HomeMy WebLinkAboutORDINANCE - 1709 - 4/9/1985 - RECAPTURE COSTS/INTERSECTION IMPROVE.ORDINANCE NO. 1709 AN ORDINANCE PROVIDING FOR THE RECAPTURE OF COSTS FOR THE RECONSTRUCTION OF INTERSECTION IMPROVEMENTS AT HIGGINS ROAD, KING STREET AND STANLEY STREET WHEREAS, the Village of Elk Grove Village has constructed the intersection of Higgins Road, King Street and Stanley Street at a cost of $137,286.18, and WHEREAS, said improvement will serve to benefit the general community and certain properties, hereinafter designated, which may annex to the Village in the future, and WHEREAS, the Village has allocated a certain portion of the cost of said improvement to the parties benefitted by same based on a formula based on a percentage of total area which will benefit from this improvement; with the Village assuming a certain portion of said costs. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, that; SECTION 1: The construction cost of the intersection improvement ($92,177.53), the engineering costs ($20,377.15) and right of way costs ($24,731.50) shall be allocated as follows: 1. The Village shall pay $68,643.09 (500) of the total cost as its share. cont'd... Page 2 2. The remaining costs ($68,643.09) shall be collected at the rate of $873.32 per acre for all unincorpor- ated properties (78.6 acres) presently existing in the benefitted area. This area lies south of Higgins Road, west Of Lively Boulevard, north of Oakton Street and east of Wildwood Road. SECTION 2: The Village has paid the full cost of the construction, engineering and right of way. The cost to the remaining parties shall be recaptured by the Village when said prop- erties are annexed to the Village. SECTION 3: The Village has caused the installation of traffic signals at this intersection at no cost to the Village or surrounding properties. SECTION 4: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTES: AYES_ NAYS 0 ABSENT 1 PASSED this 9th day of Aori1 , 198 r, . Peterson, Village Engineer SUBJECT: HIGGINS/KING/STANLEY RECAPTURE ORDINANCE I recommend the attached Recapture Ordinance be approved by the Village Board. The ordinance calls for the recapture of 500 of the cost for the reconstruction of the intersection at Higgins Road, King Street and Stanley Street. As the attached recapture calcu- lations show, half of the benefit of the improvement goes to existing incorporated properties north of Higgins Road. As such, only 50% of the Village's out-of-pocket cost of $137,286.18 could be recaptured from the 78.6 acres of unincorporated properties south of Higgins Road. This equates to $873.32 per acre. RECAPTURE DISTRIBUTION $ 9,570.99 4,690.00 6,116.16 24,731.50 92,177.53 $137,286.18 The intersection improvement completed in 1984 benefits not only the unincorporated properties (Exhibit A) in an area bounded by Higgins, Oakton, Shadywood and Lively but also the incorporated properties to the north. Two alternatives are shown here to distribute the costs. The first assigns the total Village Cost to be recaptured from the 78.6 acres of unincorpor- ated properties when annexed. The second assumes that one-half of the signal benefit goes to properties north of Higgins Road and, as such, half of the cost is paid by the Village. ALTERNATE A. All recapture costs assignable to the 78.6 acres of unin- corporated properties. See the attached exhibit for properties included. $137,286.18 = 78.6 acres = $1,746.64 ALTERNATE B. Recapture Costs are split equally (50/50) between the unincorporated properties (78.6 acres) and Elk Grove Village. $137,286.18 1 2 + 78.6 acres = $873.32 Cont'd.... Page 2 The reason for this split is because the improvement will not only benefit properties to the south but has benefitted properties to the north. The signal was warranted because of the existing traffic on Higgins Road and King Street, not because of a need along Stanley Street or because of projected traffic from the unincorporated areas. The widening of King Street and the left turn lane on Higgins Road to northbound King Street are unrelated to the unincorporated properties. Had the unincorpor- ated properties annexed, they would have had to provide a left turn lane to southbound Stanley Street, and widen and realign Stanley Street. (The left turn lane has not yet been constructed on the east leg and will be a future private responsibility). The traffic signal at Higgins Road and King Street was installed by MOT without any funding from the Village. We do share in the maintenance and energy cost.
