AN ORDINANCE GRANTING VARIATIONS OF THE
REAR YARD SETBACK PROVISIONS, THE SIDE YARD
SETBACK PROVISIONS AND THE PARKING STALL PROVISIONS
OF THE ZONING ORDINANCE OF THE VILLAGE OF ELK GROVE
VILLAGE TO CAPITAL BANK 6 TRUST COMPANY, JAMES S.
MONTANA AND STUART HANDLER REAL ESTATE COMPANY
(STRAWBERRY HILL PLAZA RESUBDIVISION)
WHEREAS, the Zoning Board of Appeals at a public
meeting duly called and held according to law considered
the question of granting variations of the rear yard setback,
the side yard setback and the parking stall requirements
of the Zoning Ordinance for the Strawberry Hill Plaza Resub-
division; and
WHEREAS, the President and Board of Trustees of
the Village of Elk Grove Village after having considered
the recommendations of said Zoning Board of Appeals find
and believe it to be in the best interest of the Village
that said variations be granted;
NOW, THEREFORE, BE IT ORDAINED by the President
and Board of Trustees of the Village of Elk Grove Village,
Counties of Cook and DuPage, Illinois as follows:
Section 1: That there be granted a five (5') foot
variation of the rear yard setback requirements of the Zoning
Ordinance; a nineteen (19') foot variation of the side yard
setback requirements; a two and one-half (2'') foot variation
of the nine by nineteen (9 X 19) parking stall requirement
to permit a two and one-half (2�i') foot over -hang to the
Capital Bank & Trust Company, James S. Montana and Stuart
Handler Real Estate Company (Strawberry Hill Plaza Resubdivi-
sion) for property located on the Northeast corner of Biesterfield
and Meacham Roads, which property is legally described on
Exhibit A attached hereto.
Section 2: That this Ordinance shall be in full
force and effect from and after its passage and approval
according to law.
