HomeMy WebLinkAboutORDINANCE - 1859 - 1/13/1987 - SEWER RATES AMENDEDORDINANCE NO. 1859 AN ORDINANCE AMENDING ARTICLE V, SEWER RATES OF CHAPTER 22A OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE WHEREAS, the Illinois Environmental Protection Agency and the United States Environmental Protection Agency have reviewed and approved grant applications previously submitted with respect to the upgrading o the Village's Sewer System; and WHEREAS, said agencies have reviewed the Village's present methodology of establishing wastewater service charges; and WHEREAS, said agencies have determined that in approving and extending Federal funding for improvements and in the upgrading of local wastewater facilities, it is necessary to establish uniform user charges based on actual operation, maintenance and replacement cos: and other regulations relating to flow measurement ad applicable surcharges and related matters; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elie Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Article V, Sewer Rates of Chaoter 22A of the Municipal Code of the Village of Elk Grove_ Village be and the same is hereby amended to read as follows: ARTICLE V WASTEWATER SERVICE CHARGE 22A.501 Basis for wastewater service charges_: The wastewater service charge for the use of and for service supplied by the wastewater facilities of the Village of Elk Grove Village shall consist of a basic user charge for operation, maintenance, and replacement. A debt service charge and a surcharge, if applicable, may also be made from time to time. The debt service charge shall be computed by dividing the annual debt service of all outstanding debts by the number of users. Through further divisions, the monthly and quarterly debt service charges can be computed. 22A.502 The basic user charge shall be based on water usage as recorded by water meters. It shall consist of operation, maintenance, and replacement costs and shall be computed as follows: a) Estimate the projected annual revenue required to operate and main- tain the wastewater facilities including a replacement fund for the year, for all works categories. b) Compute costs per 1,000 gallons for normal sewage strength. 22A.503 A surcharge may be levied to users whose wastewaters exceed the normal concentrations for BOD and SS as may be established by the Metropolitan Sanitary District of Greater Chicago for property serviced by that system or by the Village of Bensenville for property serviced by that system.. 22A.504 The adecuacv of the wastewater service charge shall be reviewed annually by the Director of Finance for the -2- Village of Elk Grove Village. All sewage system costs shall be audited annually by a Certified Public Accountant. The audit shall be available for inspec- tion by any party during normal business hours. The wastewater service charge shall be revised periodically to reflect a change in debt service, surcharge or a change in operation, maintenance, and replace- ment costs. 22A.505 Measurement of flow: The volume of flow used for computing basic user charges and surcharges shall be the metered water consumption. a) If the person discharging wastes into the public sewers procures any part, or all, of his water from sources other than the Public waterworks System, all or a part of which is discharged into the public sewers, the person shall install and maintain, at his expense, water meters of a type approved by the Village of Elk. Grove Village for the purpose of deter- mining the volume of water obtained from these other sources. b) Devices for measuring the volume. of waste discharged may be required by the Village of Elk Grove Village if these volumes cannot otherwise be determined from the metered water consumption records. Such metering devices shall be installed, owned and maintained by .the person. Following approval and installation, such meters may not be removed, unless service is cancelled, without the consent of the Village of Elk Grove Village. c) Right of Entry. The Village of Elk Grove Village shall have the right to enter on the property of persons dis- charging waste into the public sewer system for the purpose of inspecting any meters located thereon as may be required in paragraphs a) and b) above and determining the volume of flow there- from. -3- 22A.506 Debt service charge: A debt service In the event use of the wastewater facilities is determined by the Village of Elk Grove Village to be in excess of the above number of gallons per month for a given water meter size, the Village of Elk Grove Village may require such flat rate user to install (at his expense) approved metering devices on the water supply or .customer sewer service line to measure the amount of service supplied. 22A.509 Surcharge rate: The rates of surcharges for BOD and SS shall be as established by the Metropolitan Sanitary District of Greater Chicago for property serviced by that system and by the Village of Bensenville for property serviced by that system. charge is not presently charged. The Village of Elk Grove Village may, if the need arises, establish a debt service charge sufficient to comply with the terms and provisions of legally estab- lished indebtedness documents. 22A.507 Basic user rate: There shall be and there is hereby established a basic user rate for the use of and for service supplied by the Wastewater Facilities of the Village of Elk Grove Village. A basic user rate of $.35 per 1,000 gallons shall be applied to all users. 22A.508 Non -metered Users: All non -metered Elk Grove Village users of the wastewater facilities shall pay a flat rate charge per month to cover the charges established by the Village of Elk Grove Village. The minimum charge shall be at the rate of $.35 per 1,000 gallons. The flat rate charge will allow a maximum of the following. number of gallons per month for a user who would otherwise have a water meter of the following size: Meter Size Gallons Flat Rate Meter Size Gallons Flat Rate 5/8A" 8,670 $ 3.03 2" 193,831 $ 67.84 3/4" 8,670 $ 3.03 3" 193,831 . $.67.84 1" 20,613 $ 7.21 4" 657,061 $229.97 lei" 61,883 $21.66 6" 657,061 $229.97 In the event use of the wastewater facilities is determined by the Village of Elk Grove Village to be in excess of the above number of gallons per month for a given water meter size, the Village of Elk Grove Village may require such flat rate user to install (at his expense) approved metering devices on the water supply or .customer sewer service line to measure the amount of service supplied. 22A.509 Surcharge rate: The rates of surcharges for BOD and SS shall be as established by the Metropolitan Sanitary District of Greater Chicago for property serviced by that system and by the Village of Bensenville for property serviced by that system. 22A.510 Computation of surcharge: The concen- tration of wastes used for computing sur- charges shall be established by the Metro- politan Sanitary District of Greater Chicago for property serviced by that system and by the Village of Bensenville for property serviced by that system. 22A.511 Computation of Wastewater Service Charge Notice of Rates. The wastewater service charge shall be computed by the following formula: CW = Vu X CU Where CW = Amount of wastewater service charge ($) per billing period. Vu = Wastewater Volume in 1,000 gallon units for the billing period. CU = Basic User Rate for operation, Maintenance and Replacement. Each sanitary sewer user in the Village shall be notified, at least annually, in conjunction with a regular bill of the rate and that portion of the user charges which are attributable to wastewater services as provided by Elk Grove Village. 22A.512 Connection Charge: All property for which a building permit may hereafter be issued, except municipal buildings owned by the Village of Elk Grove Village, which require a new connection with any mains or pipes which are or hereafter may be constructed and used in connection with the Village sewer system, shall pay a connection charge of Twenty-five ($25.00) Dollars. 22A.513 Repeals: All sections, paragraphs or chapters of ordinances and codes previously enacted by the Village of Elk Grove Village which are in conflict with this Ordinance are hereby declared invalid and of no force or effect, and they are hereby repealed. -5- 22A.514 Penalty: Any person, firm or corporation violating any provisions of this Article shall be subject to a fine of not less than Twenty-five ($25.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues to exist. Section 2: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 3: That this Ordinance shall be in full force and effect commencing with the Village's water and sewer billing of February 27, 1987, which date is subsequent to its passage, approval and publication according to law.
