AN ORDINANCE GRANTING A VARIATION OF SECTION 3.54A
OF THE ZONING ORDINANCE TO PERMIT THE CONSTRUCTION
OF AN EVAPORATION TOWER ON PROPERTY LOCATED AT
95 KING STREET, ELK GROVE VILLAGE (DAIRY RESEARCH, INC.)
WHEREAS, the Zoning Board of Appeals of the Village of
Elk Grove Village at a public meeting duly called and held according
to law considered the question of granting a variation of Section
3.54A of the Zoning Ordinance as it relates to structures in
the required side yard to permit the construction of an evaporation
tower on property located at 95 King Street, Elk Grove Village
and legally described hereinafter; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village after having reviewed the findings of said
Zoning Board of Appeals find and believe that sufficient hardship
exists so as to justify the granting said variation.
NOW, THEREFORE, BE IT ORDAINED, by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section
3.54A of the Zoning Ordinance of the Village of Elk Grove Village
as it relates to structures in required side yards to permit
the construction of an evaporation tower six (6) feet five (5)
inches into the required side yard on property located at 95
King Street, Elk Grove Village and legally described as follows:
Lot 3 (except the South 129.29 feet thereof
and except the North 0.71 feet thereof)
in Higgins Road Commercial Subdivision,
Unit No. 4, being a resubdivision of the
West kZ of Section 22, Township 41 North,
Range 11, East of the Third Principal Meridian,
in Cook County, Illinois.
Section 2: That this Ordinance shall be in full force
and effect from and after its passage and approval according
to law.
