AN ORDINANCE APPROVING THE EXECUTION AND RECORDING OF
A PLAT OF VACATION OF A PART OF
WINSTON GROVE SECTION 22 NORTH SUBDIVISION FOR A PORTION
OF THE EXISTING BIESTERFIELD ROAD RIGHT OF WAY
AND PLAT OF EASEMENT DEDICATION FOR PUBLIC UTILITIES
P R E A M B L E
WHEREAS, the existing right of way for Biesterfield Road
has previously been dedicated to the Village of Elk Grove Village,
and said dedication has been acknowledged by the Village and
was recorded on October 12, 1976 by Document No. 23668769; and
WHEREAS, provisions of Sections 11-91-1 and 11-91-2 of
Article 11 of the Illinois Municipal Code grant to the corporate
authorities of the Village the power to determine that the public
interest will be subserved by vacating any street or alley,
or part thereof, within their jurisdiction in any incorporated
area, by Ordinance passed by the affirmative vote of at least
three-fourths (3/4) of the Village Trustees, (I11.Rev.Stat.
1987, Ch. 24, Par. 11-91-1, 11-91-2); and
WHEREAS, a Plat of Vacation for the portion of the existing
Biesterfield Road right of way to be vacated by the Village
has been prepared by Henderson and Bodwell Consulting Engineers
and has been approved by the Village Engineer, and the Village
President and Board of Trustees have determined that the public
interest will be subserved by vacating the portion of the existing
Biesterfield Road right of way which is legally described in
Section 2 of this Ordinance; and
WHEREAS, a Plat of Easement Dedication for Public Utilities
for easement rights to be reserved and granted to the Village
for the property to be vacated has also been prepared by Henderson
and Bodwell Consulting Engineers and has been approved by the
Village Engineer.
NOW, THEREFORE, BE IT ORDAINED by the Village President
and Board of Trustees of the Village of Elk Grove Village as
follows:
Section 1: The terms of the Preamble are hereby incorpor-
ated into this Ordinance.
Section 2: That the Plat of Vacation for the portion of
the existing Biesterfield Road right of way, as shown and prepared
by Henderson and Bodwell Consulting Engineers, is hereby approved,
and the Village President is authorized to execute said Plat
of Vacation for the following legally described property:
That part of Biesterfield Road in the South-
west i of Section 25, Township 41 North,
Range 10, East of the Third Principal Meri-
dian described as follows:
Beginning at the Southwest corner of Lot
56 in Winston Grove Section 23A recorded
on July 31, 1978 as Document No. 24559901;
thence Easterly 116.92 feet along the arc
of a nontangential curve, said curve being
concave Northeasterly, having a radius of
526.12 feet and a chord bearing of S. 61°
25" 43" E., said curve also being the Northerly
Right of Way of Biesterfield Road as dedicated
by Document No. 23668769 recorded on October
12, 1976; thence S. 22° 12' 18" W., on a
Southerly prolongation of the East line
of said Lot 56, a distance of 58.81 feet
to the Northerly Right of Way of a proposed
realigned Biesterfield Road being 100.00
feet in width; thence Southwesterly 42.35

feet along the arc of a nontangential curve,
said curve being concave Southerly, having
a radius of 813.94 feet, and a chord bearing
of S. 790 53' 52" W., said curve also being
the North Right of Way of said proposed
realigned Biesterfield Road; thence North-
westerly 114.23 feet along the arc of a
nontangential curve to a point of intersection
with the Southerly prolongation of the tangent
portion of the West line of said Lot 56;
said curve being concave Southwesterly,
having a radius of 265.00 feet and a chord
bearing of N. 260 28' 35" W., said curve
also being a Northerly Right of Way of a
proposed realigned Biesterfield Road, being
80.00 feet in width; thence N. 360 27' 45"
E., along said prolongation of the West
line of said Lot 56 a distance of 20.16
feet to the POINT OF BEGINNING containing
0.1446 acres more or less.
Section 3: The Village Clerk is authorized to attest to
the Village President's signature on said Plat of Vacation and
to record it with the Cook County Recorder of Deeds.
Section 4: The Village President and Board of Trustees
hereby accept the Plat of Easement Dedication for Public Utilities
dated October 12, 1988, and the easement provisions reserved
and granted therein to the Village, its successors and assigns
by the grantor Centex Real Estate Corporation d/b/a Centex Homes,
and the Village Clerk is authorized to record the Plat of Easement
Dedication for Public Utilities with the Cook County Recorder
of Deeds.
Section 5: The Village President and Clerk are further
authorized, respectively, to execute and attest such other docu-
ments as may be necessary, including documents of conveyance,
to place the fee title to parcel hereinabove vacated to the

grantor or successor in interest to the grantor of the original
dedication to the Village.
Section 6: This Ordinance shall be in full force and effect
from and after its passage, by a vote of at least three-fourths
(3/4) of the corporate authorities now holding office, and approval
in the manner provided by law.
