HomeMy WebLinkAboutORDINANCE - 1900 - 7/14/1987 - PLAT OF VACATIONORDINANCE NO. 1900 AN ORDINANCE ADOPTING A VACATION OF PART OF UTILITY AND DRAINAGE EASEMENT OF LOTS 136 AND 138 IN STAPE'S SUBDIVISION (WINDEMERE) NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, State of Illinois: Section 1: That approval is hereby given to a vacation of the southerly three (3) feet of the existing easement of Lot 136 and the easterly three (3) feet of the existing easement of Lot 138 in Stape's Subdivision (Windemere), being a subdivision of part of the Northeast Quarter of Section 35, Township 41 North, Range 10, East of the Third Principal Meridian, in Cook County, Illinois, a copy of which is attached hereto and made a part hereof as if fully set forth. Section 2: That the Village President and Village Clerk are hereby authorized to sign said document for and in the name of the Village and attach thereto the Corporate Seal. Section 3: That the Village Clerk of the Village of Elk grove Village is hereby directed to record a certified copy of this Ordinance with the Recorder of Deeds of Cook County, Illinois. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this 14th day of July , 1987 APPROVED this 14th day of July , 1987. Smith Village Clerk PARTIAL RELEASE OF EASEMENT KNOW ALL MEN BY THESE PRESENTS: THAT, COMMONWEALTH EDISON COMPANY, having no facilities located thereon and anticipating no future need therefor, hereby disclaims and releases all right, title and interest it may have in and to the following described premises under and by virtue of the utility easement set forth, granted and reserved on Exhibit "A" appended to the Grant of Easement recorded in the Office of the Recorder of Deeds of Cook County, Illinois, on October 27, 1979, as Document No. 25211886, and corrected by Certificate of Correction recorded December 29, 1983 as Document No. 26911161, to -wit: The South 3 feet of the North 10 feet, except the west 10 feet of Lot 136 and the East 3 feet of the easement on the West line except the South 10 feet, of Lot 138 in Stape's Subdivision, being a Subdivision of part of the Northeast Quarter of Section 35, Township 41 North, Range 10, East of the Third Principal Meridian, in Cook County, Illinois, said Subdivision recorded on April 16, 1979, as Document No. 24920238, said easement recorded October 27, 1979, as Document No. 25211886, and as said easement plat was corrected by Certificate of Correction recorded December 29, 1983 as Document No. 26911161. Except as to the land hereinabove specifically described said Grant of Easement recorded as Document No. 25211886 and 26911161 shall be and remain in full force and effect.
