AN ORDINANCE ANNEXING AND REZONING CFRTAIN PROPERTY
TO THE PILLAGE OF ELK GROVE VILLAGE (GERALI)
WHEREAS, a written petition has been filed with the Village Clerk by
James A. Gerali and Caravan Properties, Inc. of 630 Fairfield Circle, Elk
Grove Village, Illinois, as Owners of Record, of the hereinafter described
property, said petition being for annexation to the Village of Elk Grove
Village; and
WHEREAS, the legal description of the subject property is setforth in
Exhibit "A" attached hereto, made a part hereof and incorporated herein by
reference (subject property located at the northwest corner of Higgins Road
and Lively Boulevard in unincorporated Cook County); and
WHEREAS, the subject property is not within the Corporate Limits of any
municipality but is contiguous to and may be annexed to the Village of Elk
Grove Village, Illinois as provided in Article 7 of the Illinois Municipal
Code (Illinois Revised Statues 1985, Chapter 24); and
WHEREAS, there are no electors residing on the subject property; and
WHEREAS, all applicable provisions of the Illinois Revised Statues
pertaining to annexation and requisite notice therefor have been complied
with and adhered to; and
WHEREAS, the Plan Commission of the Village of Elk Grove Village,
acting as a Zoning Commission, conducted a public hearing duly called and
held according to law to consider the question of annexing and rezoning
said property to the Village of Elk Grove Village; and
WHEREAS, the OWNER proposes to subdivide the subject property into five
(5) lots as specified on the Preliminary Plat of Subdivision attached
hereto as Exhibit "B"; and to develop each lot of said subdivision at
separate times and with different zoning classifications; and
WHEREAS, the OWNER intends to construct and operate an automotive
laundry/car wash on the subject property identified as lot "1" on the
aforementioned Preliminary Plat of Subdivision; and
WHEREAS, the corporate authorities, after due and careful
consideration, have concluded that the annexation of the subject property
to the Village would further the orderly growth of the Village, enable the
Village to control the development of the area and serve the best interest
of the Village.

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois
as follows:
Section 1: That the subject property legally described on Exhibit
"A" is hereby annexed to the Village of Elk Grove Village.
Section 2: Lot 1, on the Preliminary Plat of Subdivision attached
hereto as Exhibit "B", shall, upon annexation, be rezoned and classified as
B-3, Automotive Oriented Business District, permitting the construction and
operation of an automotive laundry/car wash facility on the subject
premises. Lots 2 through 5 on said Exhibit "B", shall, upon annexation, be
rezoned and classified as an I-1, Restricted Industrial District. That
there heretofore have been conducted such public hearings as.are necessary
to grant the zoning classification, use and development of the subject
property as provided for herein and that no further action need be taken
by or on behalf of OWNER to obtain said zoning classifications and use
once the subject property is annexed to the Village.
Section 3: Upon annexation the Village agrees to approve a final plat
of subdivision with respect to said Lots "1" through "5", provided that it
is in substantial conformity with Exhibit "B".
Section 4: It is agreed that the Village will issue the necessary
building permits for the construction of the aforementioned automotive
laundry/car wash substantially in accordance with plans and specifications
depicted on the Site Plan, Exhibit "C". Further, said construction shall
be in conformance with the applicable codes, regulations and ordinances of
the Village.
Section 5: That the Village Clerk of the Village of Elk Grove Village
is hereby directed to record a certified copy of this Ordinance together
with an accurate Plat of Annexation of said property with the Recorder of
Deeds of Cook County, Illinois and is further directed to amend the Zoning
Map of the Village in accordance with the provisions hereof and to file
such Notice of Annexation as is required by law.
Section 6: That the annexation of the property herein is subject to
the condition that the OWNER make payment to the Village Municipal Purpose
Fund an amount of One Thousand Five Hundred Sixty Eight ($1,568.00)
Dollars.

Section 7: That the Village Clerk is hereby directed to publish this
Ordinancr in pamphlet form.
Section 8: That this Ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.
