807.3 Types and Location of Means of Egress
Section 807.3 - Exit Discharge: amend by adding the following:
DOORWAY GRADING:
From each grade floor exit way there shall be provided, after
exiting the structure, a hard surfaced area a minimum of
forty-eight (48) inches in width centered at the thirty-two (32)
inch minimum required opening and extending to a property line
adjoining a public street or alley or a point which is a minimum
of ten (10) feet clear from any part of the structure. At the
exit door, the level of the exterior surface shall not be
elevated from the floor inside the door, nor shall it be more
than two (2) inches below floor inside the door. A grade floor
exit way shall not have a threshold greater than one-half (1/2)
inch high, with beveled edges. The floor and exterior surface
shall not have a grade of more than two (2) percent for a
distance of five (5) feet either side of the door. The
remainder of the required exterior hard surfaced area shall
have, in the direction of exiting, an elevating gradient not
greater than five (5) percent. Such walks shall be of a
continuing common surface not interrupted by steps or abrupt
changes in grade.
EXCEPTION: One and two family dwellings (Use Group R-3).

13.224 Section 810.2 Dead End Corridors
Section 810.2 Dead Ends - amend the last sentence in this section to read:
The length of dead end corridors shall be in accordance with appropriate
sections of NFPA 101 Life Safety Code - 1985 Edition.
13.225 Section 812.4 Door Hardware
Section 812.4 amend the second sentence to read:
All exit doors shall swing in the direction of egress travel when serving
an occupancy load of 50 or more, or a high hazard, or when travel
distance exceeds 75 feet.
13.226 Section 823.0 Exit Signs and Lights
Section 823.2 - Amend the first sentence by putting a period after
background and deleting the words, "or in other approved distinguishable
colors."
13.227 Section 908.0 Fire Wall and Party Walls
Section 908.5, 908.5.1, 908.5.2, 908.5.3, are hereby deleted in their
entirety and amended to read:
908.5 Continuity of walls: In all buildings and structures, fire walls
shall be continuous from foundation to 2 feet 8 inches (813 MM) above the
roof surface.
13.228 Section 921.0 Fire Stopping and Draft Stopping
Add a new Section 921.7.1.4 to read:
All open web wood floor trusses shall have material conforming to the
requirements for draft stopping attached to one side of the truss.

FIRE PROTECTION SYSTEMS
13.229 Scope
The provisions of this Article specify where fire protection and
detection systems shall be required in all buildings or structures, or
portions thereof hereafter erected. The 1987 BOCA National Building
Code, Article 10, is hereby adopted as the regulations governing the
installation of fire protection and detection systems, save and except
such portions as are hereinafter deleted, modified, or amended.
13.230 Section 1002.0 Fire Suppression Systems
Section 1002.2 is hereby amended by deleting the exception.
Section 1002.6 is hereby deleted in its entirety and amended to read:
Use Groups B & R-1: In all buildings or structure of Use Groups
B & R 1 when:
1. of more than two stories in height.
2. more than 50 habitable rooms are located above the first
floor.
Use Group R-2: In all buildings or structures of Use Group R-2
when more than three stories in height.
13.231 Section 1004.0 Water Sprinkler Systems
Amend this section by adding the following sub -sections.
Section 1004.9 SPRINKLER WATER RUNOFF:
A minimum of one (1) four (4) inch floor drain
or other approved means shall be provided for
every 10,000 square feet of floor area on the
grade or subgrade levels and for every 5,000
square feet on any floor area above the grade
floor. The location of the drain shall be
approved by the Fire Official prior to the
issuance of any buildings permits.
Section 1004.10 An approved detector check valve shall be
installed between the city water supply and the
sprinkler system.

13.232 Section 1005.0 Limited Area Sprinkler Systems
Section 1005.5 Sprinkler Alarms is hereby deleted and a new section added
to read:
Section 1005.5 Sprinkler Alarms: Alarm and alarm attachments shall be
required when there are more than 10
sprinklers on the system.
13.233 Section 1017.0 Fire Protective Signaling Systems
Section 1017.3 is hereby amended by adding:
Section 1017.3.7: In all buildings of Use Group S-1 and S-2 occupancies
more than 2 stories in height or more than 150,000
square feet in floor area of the same tenant area, a
manual fire alarm system is required.
13.234 Section 1018 Automatic Fire Detection Systems
Amend Section 1018.3.4 as follows delete the wording in its
entirety and insert the following:
Use Group R-2:
1. When of more than two (2) stories in height; or
2. When more than fifty (50) habitable rooms are
located above the first or grade floor.
Use Group B:
When more than 7,500 square feet in area per floor.
EXCEPTION:
In buildings of Use Group R-2 smoke detectors are not required
by Section 1018.3.5
Section 1018.3 is further amended by adding the following subsections:
Section 1018.3.6: Senior Citizens Houussin as defined in the Elk Grove
Zoning r inance shall be provided with a complete
heat and smoke detection system.
Section 1018.3.7: In all buildings of Use Groups A-1, A-2, and A-3
with an occupancy load of more tan 5 persons as
computed in accordance with Article 800 shall be
equipped with an approved heat and smoke detection
system.

Section 1018.3.8 All recreational purpose buildings shall be
equipped with an approved eat and smoke detection
system.
Section 1018.3.9: In all buildings of UseGroup A-4, and E, when
more than 1,000 square feet in area shall be equipped
with an approved heat and smoke detection system.
Section 1018.3.10: All day care centers.
13.235 Section 1020.0 Supervision
Section 1020.2 Fire Protection Systems is hereby deleted in its entirety
and insert the following:
Section 1020.2 Fire Protection Systems:
All fire protection systems shall have a direct
connection to the Elk Grove Village Fire Department
Communications Center or an alternate method of
connection as approved by the Fire Official.
13.236 Fees
The fees for fire protection plan review shall be established by the
President and Board of Trustees.
13.237 Elevator, Dumbwaiter and Conveyor Equipment, Installation, and
Maintenance
Article 26 Elevator, Dumbwaiter and Conveyor Equipment, Installation and
Maintenance is hereby amended by adding the following:
2600.2.1 Changes to 1984 ANSI A17.1 standard:
1. Section 104.1 Add the words driving machines after signal
machine.
2. Section 111.98 Change of 111.96 to read:
The switch shall be installed only at the access landings,
top floor, and bottom floor. Access switch may only be
operable after a transfer switch located on face of car
operating panel and operable by a cylinder type lock is
turned on. The lock shall not be operable by any other key
used for the elevator or building. Lock to be identified
by markings off/Insp.
3. Section 204.7A.3 Change first sentence to read as follows:
Passenger and freight elevators shall be provided with a
standby emergency lighting power source on each elevator
conforming to the following.

4. Section 210.2S Add top and car - side emergency exit door,
5. Section 300 Rule 300.2 Change the requirements of Rule
101.16 to read the requirements of Rule 101.1A.
6. Section 303.3D Supply line shutoff valve. Change last
sentence to read:
The shutoff valve shall be located in the machine room with
a permanent handle to attach to valve for shutoff purpose.
7. Rule 306.2 Top of car operating device. Remove exceptions
to rule.
8. Section 211.36 Smoke detectors. Change to read:
Smoke detectors shall be installed in each elevator lobby at
each floor, machine room, and shaft in accordance with NFPA
No. 72E Chapter 4. The activation of a smoke detector in
any elevator lobby, machine room, or shaft other than at the
designated level shall cause all cars in all groups that
serve that lobby to return nonstop to the designated level.
9. Rule 501.5 Light in car. Add words:
Emergency lighting to be provided as per Section 204.7A.3.
10. Rule 509.1 Emergency signal. Add Words:
Emergency signalling device to comply with Section 211.1A.3.
11. Rule 2000.11 Wheelchair lift emergency signals. Change last
sentence to read:
The requirements for emergency power shall apply.
12. Section 2100 Add new Section 2100.11:
Emergency signal devices to be provided and comply with
Sections 211.1A.1, 211.11,1A.2, 211.1A.3, and Section 204.7A3
- Car Illumination.

13.238 Signs and Outdoor Display Structures
Article 29, Signs and Outdoor Display Structures, is hereby deleted in
its entirety and amended to read:
Article 29 Signs and Display
It shall be unlawful to construct, erect, remove, relocate,
expand, or alter any sign, display, or similar items of any size
or nature without first securing a permit pursuant to the Sign
Regulations of the Village of Elk Grove Village.
13.239 Section 3001.0 Precautions During Building Operations
Section 3001.1 Temporary Construction, is deleted in its entirety and
amended to read:
3001.1 TEMPORARY CONSTRUCTION (OPERATIONAL PLAN REQUIREMENTS)
3001.1.1 A building permit shall not be issued until an
operational plan has been submitted to and approved by
the Building Commissioner. The operational plan shall
indicate emergency fire apparatus vehicle access, as
determined by the Fire Official, capable of supporting
emergency fire vehicles weighing 42,000 lbs., truck
runways, employee parking areas, and material storage
yards.
3001.1.2 A $1,500.00 cash deposit or irrevocable letter of credit
payable to and on demand by the Village of Elk Grove
Village shall be deposited with the Village Treasurer.
3001.1.3 The cash deposit or letter of credit shall be cashed and
called to the extent necessary to meet expenses incurred
by the Village of Elk Grove if any aspect of the
operational plan is violated, or if the requirements of
Section 13.227 are not observed. Construction work
shall cease if the level of the cash deposit or letter
of credit is not restored within four business days and
said work shall not be resumed until said deposit
requirements are met.
3001.1.4 Upon successful completion of all construction
activities authorized by a permit and final inspection
approval by the Building Commissioner, the cash deposit
or letter of credit then on file with the Village shall
be returned unused to the depositor by the Village
Treasurer.
3001.1.5 The Building Commissioner may, when the work to be
performed under a permit is minor in nature or scope,
authorize a cash deposit or letter of credit or other
deposit of less than $1,500.00 to fulfill the above
requirements.
13.240 Section 3004.0 Maintenance
Section 3004.0 - Maintenance, is hereby amended by adding the following.
3004.2 It shall be unlawful to allow dirt, debris, gravel,
stone, concrete, or any other material to be deposited,
dropped or thrown on the street which has been prepared
for construction, repair or reconstruction or which has
a bituminous paving course in place. The Building
Commissioner and his authorized representatives are
authorized to stop all construction activity if upon
prior written notice by him to the owner's agent or
general contract, such materials are not removed within
two (2) hours.
3004.3 Failure of the builder and/or developer to maintain the
emergency fire apparatus vehicle access routes in a
useable fashion, as determined by the Fire Official or
to abide by the approved said operational plan shall
constitute sufficient grounds for the Building
Commissioner to suspend any building permit issued in
the affected area (Reference 13.228).
3004.4 The cash deposit or letter of credit, required under
Section 13.228, shall be used or cashed to the extent of
expenses incurred by the Village if any Village
employee, Village equipment, or Village contracted
services are used to remove any such material from any
street as described above. Said expenses shall be
determined in accordance with a schedule of charges
approved by the President and Board of Trustees and on
file in the Office of the Village Clerk.

ARTICLE III - ELECTRICAL CODE
13.301 Periodic Permits
A Periodic Permit for the installation, alteration, and repair of
electrical conductors and equipment may be issued to a person only where
such electrical work is to be performed in or on the premises or property
owned or controlled by the said person, and used exclusively by him to
conduct his business.
13.302
It shall be unlawful to obtain a Periodic Permit under the terms of this
Article for the installation, alteration, and repair of electrical
conductors or apparatus where such work is performed under or by contract.
13.303
No Periodic Permit shall be issued to any person until a qualified
electrician is appointed as required by this Code.
13.304
Where an applicant has complied with this Code, the Chief Electrical
Inspector or his authorized representative shall certify him as a
qualified electrician to said person, firm, or corporation.
13.305 Qualified Electrician
Before any permit to install, alter, or repair electrical work shall be
issued to any person, entitled to secure permits under the electrical
regulations of this Code, he shall appoint or employ a person who may
himself or some other person who, for the purpose of the electrical
regulations of this Code, shall be known as a Qualified Electrician. The
person so appointed or employed to act as a Qualified Electrician shall,
before starting as such Qualified Electrician, be required to comply with
this Code.

13.306 Certification of Qualified Electrician
To act as Qualified Electrician, the applicant shall be not less than
twenty-one (21) years of age, and shall have at least four (4) years of
experience in the installation, alteration, repair, and maintenance of
electrical wires, equipment, and apparatus, or in experience equivalent
thereto. Names and addresses of employers, time employed, and in what
capacity, and proof of such service shall be furnished to the Chief
Electrical Inspector. The applicant may be required to answer correctly,
a reasonable number of questions in writing to show that he has
sufficient knowledge and technical training to perform said electrical
work.
13.307
Whenever a Qualified Electrician shall leave or be discharged from the
employ of any person or firm required to employ a Qualified Electrician,
within fourteen (14) days written notice shall be given the Building
Commissioner by the employer. Permit privileges of such person or firm
shall be suspended until a Certified Qualified Electrician is employed or
appointed.
13.308
An annual, semiannual, or quarterly permit, (Periodic Permit) for the
installation, alteration, and repair of electrical wires and apparatus
may be issued, and renewal permits issued at the expiration date of
original permit, to persons where, due to their method of operation or
the nature of their business, it is necessary to make frequent
alterations and change of their electrical equipment.
13.309
Before any annual, semiannual, or quarterly permit (Periodic Permit)
shall be issued to any person, he shall appoint or employ a Qualified
Electrician in conformity with this Code.
13.310 Permit and Inspection Fees
All permit and inspection fees under this Article shall be established by
the President and Board of Trustees.

13.311 Adoption of Code
The National Electrical Code, 1987 Edition, except as noted, is hereby
adopted by the Village of Elk Grove Village as its official Electrical
Code and shall continue to be and its provisions shall continue to be
controlling in the electrical wiring and electrical construction of all
buildings and structures within the corporate limits of the Village,
except insofar as the provisions contained in this Article may be in
conflict therewith, in which event the provisions contained in this
Article shall prevail and said provisions of the National Electrical Code
in conflict therewith shall be of no force and effect.
NOTE 1: Article 336 of the 1987 National Electrical Code
(Nonnmetalic Sheath Cable) shall be used only by
special permission of the Electrical Commission.
13.312 Construction Regulations for Single and Multifamily R-1,
R-2, R-3, R-4, A-1, A-2, and A-3 Residential Wiring
A. All detached structures requiring electrical service shall
be served underground in an approved manner, and shall be
suitably protected against physical damage.
B. All applications for permits to install or alter electrical
wiring systems other than minor alteration or process wiring
shall include plans indicating the following information:
Outlets to same circuit, number of outlets on each circuit,
number of outlets proposed, number and size of wire to be
drawn in conduit, and complete service and all feeder riser
diagrams and grounding methods and material to be used.
C. All installations or alterations of electrical equipment
shall be inspected before any of the work is concealed. Any
person, firm, company, or corporation shall notify the Chief
Electrical Inspector or his duly authorized deputy, giving
twenty-four (24) hours notice before the required electrical
inspection.
1. The Chief Electrical Inspector or his duly
authorized deputy is hereby empowered to remove or
cause to be removed from said building any material
which might interfere with a thorough inspection.
Said removal shall be at owner's expense.
2. After wires are drawn in the conduits and properly
spliced, it shall be the duty of the person, firm,
company, or corporation to notify the Chief
Electrical Inspector or his duly authorized deputy
who shall inspect such work within twenty-four (24)
hours of such notice being given.

13.313
It shall be unlawful to use or turn on power into,
or induce any electrical current to flow through any
wire or equipment hereafter installed until approved
by the Chief Electrical Inspector. Commonwealth
Edison Company shall not be permitted to install a
service meter unless approved by the Chief
Electrical Inspector.
The foregoing does not restrict the issuance of the
temporary approval by the Chief Electrical Inspector
or his duly authorized deputy for the use of
electricity for construction purposes.
Exit and Emergency lighting systems shall be installed where
required by the Elk Grove Village Building Code and the BOCA
National Building Code 1987 Edition.
Construction Regulations for Commercial and Industrial -
I-1, I-2, B-1, B-2, B-4, B-5, 0-T, and 0-P

other than I-1 and I-2 Industrial Districts shall be served
underground in an approved manner, and shall be suitably

C. Provisions for Commercial and Industrial wiring:
1. Service equipment may have multiple disconnects, but
shall be in one common enclosure.
2. Drawings shall be submitted to the Electrical
Inspection Department of the Village of Elk Grove
Village for approval before any custom building
electrical equipment rated 1,000 amperes or larger
is installed for use in service or distribution
wiring system.

3. The switchboard manufacturer who builds or assembles
the service equipment shall submit three sets of
detail drawings of his proposal, including the
current interrupting capacity of all over current
devices, to the Utility Inspection Department (or
the individual working for the Utility and
designated by them as their plan examiner) who upon
approval will retain one copy, stamp with their
approval the two remaining copies of the drawings
and forward them to the Department of Electrical
Inspection of Elk Grove Village, who in turn will,
upon approval, attach the Village approval stamp
and return one copy to the Submitter bearing the
approval stamp of both the Village and the Utility
and any changes, corrections, additions, or
deletions necessary for approval.
4. Pendant hang flexible cable and cord will be
permitted with the written approval of the Chief
Electrical inspector or his duly authorized deputy
under those circumstances where the use of flexible
cord as a wiring method is necessary to the method
of operation due to the frequent alterations and
changes of the electrical equipment. All such
cables shall contain a GROUND conductor and shall
be terminated in approved fittings.
13.314 All installations or Alterations of Electrical Equipment
Shall be inspected Before any of the Work is Concealed
Any person, firm, company, or corporation shall notify the Chief
Electrical Inspector or his duly authorized deputy giving him twenty-four
(24) hours notice before the required electrical inspection.
A. The Chief Electrical Inspector or his duly authorized deputy
is therein empowered to remove or cause to be removed from

In all apparatus or equipment installed for the purpose of changing the
dry bulb temperature or humidity content of the air, whether used in
conjunction with summer comfort air conditioning or other refrigeration,
the following regulations shall apply:
(a) The use of water is prohibited when used directly from the
mains as a cooling medium in air washers or any type of
equipment whereby the air to be conditioned comes into
direct contact with sprays or wet surfaces, or where the
water is used as the direct or indirect cooling system
medium in coils.

(b)* The use of water is permitted in all compressor type
refrigeration units having standard rated capacities of one
and one-half (1-1/2) tons or less.
(c)* All compressor type refrigeration units having standard
rated capacities of one and one-half (1-1/2) tons or over
shall be equipped with evaporate coolers and condensers,
water cooling towers, spray ponds, or other water cooling
equipment so that all water from the mains is used for make
up purposes only.
*NOTE in (b) and (c) capacities shall be in accordance with
conditions given in Standard A.S.R.E. Testing and Rating
Codes.
(d) If other than compressor types of refrigeration units are
used, the consumption of water from the mains shall be
limited in amount to not more per ton of refrigeration
produced than would be used by the compressor type described
under (c) above when such type is operated under normal
conditions.
13.505 Add the following to M 1202.2
The replacement of an existing appliance, in one and two family dwelling
units, with appliance of an equivalent capacity shall not require
alterations or changes to the structure or to the venting systems.
13.506 Air Quality
Article 17 - Air Quality is hereby deleted in its entirety. (See
Ordinance No. 842, Section 5.9 Performance Standards.)

ARTICLE VII - PENALTIES
13.701
Any person, firm, or corporation violating any provision of this Chapter
shall be subject to a fine of not less than Ten ($10.00) Dollars nor more
than Five Hundred ($500.00) Dollars for each offense, and a separate
offense shall be deemed committed on each day, commencing from date of
official notification, during or on which a violation or failure to
comply occurs or continues.
In addition, the Village shall have the right to seek injunctive relief
from the Circuit Court of Cook County, including the Third Municipal
District thereof to abate or enjoin any violation of this Chapter wherein
the continuation thereof would cause a serious injury to the public
health, safety, and welfare.
