AN ORDINANCE ANNEXING AND REZONING
CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE
(BOULEVARD CORPORATION)
WHEREAS, a written Petition has been filed with the
Village Clerk of Elk Grove Village by Harris Trust & Savings
Bank as Trustee under Trust Agreement dated March 20, 1967
and known as Trust No. 32670, owner of record of the herein-
after described land and territory, said Petition being
for annexation to the Village of Elk Grove Village; and
WHEREAS, said land and territory is not within the
corporate limits of any municipality but is contiguous to
the Village of Elk Grove Village, and has no electors residing
thereon; and
WHEREAS, all applicable provisions of the Illinois
Revised Statutes pertaining to annexation and requisite
notice therefor have been complied with and adhered to;
and
WHEREAS, the Plan Commission of the Village of Elk
Grove Village, acting as a Zoning Commission, conducted
a public hearing duly called and held according to law to
consider the question of annexing and rezoning said property
to the Village of Elk Grove Village; and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage,
Illinois after having examined said Petition to Annex and
the findings of said Plan Commission find and believe it
to be in the best interest of the Village that said land
and territory be annexed to the Village of Elk Grove Village
and be zoned as a B-2 Business District, including the Special
Uses incorporated therein;
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village, Coun-
ties of Cook and DuPage, Illinois as follows:
Section 1: That the land and territory described
in Exhibit A attached hereto and incorporated herein, which
territory is contiguous to the Village of Elk Grove Village
and is not within the limits of any municipality, be and
the same is hereby annexed to the Village of Elk Grove Village.
Section 2: That said property shall, upon annexation,
be zoned B-2 Business, in accordance with the findings of
the Plan Commission upon a Petition for rezoning by the
owner so that hereafter said territory shall be included
within the boundary lines and limits of said Village of
Elk Grove Village, as is by law in such cases made and pro-
vided.
Section 3: That the Village Clerk of the Village
of Elk Grove Village is hereby directed to record a certified
copy of this Ordinance together with an accurate Plat of
Annexation of said territory with the Recorder of Deeds
of Cook County, Illinois and is further directed to amend
the Zoning Map of the Village in accordance with the provisions
hereof and to file such Notice of Annexation as is required
by law.

Section 4: That the annexation of the property herein
is subject to the condition that the Village grant a Special
Use Permit to the owners permitting three (3) restaurant
buildings, an office building and a warehouse/commissary
building as a Special Use in the B-2 Business District.
Section 5: That the Village Clerk is hereby directed
to publish this Ordinance in pamphlet form.
Section 6: That this Ordinance shall be in full
force and effect from and after its passage, approval and
publication according to law, provided the contract purchaser
consummates the purchase of the subject property and takes
title thereto and shows the Village evidence thereof. Should
the contract purchaser fail to produce such evidence within
a six (6) month period from the date of passage of this
Ordinance, then this Ordinance shall be deemed null and
void.

That part of the West 1/2 of the Northwest 1/4 of Section
26, Township 41 North, Range 11 East of the 3rd Principal
Meridian, except the South 82.50 feet thereof lying East of
the East line of the 200 foot strip of land conveyed to the
County of Cook by deed recorded January 12, 1939 in the
Recorders Office of Cook County, Illinois as Document
Number 12259408 and lying South of a line drawn at right
angles to the East line of said 200 foot strip of land from
a point on said East line of said 200 foot strip of land,
1957.80 feet South (as measured along the East line of said
200 foot strip of land) of the North line of the Northwest
1/4 of said Section 26, in Cook County, Illinois.

East of the 3rd Principal Meridian lying Southerly and
Westerly of the center line of Higgins Road, East of the
East line of said 200 foot strip of land and lying
Northerly of a line drawn at right angles to the East line
of said 200 foot strip of land from a point on said East
line of said 200 foot strip of land, 1957.80 feet South, as
measured along the East line of said 200 foot strip of
land; of the North line of the Northwest 1/4 of said
Section 26, Cook County, Illinois.
