AN ORDINANCE GRANTING A VARIATION OF THE
SIDE YARD REQUIREMENTS OF THE ZONING ORDINANCE
OF THE VILLAGE OF ELK GROVE VILLAGE TO PERMIT THE
CONSTRUCTION OF A FIREPLACE TWO (21) FEET INTO THE
REQUIRED SIDE YARD AT 1220 CHESTER LANE,
ELK GROVE VILLAGE (ROCHETTO)
WHEREAS, the Zoning Board of Appeals of the Village
of Elk Grove Village at a public hearing duly called
and held according to law considered the question of
granting a variation of Sec. 5.1 of the Zoning Ordinance
of the Village of Elk Grove Village as it relates to
structures in required front, side or rear yard areas
to permit the construction of a fireplace on property
located at 1220 Chester Lane, Elk Grove Village and legally
described hereinafter; and
WHEREAS, the President and Board of Trustees of
the Village of Elk Grove Village after having considered
the recommendation of said Zoning Board of Appeals find
and believe that there exists sufficient hardship so
as to warrant the granting of said variation;
NOW, THEREFORE, BE IT ORDAINED by the President
and Board of Trustees of the Village of Elk Grove Village,
Counties of Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of
Sec. 5.1 of the Zoning Ordinance to Mr. & Mrs. Robert
Rochetto to permit the construction of a fireplace which
would extend two (2') feet into the side yard of property
located at 1220 Chester Lane and legally described as
follows:
Lot 260 in Parkview Heights Subdivision,
being a subdivision in the Northeast Quarter
of Section 36, Township 41 North, Range 10,
East of the Third Principal Meridian, according
to the Plat thereof recorded April 12, 1978,
as Document Number 24399728 and Certificate
of Correction recorded January 2, 1979, as
Document Number 24784941, and recorded May
7, 1979 as Document Number 24949007, in Cook
County, Illinois.
Section 2: That the Village Clerk is hereby authorized
to publish this Ordinance in pamphlet form.
Section 3: That this Ordinance shall be in full
force and effect from and after its passage, approval
and publication according to law.
