HomeMy WebLinkAboutORDINANCE - 1911 - 8/11/1987 - PUBLIC & PRIVATE IMPROVEMENTSORDINANCE NO. 1911 AN ORDINANCE AMENDING CHAPTER 11 OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BY ADDING THERETO A NEW ARTICLE ENTITLED "PUBLIC AND PRIVATE IMPROVEMENTS BY PRIVATE CONTRACT" BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section 1: That Chapter 11 - STREETS AND SIDEWALKS - be and the same is hereby amended by changing the Chapter heading to read as follows: CHAPTER 11 - PUBLIC IMPROVEMENTS, STREETS AND SIDEWALKS. Section 2: That Chapter 11 be and the same is further amended by adding thereto a new Article which shall read as follows: Article VII - PUBLIC AND PRIVATE IMPROVEMENTS BY PRIVATE CONTRACT A. 11.701 Permit Required. That no street, driveway, parking lot, access drive, curb, curb and gutter, sidewalk, watermain, sanitary sewer, storm sewer, lighting system or other public or private improve- ment required by this Chapter or otherwise in the Municipal Code, whether on public property, property intended to be dedicated for public use or private property, shall hereafter be constructed in the Village of Elk Grove Village by private contract until a permit therefore shall have been obtained. The permit fee shall consist of a Plan Review Inspection Fee and/or a Public Improvement Testing Fee as hereafter established. B. Plan Review/Inspection Fees. That no improvement as above set forth shall be constructed without an engineering plan relating thereto, which plan shall be prepared by or under the direction of the Village Engineer. In any case where plans and specifications shall be prepared by an engineer other than the Village Engineer, then and in that event, the Village Engineer, or his duly designated representative, shall review all plans and specifications, and shall inspect the improvements proposed to be made during the course of construction. The applicant shall pay to the Village as and for the Village's cost for such plan reviews and construction inspections, the sum of one and one-half (1�%) per cent of the estimated cost of construction of all public and private improvements other than the building structures. C. Public Improvement Testing/Testing Fee. All improvements constructed on public property or on property intended to be dedicated for public use shall be tested by the Village Engineer. To defray the costs of the material testing services by the Village Engineer, each owner or developer constructing improvements regulated herein shall pay a testing fee to the Village, which fee shall be equal to cne and one-half (1�%) per cent of the estimated cost of construction of all public improvements. D. Bond. No permit shall be issued for the construction of improvements regulated by the terms of this Article until the applicant has filed with the Village Engineer a bond or bonds required by the provisions of this Chapter, by the Village Subdivision Control Ordinance or other applicable Ordinances or Resolutions requiring bonds or surety bonds for such construction. The form of said bonds and the amounts contained therein must be approved by the Village Engineer. Section 3: That Section 11.501 - PERMIT REQUIRED - of Article V of Chapter 11 of the Municipal Code be and the same is hereby amended to read as follows: 11.501 - Permit Required. No person, firm or corporation shall construct any parking area, including access driveways and interior driveways or receive a building permit for a structure requiring a parking area as defined herein, without having first obtained a permit in accordance with the provisions of Article VII of this Chapter. Application for such permit shall be made to the Village Engineer. -2- Section 4: Any person, firm or corporation violating any of the provisions of this Ordinance shall be subject to a fine of not less than TWENTY-FIVE ($25.00) Dollars nor more than FIVE HUNDRED ($500.00) Dollars for each and every offense, and a separate offense shall be deemed committed on each day during or on which the violation occurs or continues to exist. Section 5: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 6: That any Resolution or Ordinance inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: _6 NAYS: 0 ABSENT: _o_ APPROVED: Charles S.
