HomeMy WebLinkAboutORDINANCE - 1860 - 1/13/1987 - REGULATION & PROCEDURE OF SEWER SYSTEMNO. 1860 AN ORDINANCE AMENDING CHAPTER 22A WATER AND SEWER BY ADDING THERETO PROVISIONS WITH RESPECT TO THE REGULATION AND PROCEDURE OF THE VILLAGE'S SEWER SYSTEM WHEREAS, the Illinois Environmental Protection Agency and the United States Environmental Protection Agency have reviewed and approved grant applications for the upgrading of the Village's Sewer System; and WHEREAS, said agencies have requested that the Village provide and enact certain amendments to its Water and Sewer Ordinance with respect to the regulation, inspection and enforcement of the provisions of the Village's Sewer System amendments with respect to rate notification and accounting procedures; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Article I of Chapter 22A, Water and Sewer of the Municipal Code of the Village of Elk Grove Village be and the same is hereby amended by deleting the present Section 22A.106, Tampering, and substituting therein the following Section: Section 22A.106. It shall be unlawful for any unauthorized person to maliciously, willfully or negligently break, damage, destroy or tamper with, alter or injure any structure, appurtenance, equipment, meter or other part of the Village's Water and Sewer Facilities. Any person violating this provision shall be subject to immediate arrest under a charge of disorderly conduct. Section 2: That Chapter 22A of the Municipal Code of the Village of Elk Grove Village be and the same is hereby amended by adding thereto a new Article, which Article shall read as follows: ARTICLE XIII Miscellaneous Provisions 22A.1301 - Access to Records. The Illinois Environmental Protection Agency, the United States Environmental Protection Agency or their authorized representatives shall have access to any books, documents, papers and records of the Village of Elk Grove Village, which are applicable to the Village's system of user charges, for the purpose of making audit, examination, excerpts, and transcription thereof to ensure compliance with the terms of the Federal Regulation and Conditions of any Federal Grant. 22A.1302 - Revenues. All revenues and monies derived from the operation of the Village Sewerage System shall be deposited in the Waterworks and Sewerage Fund, 3 fund separate ar.d apart from all other Village funds. The accounting records for the Waterworks and Sewerage Fund shall be maintained on the accrual basis in accordance with generally accepted accounting principles and applicable legal requirements. The accounts for revenues and expenditures will be maintained -2- , C separately within the fund for both the Water System and the Sewer System. 22A.1303 - Inspections. The Director of Public Works and other duly authorized employees of the Village of Elk Grove Village, the Illinois Environmental Protection Agency and the United States Environmental Protection Agency, bearing proper credentials and identification, shall be permitted to enter all properties in the Village for the purpose of inspection, observation, measurement, sampling and testing in accordance with the provisions of this Ordinance. The Director of Public Works or his representative shall have no authority to inquire into any processes, including metal- lurgical, chemical oil refining, ceramic, paper or other industries beyond that point having a direct bearing on the kind and source of discharge to the sewers or waterways or facilities for waste treatment. Section 3: That any person, firm or corporation violat- ing any of the provisions of this Ordinance shall be subject to a fine of not less than Twenty-five ($25.00) Dollars or more than Five Hundred ($500.00) Dollars for each offense and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues to exist. Section 4: The Village Clerk is hereby authorized to published this Ordinance in pamphlet form. Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 0 ABSENT: 1 - APPROVAL: Charles J.
