AN ORDINANCE REPEALING ORDINANCE NO. 522 THEREBY T:
A FEE FOR CERTAIN SANITARY SEWER TAP -ONS
WHEREAS, the Village of Elk Grove Village pursuant to Ordinance
No. 522 duly passed and approved on the 26th day of March, 1968
established a fee for certain sanitary sewer tap -ons for a certain
property within the Village of Elk Grove Village; and
WHEREAS, the underlying agreement with respect to said
fees has expired in addition to the fact that other provisions
of said agreement became inapplicable;
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois as follows:
Section 1: That Ordinance No. 522, which Ordinance was
duly passed and approved on the 26th day of March 1968 be and
the same is hereby repealed.
Section 2: That this Ordinance shall be in full force
and effect from and after its passage and approval according
to law.

SUBJECT: OBSOLETE ORDINANCE - #522
Ordinance #522 (passed March 26, 1968) is obsolete
for two reason and should be repealed.
First, $50.00 of the $180.00 recapture would have
gone to Centex, based on an unsigned agreement dated May
11, 1965. Ordinance #393 (May 11, 1965 but not published)
referenced the agreement. That document, while not signed
was honored by the Village, had a planned life of twenty
years. Hence it expired on May 12,1985. Centex is no longer
entitled to any recapture funds for a sewer line it (Centex)
installed along Devon Avenue eastward from Somerset Lane.
Second, $130.00 of the $180.00 was to be paid to Joseph
Arvidson for oversized sewers to be installed westward from
Somerset Lane in Devon Avenue and in the Colebrook Subdivision.
Resolution #25-68 (March 26, 1968) referenced the recapture.
The sewers were never installed and the land was developed
by Bongi as Circle Bay. No recapture arrangements were made
with Bongi.
Please prepare an ordinance repealing Ordinance #522.

AN ORDINANCE PROVIDING A FEE FOR CERTAIN ,'ANITARY SEWER TAP -ONS
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois:
Section 1. No person, firm or corporation shall use or tap
on to a V'.11age owned or controlled sanitary sewer for the
benefit of property located in an area bounded by Biesterfield
Road on the north, Arlington Heights Road on the east, Devon
Avenue on the south and Rohlwing Road on the west, unless said
person, firm or corporation has heretofore paid for the over -
sizing of trunk sanitary sewer mains either by prior agreement
with the Village of Elk Grove Village or has paid to the
Village the sum of One Hundred Eighty Dollars ($180.00) per
acre for each acre (including street right-of-ways and other
public dedicated property) to be used and benefited by virtue
of the tap -on of said sanitary sewer. This payment shall be
in addition to the usual charge payable to the Village for
making sewer line connections.
Section.2.This ordinance specifically supersedes and thereby
repeals Ordinance No. 393.
Section 3. Any person, firm or corporation using or tapping
on to a Village owned or controlled sanitary sewer for the
benefit of property located in the area hereabove described,
without first paying the fees and charges provided, shall be
subject to a fine of not less than One Hundred ($100.00)
Dollars nor more than Two Hundred ($200.00) Dollars for said
violation; each day said violation continues shall be deemed
to be a separate and distinct violation.
Section 4. This ordinance shall be in full force and effect
from and after its passage, approval and publication according
to law.
