AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE
VILLAGE OF ELK GROVE VILLAGE (COMMONWEALTH EDISON)
WHEREAS, a written Petition has been filed with the Village Clerk of
the Village of Elk Grove Village by Commonwealth Edison, said Petition
seeking annexation of certain land and territory to the Village of Elk
Grove Village; and
WHEREAS, said land and territory is not within the corporate limits of
any municipality, but is contiguous to the Village of Elk Grove Village,
and has no electors residing thereon; and
WHEREAS, said property is owned by Commonwealth Edison, and is
utilized to supply electric power as a public utility, and as a result of
its existing use and the length of time said property has been utilized as
such, said property shall upon annexation be granted a special use in an
R-3 Residential Zone; and
WHEREAS, any Fire Protection District, Library District, Township Road
Commissioner or any other entity or person entitled to notice prior to
annexation of the subject property has been given such notice as is
required by law;
NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees
of the Village of Elk Grove Village, Cook and DuPage Counties, Illinois as
follows:
Section 1: That the land and territory set forth on Exhibit A
attached hereto, which is contiguous to the Village of Elk Grove Village
and not within the limits of any other municipality, be and the same is
hereby annexed to the Village of Elk Grove Village, so that said territory
be included within the boundary limits of said Village as is by law in such
case made and provided.
Section 2: Said property upon annexation shall be designated as I-1,
Restricted Industrial District, in conformance with the Comprehensive Plan
of Elk Grove Village.
Section 3: That said property shall be granted a Special Use in the
I-1, Restricted Industrial District, any provisions or requirements with
respect to public hearings relating to a Special Use being hereby expressly
waived.
Section 4: That the Village Clerk of the Village of Elk Grove
Village is hereby authorized and directed to amend the official map of the
Village to incorporate the rezoning as set forth herein and to record a
certified copy of this Ordinance, together with a plat of said territory
with the Recorder of Deeds of Cook County, Illinois.
Section 5: That this ordinance shall be in full force and effect
from and after its passage and approval according to law.
