AN ORDINANCE GRANTING A SPECIAL USE PERMIT
TO CRANE -FORESTER TO PERMIT THE CONSTRUCTION
AND OPERATION OF A HOTEL LOCATED ON THE
WEST SIDE OF BUSSE ROAD, APPROXIMATELY FIVE
HUNDRED (500') FEET NORTH OF OAKTON STREET,
ELK GROVE VILLAGE
WHEREAS, the Plan Commission of the Village of Elk
Grove Village, acting as a Zoning Commission, conducted
a public hearing to conpider the question of granting a
Special Use Permit to Crane -Forester to permit the construc-
tion of a Hotel on property located on the West side of
Busse Road, approximately five hundred (500') feet North
of Oakton and legally described on Exhibit A attached hereto;
and
WHEREAS, the President and Board of Trustees of
the Village of Elk Grove Village after having considered
the recommendations of said Plan Commission find and believe
it to be in the best interest of the Village that such Special
Use Permit be granted, subject to the conditions hereafter
set forth;
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village, an
Illinois home rule municipality, Counties of Cook and DuPage,
Illinois as follows:
Section 1: That a Special Use Permit be and the
same is hereby granted to Crane -Forester or an affiliated
entity (Developer) to permit the construction of a Hotel
in an I-1 restricted Industrial District on property located
on the West side of Busse Road approximately five hundred
(500') feet North of Oakton Street, which property is legally
described on Exhibit A, said Special Use Permit to be subject
to the conditions as set forth in Section 2 herein.
Section 2: The granting of the Special Use Permit
as set forth in Section -1 of this Ordinance shall be subject
to the following variations and conditions:
A. That a variation be granted of Sec. 3.55C
of the Zoning Ordinance to permit parking
within the required front yard.
B. That a variation of Sec. 3.97, Off -Street
Loading Space, be granted so as to require
one loading space for the subject property.
C. That the following variations of the Sign
Ordinance of the Village are hereby granted:
i. That a variation be granted to permit
a free standing identification sign at the
Northeast corner of the subject property front-
ing Busse Road, which sign is identified as
P-312 on the Site Plan of the subject property
in order to permit a three hundred twelve
(3121) square foot per face sign at said loca-
tion provided said sign shall not exceed sixty
(60') feet in heighth.
ii. That a variation of be given to permit
a second free standing identification sign
fronting Busse Road, which sign is identified
as P-182 on the Site Plan to permit said sign
to have one hundred eighty-two (1821) square
feet per face, plus thirty-six (36') square
feet per face for a message board, provided
said sign shall not exceed thirty-five (35')
feet in heighth.
iii. That a variation be given for a free
standing identification sign fronting Old

Higgins Road, said variation to permit said
identification sign to be one eighty-two (182')
square feet per face, provided that said sign
shall not exceed thirty-five (35') feet in
heighth.
iv. That a variation be granted to permit
one (1) identification sign located in front
of the main entrance of the Hotel as depicted
on the Site Plan as sign P-32 to permit said
sign to be thirty-two (32') square feet per
face provided said sign shall not exceed twelve
feet six inches (12'6") in heighth.
v. That a variation be given to permit
exempt directional signs so as to permit said
signs to be thirteen (131) square feet per
face and be located as depicted on the Site
Plan.
D. That a variation be granted of the Zoning
Ordinance as it pertains to the size of parking
stalls so as to permit parking stalls of nine
feet by twenty feet (9' X 20') provided that
should the Village reduce the parking stall
dimensions pursuant to a text amendment to
the Zoning Ordinance, that the Developer be
permitted to reduce the width and length of
the parking stalls in conjunction with any
such text amendment.
E. That a variation of the applicable provi-
sions of the Zoning Ordinance and Sign Ordinance
of the Village be granted for the existing
billboard on the subject property which has
present dimensions of fourteen feet by forty-
eight feet (14' X 48') and a heighth of seventy-five
(75') feet to permit the same for a period
of not to exceed twelve (12) years from the
effective date of this Ordinance provided
that said sign is relocated to the Northwest
corner of said subject property as depicted
on the Site Plan and further provided that
said sign be removed within thirty (30) days
from the termination of the aforesaid twelve
(12) year period.
F. That the alley requirements of Sec. 8.004
of the Subdivision Control Ordinance be and
the same are hereby waived for the subject
property.

G. That the owner provide a left turn bay
for North bound Busse Road pursuant to Illinois
Department of Transportation requirements
prior to occupancy.
H. That a variation of the Subdivision Control
Ordinance of the Village be granted to permit
fire hydrants to be located a maximum of three
hundred thirty (3301) feet apart for hydrants
fronting Busse Road.
I. The Developer shall cause the property
to be improved in general conformity with
the Site Plan dated February 4, 1985, a copy
of which is on file in the Office of the Village
Clerk and by this reference is incorporated
herein, said improvements to be made subsequent
to the filing of a Final Plat of Subdivision
and supporting documents in accordance with
the Subdivision Control Ordinance of the Village
except as -otherwise provided herein and as
necessarily modified to solve engineering
layout and/or design problems not reasonably
foreseeable at the time of the execution of
this Agreement. Any minor change to the Site
Plan necessary to accommodate such problems
must be approved by the Village Manager, who
is authorized hereby to give such approval
without prior consent or further action of
the Corporate Authorities.
J. That the Special Use Permit herein granted
shall be perpetual provided, however, that
this Special Use Permit shall terminate two
(2) years from the date hereof if construction
is not commenced pursuant to a Building Permit
issued by the Village, unless said Special
Use Permit is otherwise extended by the Presi-
dent and Board of Trustees. Consideration
of such extension shall not require a public
hearing.
K. All off-site sanitary sewer facilities
servicing the subject property shall be dedi-
cated to the Village and be constructed and/or
improved as approved by the Village Engineer.
Section 3: Except as otherwise provided herein,
all development and construction on the subject property

shall comply with the provisions of the Building, Electrical,
Fire Prevention, Zoning and Subdivision Codes of the Village
in effect on the date hereof; provided that the Village
reserves the right to amend, by general ordinance, the Build-
ing, Electrical and Fire Prevention Codes, including fees
set forth therein, affecting the development as may be neces-
sary for the protection of the public health, welfare and
safety.
Section 4: The Village shall issue all building,
occupancy and utility tap -on permits and all other permits
necessary to develop the subject property in accordance
with the provisions of the applicable Village Ordinances,
Codes and Regulations.
Section 5: The Village Clerk is hereby authorized
to publish this Ordinance in pamphlet form, together with
all documents incorporated by reference herein.
Section 6: That this Ordinance shall be in full
force and effect from and after its passage, approval and
publication according to law.

LEGAL DESCRIPTION
That part of the East half of the Southeast quarter of Section
22, Township 41 North, Range 11 East of the Third Principal
Meridian described as follows: Commencing at the Southeast
corner of said Southeast quarter; thence North along the
East line of said Southeast quarter 438.15 feet to the center
line of Higgins Road as originally laid out for the place
of beginning; thence Northwesterly along said center line,
being along a line that forms an angle of 41 degrees 11
minutes to the left with the prolongation of the last described
course, a distance of 547.45 feet; thence North parallel
with the East line of said Southeast quarter, 331.01 feet
to the Southerly line of a fifty foot wide strip of land
lying Southerly of the Southerly right of way line of the
Northwest Toll Highway; thence Southeasterly along the Southerly
line of said fifty foot wide strip of land 513.73 feet to
the East line of said Southeast quarter; thence South along
said East line 376.85 feet to the place of beginning. (EXCEPT
the East 50.0 feet thereof) and containing 2.5 acres in
