AN ORDINANCE GRANTING A VARIATION OF SECTIONS 3.54
OF THE ZONING ORDINANCE TO PERMIT THE CONSTRUCTION
OF A FIREPLACE IN THE REQUIRED SIDE YARD OF PROPERTY
LOCATED AT 939 DAVID LANE, ELK GROVE VILLAGE (MUELLER)
WHEREAS, the Zoning Board of Appeals at a public meeting
duly called and held according to law considered the question
of granting a variation of Section 3.54 of the Zoning Ordinance,
as it relates to structures in any required side yard area,
to permit the construction of a fireplace 29 inches within the
8 -foot required side yard on property located at 939 David Lane,
Elk Grove Village, and legally described hereinafter; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village, after having reviewed the findings of
said Zoning Board of Appeals, find and believe that sufficient
hardship exists so as to justify and warrant the granting of
said variation.
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois, as follows:
Section 1: That there be granted a variation of Section
3.54 of the Zoning Ordinance of the Village of Elk Grove Village,
as it relates to structures in any required side yard area,
to Michael and Brenda Mueller to permit the construction of
a fireplace 29 inches in the required 8 -foot side yard on property
located at 939 David Lane and legally described as follows:
Lot 163 in Parkview Heights Subdivision, being a subdivi-
sion in the North East one quarter of Section 36,
Township 41 North, Range 10 East of the Third Principal
Meridian, according to the plat thereof Recorded April
12, 1978 as Document 24399728, and Certificate of
Corrections recorded January 2, 1979 as Document 24784941,
recorded May 7, 1979, as Document 24949007, in Cook
County, Illinois.
Section 2: That this Ordinance shall be in full force
and effect from and after its passage and approval according
to law.
