HomeMy WebLinkAboutORDINANCE - 1780 - 2/25/1986 - REZONING ON SWIATEK/ELKS CROSSINGORDINANCE NO. 1780 AN ORDINANCE REPEALING ORDINANCE NO. 1777 AND REZONING PROPERTY LOCATED AT THE NORTHWEST CORNER CORNER OF BIESTERFIELD ROAD AND ARLINGTON HEIGHTS ROAD FROM R-1 RESIDENTIAL TO B-2 COMMERCIAL (SWIATER/"ELRS CROSSING") WHEREAS, the Plan Commission of the Village of Elk Grove Village at a public meeting duly called and held according to law considered the question of rezoning property located at the Northwest corner of Biesterfield Road and Arlington Heights Road, legally described hereinafter, from R-1 Residential to B-2 Commercial; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having considered the findings and recommendation of said Plan Commission find and believe it to be in the best interest of the Village that said property be rezoned as requested; and WHEREAS, the Village has heretofore adopted Ordinance No. 1777, which Ordinance rezoned the property subject hereto but which Ordinance did not contain certain conditions which the Plan Commission had recommended be applicable to the develop- ment of the subject property, as rezoned; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Ordinance No. 1777 be and is hereby repealed. Section 2: That the property located at the Northwest corner of Biesterfield Road and Arlington Heights Road, which property is legally described on Exhibit 1 attached hereto, be and the same is hereby rezoned from R-1 Residential to B-2 Commercial, subject to the following conditions: i) That no restaurant use shall be located on that portion of the property legally described on the attached Exhibit 1 which is located at the Southwest portion thereof and which is identified as Outlot A on the one (1) page Site Plan prepared by Patrick F. Daly & Associates and bearing a last revision date of February 3, 1986. ii) That prior to the issuance of the first Occupancy Permit for the property legally described on the attached Exhibit 1, the Developer thereof shall obtain the approval of the Plan Commission to a screening plan for the property legally described on the attached Exhibit 1 and for the seven and one-half (7h) acre parcel adjacent to the West boundary of the property legally described on Exhibit 1 attached hereto, for which seven and one-half (7h) acre parcel the Developer has informed the Village that it possesses a valid purchase option. Section 3: That the Village Clerk is hereby authorized to amend the Official Zoning Map of the Village to incorporate the changes set forth herein. Section 4: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form. Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 0 ABSENT: 1 OPM ATTEST: Patricia S.
