INSPECTION AND REMOVAL OF CERTAIN SIGNS OF THE
MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE
WHEREAS, the Village of Elk Grove Village is a Home Rule
Municipality as authorized and defined by the Constitution of
the State of Illinois; and
WHEREAS, the Village has been advised that in excess of
sixty (60) advertising benches or signs have been placed in
Village, County or State rights -of -ways within the Village without
the permission of the Village, County or State and without receiving
a sign permit therefor; and
WHEREAS, the Village, Cook County and the State of Illinois
have attempted to contact the owners of said signs for the purpose
of removing same but to date said signs remain in existence
in violation of Village Ordinance, County regulation or State
statute;
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois as follows:
Section 1: That Section 12.005 - Inspection and Removal
of Certain Signs be and the same is hereby amended by adding
thereto a new paragraph which shall read as follows:
C. Any advertising bench or sign which is erected
or has been previously erected on any Village,
County or State right-of-way without the permission
of the appropriate local or state agency and for
which no permit was issued by the Village of Elk
Grove Village, shall be deemed to be a nuisance.
In such case the Building Department shall give
written notice by certified mail to the owner
of such sign or bench or if the owner is unknown,
by posting such notice to the sign or bench, advising
that said sign or bench is in violation of the
Village Sign Ordinance and must be removed within
ten (10) days from the notice date. Any bench
or sign which is not removed within said time
period shall be removed and stored by the Village
and any such expense incident thereto shall be
paid by the owner thereof. If the owner fails
to claim said sign or bench within sixty (60)
days from the date of removal, the Village shall
cause said sign or bench to be destroyed or otherwise
dispose of same. In such event the owner shall
remain responsible for all costs associated with
the removal, storage and disposal of such sign
or bench.
Section 2: Any person, firm or corporation violating any
of the provisions of this Ordinance shall be fined not less
than Twenty -Five ($25.00) Dollars nor more than Two Hundred
($200.00) Dollars for each offense, and a separate offense shall
be deemed committed on each day, commencing from date of official
notification, during or on which a violation or a failure to
comply 'occurs or continues.
Section 3: That the Village Clerk is hereby authorized
to publish this Ordinance in pamphlet form.
Section 4: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
