AN ORDINANCE AMENDING ARTICLE V - PRIVATE PARKING
LOTS OF CHAPTER 11 OF THE MUNICIPAL CODE OF THE
VILLAGE OF ELK GROVE VILLAGE
BE IT ORDAINED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage,
Illinois, as follows:
Section 1: That Chapter 11 presently entitled "Streets
and Sidewalks" be amended by changing the Chapter heading to
read as follows:
Chapter 11. Rights of Way, Parking Areas and Driveways
Section 2: That Section 11.201 ("Permits Required") and
11.202 ("Fees") of Article II - Driveways be and the same are
hereby repealed.
Section 3: That Article V - Private Parking Lots be amended
to read as follows:
Article V - Parking Areas and Parking Area Drive-
ways.
Section 11.501 - Permit Required. No person, firm
or corporation shall construct any parking area,
including access driveways and interior driveways
or receive a building permit for a structure requiring
a parking area as defined herein, without having
first obtained a permit therefor. Application for
such permit shall be made to the Village Engineer.
Section 11.502 - Definitions.
a. Parking Area - The offstreet parking area
for business, commercial, office, institutional,
research, industrial or multi -family residential
developments of six dwelling units or greater, inclu-
sive of the main access driveways, interior driveways
and the parking stalls.
b. Main Access Driveway - The main driveway
which directly connects the parking area to adjacent
public or private roadways, or driveways which are
used as primary traffic ways for vehicular traffic
within a parking area.
C. Interior Driveways - Driveways which principal-
ly connect the main access driveway with the parking
stall area and which are not primary vehicular traffic
ways.
d. Parking Stall Area - That area which contains
designated striping for vehicle parking.
Section 11.503 - Parkina Area Soecifications.
a. All parking areas, including interior driveways
and parking stalls, but specifically excluding the
main access driveways, shall be designed and constructed
to a minimum structural support level of 2.5 as
established by the Design Manual of the Illinois
Department of Transportation Bureau of Design, which
manual, as amended, is hereby adopted by reference.
b. All main access driveways as herein defined
and such other areas intended for or which are to
be utilized for high-volume vehicular traffic or
medium volume truck traffic as determined by the
Village Engineer shall be designed and constructed
to a minimum structural support level of 3.0.
Section 11.504 - Appeals/Variation. Any appeal
of the determination of the Village Engineer or
any request for a variation of the provisions of
this article shall be made to the President and
Board of Trustees. Any person, firm or corporation
requesting Board review shall do so in writing and
shall specify clearly and in detail the nature of
the relief requested and the reasons therefor.
The President and Board of Trustees shall consider
the matter on review at a regularly scheduled Board
meeting, at a specially convened Board meeting,
at a meeting of the Committee of the Whole, or at
a meeting of a standing committee of the Board specifi-
cally designated by the President and Board to hear
and determine any such matter on review.
Section 11.505 - Penalty. Any person, firm or corpora-
tion violating any of the provisions of this Ordinance
shall be subject to a fine of not less than Twenty-five

($25.00) dollars nor more than Five Hundred ($500.00)
dollars for each offense and a separate offense
shall be deemed committed on each day on which a
violation occurs or continues to exist.
Section 4: That the Village Clerk is hereby authorized
to publish this Ordinance in pamphlet form.
Section 5: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
