HomeMy WebLinkAboutORDINANCE - 1722 - 5/14/1985 - FIRE PREVENTION CODE AMENDEDORDINANCE NO. 1722 AN ORDINANCE AMENDING ARTICLE III, FIRE PREVENTION CODE OF CHAPTER 6 OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, an Illinois home rule municipality located in the Counties of Cook and DuPage, Illinois as follows: Section 1: That Article III, Fire Prevention Code, of Chapter 6 of the Municipal Code of the Village of Elk Grove Village be and the same is hereby amended in its entirety, said Article as amended is set forth in Exhibit A attached hereto and by this ref- erence incorporated herein. Section 2: That the Village Clerk is hereby authorized fo publish this Ordinance in pamphlet form. Section 3: Any person, firm or corporation violating any of the provisions of this Ordinance shall be subject to a fine of not less than Ten ($10.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense, and a separate offense shall be deemed committed on each day during or on which a violation or failure to comply occurs or continues. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Smith Village Clerk 1985 RDINANCE NO. 1722 AN ORDINANCE AMENDING ARTICLE III, FIRE PREVENTION CODE OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, an Illinois home rule municipality located in the Counties of Cook and DuPage, Illinois, as follows: Section 1. That Article III, Fire Prevention Code, of Chapter 6 of the Municipal Code of the Village of Elk Grove Village be and the, same is hereby amended in its entirety, said Article as amended is set forth as follows: Article III - Fire Prevention Code 6.301 - Adoption There is hereby adopted by the Village of Elk Grove Village for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion the BOCA (Building Officials & Code Administrators International Inc.) Basic National Fire Prevention Code 1984 Edition, save and except such portions as are hereinafter deleted, modified or amended. 6.302 - Copies Of Code Three (3) copies of the 1984 BOCA Basic National Fire Prevention Code, (Building Official and Code Administrators International Inc.) as adopted herein are on file in the office of the Village Clerk. (Article III Of Chapter 6 repealed & amended by Ordinance No. 837 passed 12/05/72.) (Article III of Chapter 6 repealed & amended by Ordinance No. 1244 passed 09/12/78.) (Article II Of Chapter 6 repealed & amended by Ordinance No. 1546 passed 11/09/82.) Article III - Fire evention Code Page 2 6.303 Section F-100.1 Insert Village of Elk Grove Village in the space for name of jurisdiction. 6.304 - Appeals Section F-104.1 and 104.2 of the 1984 BOCA Basic National Fire Prevention Code are hereby deleted and amended to read: Section F-104.1 Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the provisions of the code have been misconstrued and wrongly interpreted, the applicant may, upon payment to the Village Treasurer a sum equal to the estimated cost for publication and court reporter services, appeal from the decision of the Chief of the Fire Department to the President and Board of Trustees within thirty (30) days from the date of the decision of the modification application. Section F-104.2 The said President and Board of Trustees shall designate a time and place for a public hearing thereon and the applicant and Fire Chief may present pertinent information. The decision of the President and Trustees shall be final. A refund of the money not used for the foregoing shall be made to the applicant by the Village Treasurer. 6.305 - Permits Section F-103.0 Delete the entire section. 6.306 - Permits Those sections of the Fire Prevention Code making reference to permits being required are hereby deleted. Article III - Fire evention Code Page 3 6.307 - New Material or Processes Add Sections F-108.0 New Materials or Processes Which May Require Permits. The Chief of the Fire Department, the Officer in charge of the Fire Prevention Bureau and the Building Commissioner shall act as a Committee to determine and specify, after giving affected person an opportunity to be heard, whether certain specifications and materials not presently enumerated in the Code, may be allowed in addition to those now enumerated in said Code. The Chief of the Fire Department shall post such list in a conspicuous place in the Fire Department Headquarters.Fire Station, Office of the Building Department, Office of the Village Clerk, and make copies thereof available to other persons. 6.308 - Definitions Section 201.0 Add the following: A. Whenever the word "Municipality" is used in the Fire Prevention Code, it shall be held to mean the Village of Elk Grove Village. B. Whenever the term "Corporation Counsel" is used in the Fire Prevention Code, it shall mean the Village of Elk Grove Village. C. Whenever the term "Village Manager" is used in this Fire Prevention Code, it shall mean the Village Manager of the Village of Elk Grove Village. D. Whenever the term "Fire Official" or "Chief of the Fire Prevention Bureau" is used in this Fire Prevention Code, it shall mean the Fire Chief of the Fire Department of the Village of Elk Grove Village. E. Whenever the term "Building Commissioner" is used in the Fire Prevention Code, it shall mean the Building Commissioner of the Village of Elk Grove Village. Article III - Fire evention Code Page 4 6.309 - Fireworks Section F-2700.4 Delete the definition and add the following: Definition: The definition of fireworks is as defined in the Municipal Code, Chapter 23/Article 1. 6.310 - Bulk Plants Section F-2802.0 New bulk plants for flammable liquids referred to in Section F-2802.0 of the BOCA Basic National Fire Prevention Code, 1984 Edition are hereby prohibited. 6.311 - Above Ground Storage of Flammable Liquids Section 2803.1 Storage of flammable liquids in outside above ground tanks referred to in Section F-2803.0 paragraph F-2803.1 of the BOCA Basic National Fire Prevention Code, 1984 Edition is hereby prohibited. 6.312 - Storage of Liquified Petroleum Gas Section F-3000 Bulk storage of liquified petroleum gas referred to in Section F-3000.0 of the BOCA Basic National Fire Prevention Code, 1984 Edition is hereby prohibited unless: 1. A security fence six feet (6') in height with barbed wire above is constructed and provided around all such tank installations, said fence shall be so constructed as to screen from view the lower six feet (6') of the tank installations. 2. The plans for said bulk storage and construction are approved by the Fire Chief as being safe from fire hazards and in accordance with the provisions hereof. 3. That no tanks be installed in the flood plain, except when provided with devices capable of anchoring the tank to prevent its going afloat under flood conditions. That no transfilling operations will be allowed except that which is required from the mobile tank, truck or railroad car to the stationary above ground storage tank and private filling stations utilizing Liquified Petroleum Gas in company owned or leased vehicles. 4a. That it be mandatory that the person doing the transfilling operations be trained by the installing or servicing company on the safety aspect and fire prevention procedures associated with Liquified Petroleum Gas transfilling operations as approved by the Fire Department. 5. The installation shall meet the requirements of the BOCA Basic National Fire Prevention Code, Section F-3000 and the BOCA Basic National Building Code. 6.313 - Appendix A The Section for NFiPA is amended by deleting the existing listing and adding the following: The entire set of the 1984 National Fire Codes are added as a reference, and shall govern the installation and regulations pertaining to all processes and materials covered by the National Fire Codes. 6.314 - Modifications The Fire Chief may modify any provision of the Fire Prevention Code upon application in writing thirty (30) days from the date of an order by the Bureau submitted by the owner or lessee, or his duly authorized agent, when there are practical difficulties in carrying out the strict letter of the Code, provided that the spirit of the Code shall be observed and public safety secured. The particulars of such modification when granted or allowed and the decision of the Fire Chief shall be entered upon the records of the department and a signed copy shall be furnished to the applicant and to the Village Manager. Article III - Fire evention Code Page 6 6.315 - Access To Structure When access to or within a structure or an area is unduly difficult because of secured openings or where immediate access is necessary for lifesaving or firefighting purposes, the Fire Chief may require a key box to be installed in an accessible location. The key box shall be a type approved by the Fire Chief and shall contain keys to gain necessary access as required by the Fire Chief. 6.316 - Penalty Any person, firm or corporation violating any of the provisions of this Article shall be subject to a fine of not less than Ten ($10.00) dollars nor more than Five Hundred ($500.00) dollars for each offense, and a separate offense shall be deemed committed on each day during or on which a violation or failure to comply occurs or continues. 6.317 - Jurisdiction The jurisdiction of the Fire Prevention Code shall include property and structures within the Village of Elk Grove Village. 6.318 - dreation Of The Fire Prevention Bureau A Fire Prevention Bureau is hereby created in the Fire Department of the Village of Elk Grove Village. Said Bureau shall be under the direction of the Fire Chief of the Fire Department subject to the general direction of the Village Manager. Article III - Fire evention Code Page 7 6.319 - Members A. The Chief of the Fire Department shall select a person to be, in addition to any other responsibilities he may have, the Officer in charge of the Fire Prevention Bureau who shall serve in such capacity of the discretion of the Chief of the Fire Department. B. The Chief of the Fire Department may, also select additional persons as Inspectors to be assigned to the Fire Prevention Bureau under the supervision of the Officer in Charge of the Bureau. 6.320 - Duties It shall be the duty of the Officer in Charge of the Fire Prevention Bureau to: A. Enforce all laws and ordinances of the State, County and Village, covering the following: 1. The prevention of fires; 2. The storage and use of explosives and flammables; 3. The maintenance of automatic and other fire alarm systems, and fire extinguishing equipment. 4. The maintenance, regulation and adequacy of means of egress. 5. The investigations of the cause and origin of fires; 6. The Officer in Charge of the Fire Prevention Bureau shall perform such other duties as may be required from time to time, including making rec- commendations to improve this Code. Article III - Fire evention Code Page 8 B. Provide.technical staff assistance and support to the Building Commissioner of the Village of Elk Grove Village in the following areas: 1. Examination of plans for new construction, reconstruction or alteration of structures and to advise the Building Commissioner thereon of the extent of noncompliance with established Village requirements and codes relating to lifesafety, fire prevention, fire alerting and suppression systems. 2. Inspection of construction in progress to advise the Building Commissioner thereon of non- compliance with lifesafety, fire prevention, fire alerting and suppression systems previously approved for said construction. 3. Review of existing and new stand - dards, codes, and requirements to advise the Building Commissioner thereon of changes considered necessary for improved lifesafety, fire prevention, fire alerting and suppression systems. C. A report of the Fire Prevention Bureau shall be made annually to the Fire Chief and transmitted to the Village Manager of the Village of Elk Grove Village. The report shall contain all proceedings under this Code, with such data as the Chief of the Fire Department may require, including recommendations to improve the Fire Prevention Code. ORDINANCE NO. 1722 An Ordinance Amending Article III, Fire Prevention Code of Chapter 6 of the Municipal Code of the Village of Elk Grove Village was duly adopted by the President and Board of Trustees on May 14, 1985. Said Ordinance has been published in Pamphlet Form pursuant to the authority of the President and Board of Trustees, Village of Elk Grove Village, Cook and DuPage Counties, Illinois. Copies are available at the Village Clerk's Office, Municipal Building, 901 Wellington Avenue, Elk Grove Village, Illinois.
