AN ORDINANCE ADOPTING A VACATION OF PART OF UTILITY AND
DRAINAGE EASEMENT ALONG THE SOUTHERLY LOT LINE OF LOT 111
IN THE WINDEMERE SUBDIVISION
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois:
Section 1: That approval is hereby given to a vacation of the
North 3 feet of the South 10 feet, except the West 10 feet, of Lot 111
in Stape's Subdivison, being a subdivision of part of the Northeast
quarter of Section 35, Township 41 North, Range 10, East of the Third
Principal Meridian, in Cook County, Illinois a copy of which is attached
hereto and made a part hereof as if fully set forth.
Section 2: That the Village President and Village Clerk are hereby
authorized to sign said document for and in the name of the Village and
attached thereto the corporate seal.
Section 3: That the Village Clerk of the Village of Elk Grove Village
is hereby directed to record a certified copy of this Ordinance with the
Recorder of Deeds of Cook County, Illinois.
Section 4: That this ordinance shall be in full force and effect
from and after its passage and approval according to law.

VACATION OF EASEMENT for
,pne North 3 feet of the South 10 feet, except the West 10 feet, of
lot 111 in Stape's Subdivision, being a subdivision of part of
the Northeast quarter of Section 35, Township 41 North, Range 10,
East of the Third Principal Meridian, in Cook County, Illinois,
said subdivision recorded on April 16, 1979 as document No.
24920238, said easement recorded October 27, 1979 as document No.
25211886 and as said easement plat was corrected by certificate
of correction recorded December 29, 1983 as document No.
26911161.
The lot is commonly known as 780 Schooner Lane, Elk Grove
Village, Illinois. (see attached exhibit "A")
The Village of Elk Grove Village agrees to vacate its easement
rights as described on this Vacation of Easement.

Northern Illinois Gas Company, having no Rae facilities located therein
and anticipating, no further need thereof, hereby disclaims all right,
title and interest, however acquired, which it has or may have in the
following described property:
The North 3 feet of the South 10 feet (except the West 10 feet of Lot 111
in Stope's Subdivision) being a Subdivision of part of the Northeast
Quarter of Section 35, Township 41 North, Range 10 East of the Third
Principal Meridian, Cook County, Illinois.
Gas service pipes from gas system mains extending to buildings on the
property, if any, are neither napped nor do recorded easements aliist
covering their locations.
It -is our understanding that with this letter, certain objections
appearing in -say Vrellsisary Report on Title Insurance Application
will be waived or not set up insofar as the rights of this Company
are concerned.

KNOW ALL MEN BY THESE PRESENTS:
THAT, COMMONWEALTH EDISON COMPANY, having no facilities located
thereon and anticipating no future need therefor, hereby disclaims all right,
title and interest it may have in and to the following described premises under
and by virtue of the utility easement set forth, granted and reserved on the
plat of subdivision filed in the Office of the Recorder -of Deeds of Cook County,
Illinois, on October 26, 1979 as Document No. 25211886, to -wit:
The North three (3) feet of the South ten (10) feet, except the West
ten (10) feet of Lot 111 in Stape's Subdivision, being a Subdivision
of part of the Northeast Quarter of Section 35, Township 41 North,
Range 10 East of the Third Principal Meridian, in Cook County,
Illinois, said Subdivision recorded on April 16, 1979 as Document No.
24920238, said easement recorded October 26, 1979 as Document No.
25211886, and as said easement plat was corrected by Certificate of
Correction recorded December 29, 1983, as Document No. 26911161.
Except as to the land hereinbefore specifically described said Grant
of Easement recorded as Document No. 25211886 shall be and remain in full force
