AN ORDINANCE APPROVING AN AGREEMENT TO TERMINATE AN INTER-
GOVERNMENTAL AGREEMENT, DATED MAY 1, 1978, CONCERNING
RESERVE FIP.E APPARATUS, AND REPEALING ORDINANCE 1219, WHICH
APPROVED THE ORIGINAL AGREEMENT (RESERVE FIRE APPARATUS)
WHEREAS, it has been determined that the Intergovern-
mental Agreement, dated May 1, 1978, approving mutual
cooperation between the Fire Departments of Arlington
Heights, Mount Prospect, Elk Grove Village, and Rolling
Meadows, (Reserve Apparatus) is no longer of value to and
between the communities, and
WHEREAS, Arlington Heights is in need of the exclusive
use of the vehicle, and
WHEREAS, the cooperating communities through its
current Mutual Aid Agreements have adequate resources
available for aerial ladder operations.
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village,
Counties of Cook and Du Page, Illinois, as follows:
Section 1. An agreement by and between the Village
of Arlington Heights, Village of Mount Prospect, Elk Grove
Village, and Rolling Meadows, to terminate an Intergovern-
mental Agreement concerning reserve fire apparatus, a true
and correct copy of which is attached hereto, be and it
is hereby approved.
Section 2. The Village President and Village Clerk
are hereby authorized and directed to execute said Agreement
on behalf of the Village of Elk Grove Village.
Section 3. That Ordinance 1219 is hereby repealed.
Section 4. That this Ordinance shall be in full force
and effect from and after its passage and approval according
to law.

AGREEMENT TO TERMINATE AN
INTERGOVERNMENTAL AGREEMENT DATED MAY IL 1978
CONCERNING RESERVE FIRE APPARATUS
AGREEMENT by and among the following municipalities:
ARLINGTON HEIGHTS, MOUNT PROSPECT, ELK GROVE VILLAGE and ROLLING
MEADOWS.
WHEREAS, the above-named municipalities, acting through
their respective corporate authorities, have heretofore entered
into an agreement known as "AGREEMENT APPROVING MUTUAL
COOPERATION BETWEEN THE FIRE DEPARTMENTS OF ARLINGTON HEIGHTS,
MOUNT PROSPECT AND ELK GROVE VILLAGE (RESERVE FIRE APPARATUS)",
dated May 1, 1978, (hereinafter the "Reserve Fire Apparatus
Agreement"), to which the City of Rolling Meadows was
subsequently added as a party; and
WHEREAS, the 1963 American LaFrance, 100 Foot, Aerial
Ladder Truck, owned by the Village of Arlington Heights, which
was the subject of that agreement is in need of major repair and
its use is no longer practical to the municipalities other than
the owner; and
WHEREAS, the parties wish to terminate that agreement
for joint use and maintenance of the apparatus,
NOW, THEREFORE IT IS AGREED AS FOLLOWS:
1. The Reserve Fire Apparatus Agreement is terminated
with respect to each party thereto, except for the Village of -
Arlington Heights, as of the date of approval of this Agreement
by its corporate authorities, as set forth below, provided,
however, that each party shall continue to be obligated to pay
into the maintenance fund, established to implement the Reserve
Fire Apparatus Agreement and held by the Village of Mount
Prospect, any amounts due under the agreement.
2. The Village of Mount Prospect shall collect any
amounts due to the maintenance fund from the parties to the
Reserve Fire Apparatus Agreement and shall distribute any excess
funds to the parties on a pro rata basis.
3. That subject vehicle shall remain the property of
the Village of Arlington Heights.

ORDINANCE NO. 1219
AN ORDINANCE APPROVING AN AGREEMENT APPROVING MUTUAL COOPERATION
BETWEEN THE FIRE DEPARTMENT OF ARLINGTON HEIGHTS, MOUNT PROSPECT,
AND ELK GROVE VILLAGE (RESERVE FIRE APPARATUS)
NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois,
as follows:
Section 1: A certain agreement by and between the Village of Arlington
Heights, the Village of Mount Prospect, and Elk Grove Village, dated May 1,
1978, a true and correct copy of which is attached hereto, be and it is
hereby approved.
Section 2: The Village President and Village Clerk ,are hereby authorized
and directed to execute said agreement on behalf of the Village of Elk Grove
Village.
Section 3: That this Ordinance shall be in full force and effect from
and after its passage and approval according to law.

Agreement made this 1st day of lay , 197 3 by and
between the following municipalities: ARLINGTON HEIGHTS, MOUNT PROSPECT,
ELK GROVE VILLAGE:
WHEREAS the municipalities of Arlington Heights, Mount Prospect,
and Elk Grove Village have in the past cooperated with each other for
mutual aid for major conflagrations, and now find it necessary to coo_erate
additionally, with regard to mutually sharing expenses to refurbish a 1963
American LaFrance, 100 Foot, Aerial Ladder Truck, Manufacturer's Serial
1.8-1-9147, which is presently owned by the Village of Arlington Heights;
and
WHEREAS by sharing expenses to refurbish this reserve true;: and
its use by the three municipalities, the inconvenience and cost occasioned
by each individual cc.munity in providing a reserve true.: to fulfill the
requirements of the Insurance Service Office of Illinois (I.S.O.) grill be
alleviated; and'
WHEREAS the Fire Chiefs of the three municipalities wish to join
together and refurbish, equip, and place into service one (1) reserve
apparatus to service the best interests of these municipalities;
NO -,'7 THEREFORE, IT IS AGREED AS FOLLOWS:
1. The Village of Arlington Heights shall furnish the completed
chassis and be responsible for the entire refurbishing of its aerial
ladder true;. The cost of refurbishing shall be evenly divided between
the three municipalities; and when the apparatus is completely operable
for the intended purpose, it will be housed at Arlington Heights Fire
Station ;'r3, located at 2000 South Arlington Heights Road, Arlington
Heights, Illinois.
2. This rese apparatus will respond t 11 major fires as a
2nd.Alarm apparatus at the discretion of the Fire Chiefs of the said
three municipalities involved.
3'. The municipalities of vlount Prospect and Elk Grove Village
shall further benefit from this agreement whenever their first line
aerial equipment is out -of -service for necessary maintenance or repairs.
These municipalities shall utilize the subject apparatus for the period
of time that their first line equipment is out -of -service.
4. It shall be understood and agreed that the subject vehicle
shall remain the property of the Village of Arlington Heights and shall
be subject to use by the Village of Arlington Heights on a first priority
basis.
5. The Fire Chiefs of.the three municipalities shall continue to
further explore the future needs of this apparatus as far as the possi--
bil4 ties of mutual manning requ-rements are concerned and/or any fu --,,,-
new requirement placed upon it.
6. On such dates and times as the Village of Mount Prospect or
the Village of Elk Grove solely or jointly use, operate or maintain: the
subject vehicle, said Villages agree to indemnify and hold harmless the
Village of Arlington Heights, its agents, employees, assigns and successors
in interest from any and all liability of whatsoever character for damages
or injuries sustained by any persons or property which may be occasioned
by the negligent or intentional acts of the above municipalities in the
operation of said vehicle.
