AN ORDINANCE GRANTING A VARIATION OF SECTION 5.34 E. OF THE
ZONING ORDINANCE AS IT PERTAINS TO THE FIFTY (508) PERCENT
OPEN SPACE REQUIREMENT AND THE ELEVATOR REQUIREMENT FOR
THE SBL DEVON - 53/HAMILTON MANOR APARTMENT DEVELOPMENT
WHEREAS, the Zoning Board of Appeals of the Village of
Elk Grove Village at a public meeting duly called and held con-
sidered the question of granting a variation of Section 5.34
E.(1) and E.(6) as same pertain to common open space requirements
and elevator requirements for the Planned Unit Development known
as the Devon - 53 Development; and
WHEREAS, the President and Board of Trustees after having
reviewed the findings of said Zoning Board of Appeals find and
believe that sufficient hardship exists so as to justify the
granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section
3.54 E.(1) and E.(6) of the Zoning Ordinance of the Village.
of Elk Grove Village for property known as the Devon - 53 Develop-
ment located at the Northeast corner of Rohlwing Road and Nerge
Road, which property is legally described on Exhibit A attached
hereto, to permit the following:
A. A variation from the Ordinance requirements
for elevators in buildings of more than two
(2) stories thus waiving the requirement for
elevators on Phase III of the subject property.
B. A variation granting a one (18) percent variation
from the fifty (508) percent open space requirement
as same applies to Phases I, II and III of the
Devon - 53 Planned Unit Development.
Section 2: That an additional variation be granted from
the Building Code Requirements so as to permit buildings containing
twelve (12) units to have frame construction provided said buildings
are fully sprinklered.
Section 3: That this Ordinance shall be in full force
and effect from and after its passage and approval according
to law.
