HomeMy WebLinkAboutORDINANCE - 1894 - 5/26/1987 - SIGNS & AWNINGS/AMEND CODEORDINANCE NO. 1894 AN ORDINANCE AMENDING CHAPTER 12, SIGNS AND AWNINGS OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE AS IT PERTAINS TO PERMITTED FREESTANDING IDENTIFICATION SIGNS FOR SHOPPING CENTERS BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage as follows: Section 1: That Section 12.002 V - Definition for Shopping Center - be and the same is hereby amended to read as follows: (V) "Shopping Center" A shopping center as herein defined as any concentration of two or more retail stores and/or service establishments in one or more buildings, or on one or more adjacent lots, under single ownership or management, or with one or more of the following: a. Common parking facilities; b. Common storm water detention or storm sewer facilities; C. Common water distribution facilities; d. Common sanitary sewer facilities; or e. Without exclusive ingress or egress from public streets. Section 2: That Section 12.002 - Definitions - be and the same is hereby amended by adding thereto the following: CC. "Monument Sign - A monument sign shall mean any decorative sign not attached to any building or premises which advertises or identifies the business conducted on the premises, and which does not exceed six (6') feet in height." Section 3: That the first paragraph of Section 12.003 - Permitted Signs - be and the same is hereby amended to read as follows: 12.003 - 2rmitted Signs - Signs sha. be classi- fied and permitted in accordance with the regulations set forth in this Article, and only those signs specifically permitted by the text of this Ordinance shall be permitted and no others. The classi- fication for signs hereinafter set forth shall be in accordance with the various use districts designated now or hereafter established in the Zoning Ordinance, or as otherwise provided herein. Section 4: That Section 12.003 B. 2. be and the same is hereby amended to read as follows: 2. A shopping center as herein defined having an aggregated floor area more than ten thousand square feet may elect to construct or erect one freestanding identification sign identi- fying said shopping center, subject to the following criteria and conditions: a. No other freestanding sign, other than entrance or exit signs which do not ex- ceed eight (8) square feet in area, shall be constructed or erected within the area comprising the shopping center, provided, however, that when a shopping center is comprised of more than one lot, then and in that event a monument sign, as defined herein, shall be permitted for a freestanding building located on any outlot which is contiguous to the main shopping center lot and which outlot exceeds twenty thousand square feet in area. b. The freestanding identification sign shall not contain any advertisement other than the identity of the shopping center and the businesses located therein. C. The freestanding identification sign or any portion thereof does not exceed 18 feet in height and maintains a clear- ance of 10 feet from the ground to the bottom of the sign and does not exceed 192 square feet in area if the sign is multi -faced and 96 square feet in area if the sign is single -faced. d. I£ the shopping center fronts on more than one public street, then said shop- ping center may elect to have two (2) freestanding identification signs, to be located on separate street frontages, provided that in that event the signs shall not exceed 45 square feet in area for single -faced signs or 90 square feet for multi -faced signs. -2- Section 5: That Section 12.003 B. 3. is hereby amended to read as follows: 3. Freestanding identification signs in other than shopping centers or in shopping centers having an aggrevated floor area less than 10,000 square feet. One freestanding identification sign shall be permitted subject to the following criteria and conditions: (a) A freestanding identification sign shall be permitted provided said sign fronts on one of the following major arterial streets: (1) Higgins Road (2) Oakton Street East of Lively Boulevard (3) Landmeier Road East of Lively Boulevard (4) Devon Avenue between Elmhurst Road and Arlington Heights Road (5) Busse Road (6) Elmhurst Road (b) No freestanding sign shall exceed forty-five (45) square feet in area for single faced signs nor ninety (90) square feet for multi -faced signs. (c) All freestanding signs shall main- tain a clearance of ten (10') feet from the ground to the bottom of the sign and shall in no case exceed a total height of eighteen (181) feet from the ground to the top of the sign. (d) Observe a setback of five (5') feet from any portion of any street or road right-of-way line and be placed not closer than ten (10') feet from any side property line. Section 6• That Section 12.003 B. is hereby amended by adding there to the following: 9. Mcnument Signs subject to the following conditions: -3- (a) Monument signs shall not exceed six feet in height from the ground to the top of the sign and shall not exceed thirty-nine square feet in area for single -faced signs nor seventy- eight square feet in area for multi - faced signs, and shall not exceed ten feet in width. (b) Observe a setback of five feet from any portion of any street or road right-of-way line and placed not closer than ten feet from any side property line. Section 7: That Section 12.008 - Penalty of the Municipal Code be and the same is hereby amended to read as follows: 12.008 - Penalty - Any person, firm or corpora- tion violating any provision or failing to comply with any provision of this Article shall be subject to a fine of not less than Twenty -Five ($25.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense, and a separate offense shall be deemed committed on each day during or on which a violation or failure to comply occurs or continues to exist. Section 8: The the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 9: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 6 NAYS: 0 ABSENT: 0 APPROVED: Charles J.
