HomeMy WebLinkAboutORDINANCE - 1885 - 4/28/1987 - DENVER BOOTORDINANCE NO. 1885 AN ORDINANCE AMENDING ARTICLE I SETTLEMENT OF MISCELLANEOUS OFFENSES - POLICE DEPARTMENT OF CHAPTER 24A OF THE MUNICIPAL CODE BY AMENDING SETTLEMENT PROCEDURES AND COSTS FOR PARKING TICKETS AND PROVIDING FOR THE REMOVAL OR IMPOUNDMENT IN PLACE OF MULTIPLE PARKING ORDINANCE VIOLATORS BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section 1: That Section 24A.101 - Parking Violations. of Article I of Chaper 24A of the Municipal Code be and the same is hereby amended to read as follows: 24A.101 Parking Violations.) Whenever a peace officer is authorized to arrest a person without a warrant or otherwise observes a violation of Article V of Chapter 14 of this Municipal Code (Parking Rules), said officer shall issue a "P" ticket in such form as authorized by the Office of the Clerk of the Circuit Court of Cook County, setting forth the nature of the violation, and the date, time and location wherein the violation occurred and shall issue same by personal delivery to the vehicle operator, if present, or attaching same to the motor vehicle. The registered owner or operator of any vehicle who receives a "P" ticket may settle and compromise the penalty arising from same by paying to the Finance Department the following settlement amounts: TIME PERIOD Date of Violation up to Due Date Due Date up to Final Notice Date Final Notice -Date up to Collection Date Collection Date up to Court Assign- ment Date Court Assignment Date up to Court Date SETTLEMENT AMOUNT minimum fine estab- lished by Ordinance minimum fine estab- lished by Ordinance minimum fine estab- lished by Ordinance plus $10.00 minimum fine estab- lished by Ordinance plus $20.00 minimum fine estab- lished by Ordinance plus $30.00 Any person, firm or corporation who fails to settle or compromise any "P" ticket as set forth herein and who fails to appear in Court will be subject to having a judgment entered in the amount of One Hundred ($100.00) Dollars for each offense. Any person for whom judgment is entered may settle and compromise said judgment by appearing before the Clerk of the Circuit Court, Third Municipal District in Niles, Illinois, within ninety (90) days from the date judgment is entered and paying a fee of Forty- five ($45.00) Dollars for each citation. Section 2: That Article I of Chapter 24A be further amended by adding thereto a new Section which shall read as follows: 24A.104 Impoundment of Vehicles.) A. Violation. Any vehicle, the owner or owners of which have a total of five (5) or more unpaid citations for parking violations, issued within an eighteen (18) month period, charging that such vehicle was parked or stopped in violation -2- of any Ordinance of the Village, shall be deemed a public nuisance, and the police department or any other agents of the Village assigned to traffic duty are hereby authorized to remove, cause to be removed or impound in place the offending vehicle at the sole cost and expense of the owner or owners thereof. B. Disposition of Removed Vehicle. The disposition of removed vehicles shall be in accordance with the Illinois Vehicle Code pertaining to "abandoned property". C. Presumption of Owner's Responsibility. The registered owner of the vehicle having against it five (5) or more citations for parking violations shall be presumed to be the owner and the operator of the vehicle at the time the citations were issued and shall be responsible for the offense and the impoundment. D. Release of Vehicle. Any vehicle removed or impounded in place pursuant to this Section will be released to its lawful owner upon the showing of adequate evidence of the right to possession and upon the payment of all accrued fines and costs for each outstanding unpaid citation and judgment against a person or persons registered as the owner of the vehicle. In lieu of payment of the amount due on any unpaid citation, the owner may deposit a bond in the amount of Twenty -Five ($25.00) Dollars per violation for his appearance in the Circuit Court of Cook County to answer said violation. A release must be signed by an officer of the police department of the Village. Section 3: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. -3- Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
