HomeMy WebLinkAboutORDINANCE - 1822 - 7/22/1986 - TRUANCY ADDED TO VLG CODEORDINANCE NO. 1822 AN ORDINANCE AMENDING CHAPTER 23 MISCELLANEOUS REGULATIONS OF THE MUNICIPAL CODE BY ADDING THERETO A NEW ARTICLE ENTITLED "TRUANCY" WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village have been advised that there is a growing problem of chronic absenteeism from school by students under the age of 18, and that in many instances police records show that persons under the age of 18 who have been involved in commit- ting offenses of vandalism, drug abuse, alcohol consumption and disorderly conduct have also been guilty of truancy in viola- tion of State laws regarding compulsory school attendance; and WHEREAS, the current procedures provided in the Illinois School Code and the Juvenile Court Act for handling problems of truancy have for the most part proved ineffective in combating such absenteeism from school. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, an Illinois Home Rule Municipality, Counties of Cook and DuPage, Illinois, as follows: Section 1: That Chapter 23, Miscellaneous Regulations of the Municipal Code of the Village of Elk Grove Village being the same is hereby amended by adding thereto the following: Article XVII - Truancy Section 23.1701 - Truancy Prohibited a. It shall be unlawful for any person under the age of 18 enrolled in a public, private or parochial school within the corporate limits of the Village of Elk Grove Village to absent himself or herself from attendance at school, during such period when school is in session, without parental permission or valid cause. b. A valid cause for absence from school shall include illness, death in the immediate family, other family emergencies, or other causes beyond the control of the person so absenting himself or herself from school, provided that parental permission for absence due to such cause is obtained, in writing, from the parent or legal guardian and is submitted to the proper school authorities within 24 hours after such absence. C. Parental permission as required by this Section shall refer to and include permission obtained from a parent, legal guardian or other adult person standing in local parentis and having custody and control over a person under the age of 18. Section 23.1702 - Penalty. Any person who shall so absent himself or herself from school attendance without valid cause or parental permission as provided herein shall be guilty of the offense of truancy, and upon conviction, shall be subject to a fine of not less than twenty-five ($25.00) dollars nor more than five hundred ($500.00) dollars for each offense, and each day that such person shall absent himself or herself from school attendance shall constitute a separate offense. Section 2: The Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: NAYS: 0 ABSENT: -2- APPROVED: Charles J.
