AN ORDINANCE GRANTING A VARIATION OF SECTION 8.004
OF THE MUNICIPAL CODE TO PERMIT THE CONSTRUCTION OF A
GARAGE ONE (11) FOOT INTO THE EXISTING TEN (10') FOOT
SIDE YARD EASEMENT FOR PROPERTY LOCATED AT 998 LEICESTER
WHEREAS, the Village has received a request from Mr. Mark
Evans, the owner of property located at 998 Leicester, Elk Grove
Village to grant a variation of Section 8.004 of the Municipal
Code to permit the construction of a garage which would encroach
one (11) foot into the existing ten (10') foot side yard easement
on his property; and
WHEREAS, the Village has determined that there are no Village
utilities located in this easement and all private utility companies
have consented and waived their rights to that portion of the
easement for which the variation is requested.
NOW, THEREFORE, BE IT ORDAINED, by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section
8.004 of the Municipal Code of the Village of Elk Grove Village
to Mr. Mark H. Evans to permit the construction of a garage
which would encroach one (1') foot into the existing ten (101)
foot side yard easement for property located at 998 Leicester,
Elk Grove Village.
Section 2: That this Ordinance shall be in full force
and effect from and after its passage and approval according
to law.
