AN ORDINANCE GRANTING A VARIATION OF THE
ZONING ORDINANCE OF THE VILLAGE OF ELK
GROVE VILLAGE AS IT PERTAINS TO THE LOCATION
OF SWIMMING POOLS IN PROXIMITY TO THE SIDE OR
REAR LOT LINES OF PROPERTY TO PERMIT THE
EXISTENCE OF AN ABOVE GROUND SWIMMING POOL
AT 39 EVERGREEN, ELK GROVE VILLAGE (MILLER)
WHEREAS, the Zoning Board of Appeals at a public meeting
duly called and held according to law considered the question
of granting a variation of Sec. 3.54D. of the Zoning Ordinance
of the Village of Elk Grove Village to permit the continued
existence of an above ground swimming pool at property located
at 39 Evergreen, Elk Grove Village and legally described herein-
after; and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village after having reviewed the recommenda-
tions and findings of said Zoning Board of Appeals find and
believe that sufficient hardship exists so as to warrant the
granting of the variation requested;
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Sec.
3.54D. of the Zoning Ordinance of the Village of Elk Grove
Village to permit the continued existence of an above ground
swimming pool in its present location for property located
at 39 Evergreen, Elk Grove Village and legally described as
follows:
Lot 212 in Elk Grove Village Section 1 North,
being a subdivision in the Southeast Quarter of
Township 41 North, Range 11 East of the Third
Principal Meridian according to the Plat recorded
on January 21, 1957 as Document 16806228 in Cook
County, Illinois.
Section 2: That the Village Clerk is hereby authorized
and directed to publish this Ordinance in pamphlet form.
Section 3: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
