HomeMy WebLinkAboutORDINANCE - 1918 - 9/8/1987 - WASTE WATER PRE-TREATMENT DUPAGEORDINANCE NO. 1918 AN ORDINANCE AMENDING ARTICLE XII, REQUIREMENTS FOR WASTE WATER PRE-TREATMENT/DuPAGE COUNTY PROPERTY OF CHAPTER 22A, WATER AND SEWER, OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Article XII, Requirements for Waste Water Pre-Treatment/DuPage County Property be and the same is hereby amended as follows: ARTICLE XII REQUIREMENTS FOR WASTE WATER PRE-TREATMENT/ DuPAGE COUNTY PROPERTY 22A.1201 AMENDED: Pre -Treatment Regulations, Bensenville Service Area. There is hereby adopted as and for regulations with respect to the General Pre -Treatment Program regulating use of sewers for property located in the Village of Elk Grove Village within DuPage County, and which property is serviced by the Village of Bensenville's Treatment Facility, the Ordinance and regulations duly adopted by the Village of Bensenville on the 15th day of August, 1985 entitled "AN ORDINANCE ENACTING A GENERAL PRE-TREATMENT PROGRAM, REGULATING USE OF SEWERS AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF", as amended three (3) copies of which are on file in the Office of the Village Clerk of the Village of Elk Grove Village. The Village of Elk Grove Village hereby designates the Village of Bensenville as the primary enforcement authority with respect to the regulations and provisions as set forth in the Ordinance above adopted. 22A.1202: Pre -Treatment Regulations, Elk Grove Village Service Area. There is hereby adopted as and for regulations with respect to the general pre-treatment program regulating use of sewers for property located in the Village of Elk Grove Village within DuPage County, and which property is not currently serviced by the Village of Bensenville's Treatment Facility, the Ordinance and regulations duly adopted by the Village of Bensenville on the 15th day of August, 1985 entitled "An Ordinance Enacting a General Pretreatment Program, Regulating the Use of Sewers and Providing Penalties for Violations Thereof", as amended with the following exceptions: a. Section 8-6A-3 shall be amended to read as follows: 8-6A-3: JURISDICTION: This Ordinance shall apply to that portion of the Village of Elk Grove Village served by the Devon -O'Hare wastewater treatment plant, which is owned by the Village, and to persons outside the Village who are, by contract or agreement with the Village, users of the Village POTW. b. Section 8-6A-7-2: DEFINITIONS shall be amended as follows: SUPERVISOR OF The Director of Public Works of WASTEWATER of the Village of Elk Grove Village. VILLAGE The Village of Elk Grove Village C. Section 8 -6A -8-2(c)(8) shall be amended as follows: Any wastewater which may contain more than thirty-six (36) mg/l of fat, oil or grease (FOG). d. Section 8 -6A -8-2(D) shall be amended as follows: No discharger shall discharge any wastewater containing concentrations greater than the limitations as set forth below into any sewers that connect either directly or indirectly with any Village facility. Section 8-6A-9-2 (I) Cost of Permit. Shall be amended as follows: The annual wastewater discharge permit fee shall be $200.00 due and payable at the time of initial application or reapplication and annually there- after prior to August 31. f. Section 8-6A-10-1 shall be amended as follows: The Village shall publish annually in the local daily news- paper of largest circulation a list of industrial users who have committed significant violations of any pretreat- ment requirement or standard during the previous twelve (12) months. The notification shall also summarize any enforcement actions taken against the industrial users during that period. 22A.1203: Penalty. Any person, firm or corporation violating any of the provisions of this Article shall be subject to a fine of not less than $25.00 nor more than $500.00 for each offense. In addition to the penalties above stated any user of the Bensenville Treatment Facilities and who is a resident or is housed in the Village of Elk Grove Village may be further subject to such penalties and costs as are set forth in the Bensenville Ordinance adopted by reference herein. Section 2: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 4 ATTEST: Patricia S.
