HomeMy WebLinkAboutORDINANCE - 1844 - 10/14/1986 - ZONING VARIATION/895 CASS LNNO. 1844 AN ORDINANCE GRANTING A VARIATION OF SECTION 3.54A OF THE ZONING ORDINANCE OF THE VILLAGE TO PERMIT THE CONSTRUCTION OF A FIREPLACE WITHIN THE EIGHT FOOT REQUIRED SIDE YARD ON PROPERTY LOCATED AT 895 CASS LANE, ELIC GROVE VILLAGE (LAPPA) WHEREAS, the Zoning Board of Appeals of the Village of Elk Grove Village at a public hearing duly called and held accord- ing to law considered the question of granting a variation of Section 3.54A of the Zoning Ordinance as it relates to structures in any required side yard to Peter and Wendy Lappa to permit the construction of a fireplace sixteen (16) inches within the 8 -foot required side yard on property located at 895 Cass Lane, Elk Grove Village, and legally described hereinafter; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, after having reviewed the recommendation and finding of said Zoning Board of Appeals, find and believe that sufficient hardship exists so as to justify the granting of said variation. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: That there be granted a variation of Section 3.54A of the Zoning Ordinance as it relates to structures in any required side yard to permit the construction of a fireplace sixteen (16) inches within the 8 -foot required side yard on property located at 895 Cass Lane, Elk Grove Village, and legally described as follows: Lot 75 in Parkview Heights Subdivision, being a subdivi- sion in the Northeast 1/4 of Section 36, Township 41 North, Range 10, East of the Third Principal Meridian, according to the plat thereof recorded April 12, 1978, as Document Number 24399728 and Certificate of Correction Recorded January 2, 1979, as Document Number 24784941, and Recorded May 7, 1979 as Document Number 24949007, in Cook County, Illinois. Section 2: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTES: AYES: S NAYS: n ABSENT: 1 APPROVED: Charles J.
