HomeMy WebLinkAboutORDINANCE - 1837 - 9/9/1986 - DRIVEWAYS & PAVEMENTSORDINANCE NO. 1837 AN ORDINANCE AMENDING CHAPTER 17 OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 7: That Article 11 entitled "DRIVEWAYS" be amended by adding thereto the following Sections: 11.201 Permits required) No person, firm or corporation shall con- struct o driveway for vehicles or onimols across any sidewalk in the Village without having first obtained a permit therefor. Applications for such permits shall be made to the Village Engineer and sholl be accompanied by the fee required. No permit for construction of a driveway for commercial use or for the habitual use of other than the owner or occupant of the premises served sholl be issued except upon the order of the Board. 77.202 Fees) The fee for all such construction permits shall be Ten ($10.00) Dollars. Section 1: That Article V presently entitled "Parking Areas and Parking Areo.Drivewoys" be amended by Changing the Article heading to read as follows: "Article V - Parking Areas, Parking Area Driveways, Public Invited Private Roods, Access Roods, and, Established Ways for Municipal Vehicles." Section 3: That Article V, Sections 11.504 - Appeols/Variotions, and 77.505 - Penalty be amended by renumbering the sections as follows: "11.506 - Appeals/Voriation 71.507 - Penalty" Section 4: That Article V be Amended by adding thereto o new Section 11.504 to read as follows: "11.504 Required Maintenance - The property owner(s) of Business, Commercial, Office, Institutional, Research, Industrial, or Multi -family residential developments of six dwelling units or greater shall be responsible for the maintenance of all parking areas, parking area driveways, public invited private roods, access roods and established ways for Municipal Vehicles. Maintenance operations shall include, but not be limited to pavements, striping and signing in accordance with the require- ments of the following: Page 1 a. Pavements - All pavement which represents a hazard to vehicular or pedestrian traffic shall be defined as one or more of the following: A pot hole three (3) inches or more in depth covering one (1) square foot or more in area. 2. A rut two (2) inches or more in depth. 3. A fault with o one (7)inch or greater difference in elevation. 4. A crock one-half (112) inch or greater in width. 5. Settlement or sinking one (1) inch or greater in depth. 6. Disintegration covering a one (1) square yord or greater area or any other condition that is determined by the Village En- gineer to be a hazord. Notification of the property owner and necessary maintenance activities shall be in accordance with Section 11.505 of this Article. b. Pavement Striping - Ali markings, whether placed on the pavement, on curbs, or on on object, shall be maintained to the extent that their usefulness for directing and delineating traffic movements meets their intended purpose to the satisfaction of the enforcing officer. Notification of the property owner and necessary maintenance activities shall be in accordance with Section 11.505 of this Article. c. Traffic Signing - All signage shall be maintained to the extent that their usefulness for directing, and advising traffic movements meets their intended purpose to the satisfaction of the enforcing officer. Page 3 A/I traffic signs shall be kept in proper position, clean and legible at all times. Special core should be token to see that weeds, trees, shrub- bery and construction materials do not obscure the visibility of any sign. Damaged, defaced, dirty andlor obscured sign- age shall be replaced and/or maintained in accordance with Section 11.505 of this Chop ter." Section 5: That Article V be amended by adding thereto o new Section 11.505 to read as follows: "17.505 Notification and Compliance - The enforcing officer shall notify the property owner or occupant concerning violations of this Article. Such notification shall indicate the nature of the violation and on amount of time allowed for compliance. Upon receipt of said notice, the property owner shall notify the enforcing officer within ten (10) working days of his plans for corrective action. Time to comply shall be determined as follows: a. During the construction season (April 1 to October 30), o maximum of thirty calendar days for a perm- anent repair. b. A t other times of the year, a max- imum of thirty calendar days for a temporary repair. c. For hazardous pavement damage which would result in either vehicular or personal property damage, or, in- jury to pedestrians, o maximum of twenty-four hours for o temporary repair. Extensions for compliance may be granted under special circumstances and demonstration of undue hardship. " Section 6: That Section 17.507 - Penalty, be amended by adding thereto the following paragraph: "in addition to any penalty as hereinabove provided, the Village of Elk Grove Village shall hove the right by injunction to enjoin the use of such parking area, parking area driveway, public in- vited private rood, access rood or established way for municipal Page 4 vehicles, and, in cases of emergency, shall hove the right to immediately close any of the aforementioned areas and thereafter proceed by injunction to enforce the provisions of this Article. Section 2: The Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to low.
