HomeMy WebLinkAboutORDINANCE - 1904 - 7/14/1987 - RECAPTURE OF WATERMAIN/OAKTONORDINANCE NO. 1904 AN ORDINANCE REPEALING ORDINANCE NO. 1767 AND PROVIDING FOR THE RECAPTURE OF COSTS FOR THE CONSTRUCTION OF A TWELVE INCH (12") WATERMAIN ON OAKTON STREET IN THE VILLAGE OF ELK GROVE VILLAGE WHEREAS, the Village of Elk Grove Village is a home rule municipality as established and defined by the Constitution of the State of Illinois and in that regard is entitled to exercise its powers and authorities in matters pertaining to its governmental affairs; and WHEREAS, the Village of Elk Grove Village has constructed a twelve inch (12") watermain on the south side of Oakton Street between Shadywood Lane and a point seven hundred feet (700') east of Shadywood Lane at a cost of $23,870.60; and WHEREAS, said improvement will serve to benefit the general community and certain properties, hereinafter designated, which may annex to the Village in the future; and WHEREAS, the Village has allocated a certain portion of the cost of said improvement to the parties benefited by same based on a formula based on a percentage of total area which will benefit from this improvement; with the Village assuming a certain portion of said costs. NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the Village of Elk Grove Village shall be entitled to recapture the construction costs of a twelve inch (12") watermain on the south side of Oakton Street between Shadywood Lane and a point seven hundred (7001) feet east of Shadywood Lane which costs total $23,870.60 as set forth on Exhibit 1 attached hereto and by this reference incorporated herein. Section 2: That construction costs shall be allocated at a rate of $296.21 per acre for the following unincorporated properties to be benefited by said watermain: A. Busse Property (77.224 acres) B. Schnell Property (2.578 acres) C. Tichy Property (0.786 acres) The legal descriptions of the above described properties are set forth on Exhibit 2 attached hereto and incorporated herein. Section 3: That the cost to be recaptured as herein established shall be paid to the Village when the properties designated in Section 2 of this Ordinance are annexed to the Village. Section 4: That the Village Clerk is hereby authorized to record a copy of this Ordinance with the Recorder of Deeds of Cook County, Illinois. Section 5: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
