HomeMy WebLinkAboutORDINANCE - 1714 - 4/23/1985 - REZONING/TRANSUNIONNO. 1714 AN ORDINANCE REZONING CERTAIN PROPERTY WITHIN THE VILLAGE OF ELK GROVE VILLAGE FROM R-3 RESIDENTIAL TO B-2 AND B-3 BUSINESS (TRANSUNION) WHEREAS, the Plan Commission of the Village of Elk Grove Village acting as a Zoning Commission, conducted a Public Hearing duly called and held according to law to consider the question of rezoning certain parcels of property from R-3 Residential to B-2 Business (General) and B-3 Business (Automotive) respectively; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation of said Plan Commission find and believe it to be in the best interest that such rezoning be granted subject to the terms and conditions generally set forth in the findings of said Plan Commissin; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the property designated as Parcel A on Exhibit A attached hereto and incorporated herein be and the same is hereby rezoned from R-3 Residential to B-2 Business District (General) and that the property designated as Parcel B on Exhibit A attached hereto be and the same is hereby rezoned from R-3 Residential to B-3 Business District (Automotive Oriented) subject to the following terms and conditions: 1. The construction and development of the subject property shall be in substantial conformance with the conceptual Site Plan dated February 26, 1985 prepared by Enviro-Technics Ltd. 2. A Screening and Landscape Plan for the entire parcel shall be submitted to and approved by the Plan Commission of the Village of Elk Grove Village, which approval, or lack thereof, shall be subject to final review by the President and Board of Trustees. Said Plan and the approval thereof shall adher to Village requirements therefor and must be approved prior to the issuance of any Building Permits for the subject property. 3. Screening of Phase I and Ia, as well as berming and seeding of Phase II, all as depicted on the conceptual Site Plan must be completed prior to the issuance of Occupancy Permits for Phase I and Ia. 4. Screening of Phase II must be completed prior to the issuance of Occupancy Permits for Phase II or within two (2) years of the date of the issuance of the Occupancy Permit for Phase I. The Developer shall provide the Village with acceptable assurances for the installation of the screening for Phase II, which assurances may include a letter of credit or such other surety as is acceptable to the Village. 5. A Lighting Plan with a nonglare concept must be approved by the Village prior to the issuance of Building Permits for any individual Phase. 6. Prior to the issuance of any Building Permits for Phase II, a conceptual Site Plan therefor must be approved by the Village Board after review and recommendation by the Plan Commission. 7. Subject to approval by the Cook County Highway Department, the Developer shall install a decelera- tion lane on southbound Meacham Road for the northern most entrance of Phase I of the subject property. The Village agrees to assist the Developer in obtaining necessary County approval. Section 2: That the Village Clerk is hereby directed to amend the Zoning Map of the Village to reflect the above rezoning. -2- Section 3: That the Village Clerk is further directed to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
