HomeMy WebLinkAboutORDINANCE - 1823 - 7/22/1986 - ANNEXING PROPERTY/HERTZORDINANCE NO. 1823 AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (HERTZ) WHEREAS, a written Petition has been filed with the Village Clerk of the Village of Elk Grove Village by Heritage Pullman Bank and Trust Company as trustee under Trust No. 71-80971 and the Hertz Corporation being the Record Owners and Contract Lessees respectively of the here- inafter described land and territory, said Petition seeking annexation to the Village of Elk Grove Village; and WHEREAS, said land and territory is not within the Corporate limits of any municipality but is contiguous to the Village of Elk Grove Village and has no electors residing thereon; and WHEREAS, a public hearing has been held to consider the question of rezoning the subject property from I-1, Restricted Industrial District to B-3, Business District (Automotive Oriented); and WHEREAS, any Fire Protection District, Library District, Township Road Commissioner, County Clerk or other entity or person entitled to notice prior to annexation of the subject property has been given such notice as is required by law; and WHEREAS, all statutory requirements in reference to the Annexation have been fully complied with and the Village President and Board of Trustees believe it to be in the best interest of the Village that said land and territory be annexed thereto; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1. That the land and territory, legally described on Exhibit A, attached hereto and by this reference incorporated herein, which land and territory is contiguous to the Village of Elk Grove Village, and not within the limits of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boundary limits of said Village as is by law in such case made and provided. Section 2. That all requisite fees due upon annexation to the Village of Elk Grove Village have been paid. Section 3. That said property shall be rezoned from I-1 Industrial District to B-3 Business District. Section 4. That the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this Ordinance, together with a Plat of said territory, with the Recorder of Deeds of Cook County, Illinois. Section 5. That this Annexation is in conjunction with and s subject to the terms and conditions set forth in the Annexation Agreement by and between the Village and the Petitioners, adopted and approved pursuant to Resolution No. 57-86 passed and approved on July 22, 1986. Section 6. That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTES: AYES: 4 NAYS: ABSENT: 2 Charles J. EXHIBIT A LEGAL DESCRIPTION The South 275.00 feet, (as measured along the West line of Busse Road) of the East 200.00 feet, (as measured along the South line of the Southeast Quarter) of that part of the Southeast Quarter of Section 22, Township 41 North, Range 11 East of the Third Principal Meridian, lying West of the West line of Busse Road as per instrument recorded, February 8, 1939 as Document No. 12269603, excepting from the aforesaid tract that part taken for Oakton Street, Document No. 9967968, recorded March 27, 1928 and also except that part for additional dedication for Oakton Street, per Case No. 68L13091 in the Circuit Court, in Cook County, Illinois.
