HomeMy WebLinkAboutORDINANCE - 1916 - 9/8/1987 - ANNEXATION/BIANCONO. 1916 AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (BIANCO) WHEREAS, a written Petition has been filed with the Village Clerk of the Village of Elk Grove Village by the Harris Trust and Savings Bank as Trustee under Trust Agreement dated March 20, 1967 and known as Trust No. 32670 and LaSalle National Bank as Trustee under Trust Agreement dated September 4, 1986 and known as Trust No. 110309, said Petition seeking annexation to the Village of Elk Grove Village of certain land and territory legally described hereinafter; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village; and WHEREAS, any Fire Protection District, Library District, Township Road Commissioner, County Clerk or other entity or person entitled to notice prior to the annexation of the subject property has been given such notice as is required by law; and WHEREAS, the Petitioners and the Village have entered into a Pre -Annexation Agreement with respect to the annexation of the subject property to the Village, which Annexation Agreement was duly considered at a public meeting duly called and held according to law and which Agreement was approved by the President and Board of Trustees pursuant to Resolution #51-87, duly passed and approved on the 25th day of August, 1987; and WHEREAS, the President and Board of Trustees find and believe it to be in the best interest of the Village that said land and territory be annexed to the Village according to the conditions and provisions of said Pre -Annexation Agreement. NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the land and territory legally described on Exhibit A attached hereto and by this reference incorporated herein, which land and territory is contiguous to the Village of Elk Grove Village, and not within the limits of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boundary limits of said Village as is by law in such cases made and provided. Section 2: That the subject property, pursuant to Section 2.4 of the Zoning Ordinance of the Village, shall be classified as an I-1 Restricted Industrial District. Section 3: That there is hereby granted the following variations of the Village's Subdivision Control Ordinance: a. A variation shall be granted from the provisions of Section 8.001E to permit an eight hundred and twenty-four (8241) foot long cul-de-sac to be constructed as shown on the plans which are amended and made a part of the Annexation Agree- ment referenced herein. b. No alleys shall be required. Sidewalks are required in accordance with the Subdivision Control Ordinance. The owner -developer shall -2- execute a "Statement of Commitment to Construct Public Sidewalk" in the form used by the Village for the installation of sidewalks on Busse Road. Section 4: That the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this Ordinance, together with a Plat of said territory with the Recorder of Deeds of the County of jurisdiction. Section 5: That this annexation is in conjunction with and subject to the terms and conditions set forth in the Annexation Agreement heretofore incorporated by reference into this Ordinance. Section 6: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTES: AYES: 4 ATTEST: Patricia S. APPROVED this � day of September 1987. -3- EXHIBIT A LEGAL DESCRIPTION That part of the West h of the Northwest k of Section 26, Township 41 North, Range 11, East of the Third Principal Meridian, except the South 82.50 feet thereof, lying East of the East line of a 200 foot strip of land conveyed to the County of Cook by Deed recorded January 12, 1939 in the Recorder's Office of Cook County, Illinois as Document No. 12259408 and lying South of a line drawn at right angles to the East line of said 200 foot strip of land from a point on said East line of said 200 foot strip of land, 1957.80 feet South (as measured along the East line of said '200 foot strip of land) of the North line of the Northwest k of said Section 26, in Cook County, Illinois. The East 30.0 feet, measured at right angles to the East line thereof, of that part of the West � of the Northwest k of Section 26, Township 41 North, Range 11, East of the Third Principal Meridian lying Southwesterly of the Northeasterly line of Higgins Road and lying Northerly of a line drawn at right angles to the East line of that 200 foot strip of land conveyed to the County of Cook by Deed recorded January 12, 1939 in the Recorder's Office of Cook County, Illinois as Document No. 12259408, from a point on said East line of said 200 foot strip of land, 1957.80 feet South, as measured along the East line of said 200 foot strip of land of the North line of the Northwest k of said Section 26, in Cook County, Illinois. That part of the 200 foot strip of land conveyed to.the County of Cook by Deed recorded January 12, 1939 in the Recorder's Office of Cook County, Illinois as Document No. 12259408 situated in the Northwest k of Section 26 and the Northeast k of Section 27, both in Township 41 North, Range 11, East of the Third Princi- pal Meridian, except the South 82.50 feet thereof, which lies South of a line drawn at right angles to the East line of said 200'foot strip of land from a point on said East line of said 200 foot strip of land, 1957.80 feet South, as measured along the East line of said 200 foot strip of land, of the North line of the Northwest k of said Section 26, in Cook County, Illinois.
