AN ORDINANCE PROVIDING FOR THE RECAPTURE OF COSTS
FOR THE CONSTRUCTION OF A TWELVE INCH (12") WATERMAIN
ON OAKTON STREET IN THE VILLAGE OF ELK GROVE VILLAGE
WHEREAS, the Village of Elk Grove Village is a
home rule municipality as established and defined by the
Constitution of the State of Illinois and in that regard
is entitled to exercise its powers and authorities in matters
pertaining to its governmental affairs; and
WHEREAS, the Village of Elk Grove Village has constructed
a twelve inch (12") watermain on the south side of Oakton
Street between Shadywood Lane and a point seven hundred
(700') feet east of Shadywood Lane at a cost of $23,947.40;
and
WHEREAS, said improvement will serve to benefit
the general community and certain properties, hereinafter
designated, which may annex to the Village in the future;
and
WHEREAS, the Village has allocated a certain portion
of the cost of said improvement to the parties benefited
by same based on a formula based on a percentage of total
area which will benefit from this improvement; with the
Village assuming a certain portion of said costs.
NOW, THEREFORE, BE IT ORDAINED, by the President
and Board of Trustees of the Village of Elk Grove Village,
County of Cook, Illinois as follows:

Section 1: That the Village of Elk Grove Village
shall be entitled to recapture the construction costs of
a twelve inch (12") watermain on the south side of Oakton
Street between Shadywood Lane and a point seven hundred
(700') feet east of Shadywood Lane which costs total
$23,947.40 as set forth on Exhibit 1 attached hereto and
by this reference incorporated herein.
Section 2: That construction costs shall be allo-
cated at a rate of $297.16 per acre for the following unincor-
porated properties to be benefited by said watermain:
A. Busse Property (77 +/- acres)
B. Schnell Property (2.5 +/- acres)
C. Tichy Property (1.0 +/- acres)
The legal descriptions of the above described properties
are set forth on Exhibit 2 attached hereto and incorporated
herein.
Section 3: That the cost to be recaptured as herein
established shall be paid to the Village when the properties
designated in Section 2 of this Ordinance are annexed to
the Village.
Section 4: That the Village Clerk is hereby authorized
to record a copy of this ordinance with the Recorder of
Deeds of Cook County, Illinois.
Section 5: That this ordinance shall be in full
force and effect from and after its passage and approval
according to law.

TON WATERMAIN RECAPTURE
The watermoin from Shadywood Lane east for opproximotely
400 lineol feet was oversized from the required 8" to 12". The letter from
the Village to the developer, DiAloso & Son, Inc., agreeing to payment of
$71,050 for the difference in wotermain size is attached.
Also, the above mentioned 72" wotermain was extended from
400 feet east of Shodvwood Lane east for on additional 300 lineal feet to
close the watermoin system on Ockton Street and to accommodate possible
future industrial development in the area. The extension was installed by
R. W. Duntemonn Co. as port of the Oakton St. FA US project at o cost of
$11,897.40. The letter with the approved agreed price is attached.

LEGAL DESCRIPTION
Of that part of Lot 2 of the Division of the East half of the Southwest
quarter of Section 22, Township 41 North, Range 11 Fast of the Third
Principal Meridian, bounced by a line described as follows: Commencing
at a point which is the intersection of the West line of said Lot 2
with the center line of Higgins Road; thence South along said West line
to a point on said West line that is equidistant from the center line
of Higgins Road and the center line of Oakton Street; thence East parallel
with the center line of Oakton Street to the East line of Lot 2; thence North
on the East line of Lot 2 to the center line of Higgins Road; thence North
Westerly along the center line of Higgins Road to the place of beginning.

Principal Meridian, bounded ey a line described as follows: Commencing
at a point which is the intdrsection of the West line of said Lot 2 with
the center line of Higgins goad; thence South along said West line to a
point which is equidistant frota the center line of Higgins Road and the
center line of Oakton Street for the place of beginning; thence East
parallel with the center line of Oakton Street to the Fast line of said
Lot 2; thence South along the East line of Lot 2 to the center line of
Oakton Street; thence West along the center line of Oakton 3treet to the
West line of Lot 2; thence North along said West line to the place of
beginning. Subject to dedication for Oakton Street as per Document No.
9967968.

That part of the West half of the Southwest quarter of Section 22, Town-
ship 41 North, Range 11 East of the Third Principal Meridian, described
as follows: Commencing at a point in the South line of said Southwest
quarter which is 9.76 chains East of the Southwest corner of said quarter
section and running thence East 10 chains 31 links to the Southeast corner
of the West half of said quarter section; thence North 26 chains 30 links
to a point in the center line of said Highway; thence North 81 degrees
West along the center line of said Highway 10 chains 40 links; thence
