AN ORDINANCE GRANTING A VARIATION OF SECTION 5.1
OF THE ZONING ORDINANCE OF THE VILLAGE TO PERMIT
THE CONSTRUCTION OF A DECK TEN (10') FEET INTO THE
REQUIRED TWENTY (20') FOOT REAR YARD ON PROPERTY
LOCATED AT 872 CASS LANE (KOSKA)
WHEREAS, the Zoning Board of Appeals of the Village of
Elk Grove Village at a public meeting duly called and held according
to law considered the question of granting a variation of Section
5.1 of the Zoning Ordinance as it pertains to rear yard requirements
to permit the construction of a deck that would infringe ten
(10') feet into the regtired twenty (20') foot rear yard on
property located at 872 Cass Lane, Elk Grove Village and legally
described hereinafter; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village find and believe that sufficient hardship
exists so as to justify the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED, by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section
5.1 of the Zoning Ordinance of the Village to permit the construction
of a deck ten (10') feet into the required rear yard on property
located at 872 Cass Lane and legally described as follows:
Lot 45 (except that part thereof lying South
of the Easterly extension of the North line
of Lot 40) and that part of Lot 46 lying
North of the Easterly extension of the North
line of Lot 40 all in Parkview Heights Subdi-
vision being a Subdivision in the Northeast
k of Section 36, Township 41 North, Range
10, East of the Third Principal Meridian,
in Cook County, Illinois
Section 2: That this Ordinance shall be in full force
and effect from and after its passage and approval according
to law.
